Foreign Firms in China’s Standards Setting: Institutional Channels and Practical Pathways |

Overview

On 9 October 2026, the Central Committee of the Communist Party of China and the State Council issued a policy document on developing new quality productive forces. Among its provisions, the document encourages foreign venture-capital institutions and international standards organisations to develop in China, and it calls for actively building a global network of innovation cooperation through platforms such as jointly built science parks, Belt and Road joint laboratories and international advanced-technology application centres. For foreign-invested enterprises, the reference to standards organisations is one of the clearer signals that participation in standards work sits inside the broader market-access picture rather than outside it.

A second central document, on improving the market-access system, addresses the same theme from the angle of rules and standards. In a set of named frontier fields, it provides that key enterprises, research institutions and relevant localities should establish collaborative models for cutting-edge global scientific research, actively participate in international market-access rules and standards setting, and promote the convenient and efficient application of innovation results in key fields. Read together, the two documents frame standards engagement as part of market access.

The four-tier standards system

China’s standards system has four levels: national standards, industry standards, local standards, and group standards together with enterprise standards. National standards are developed under the national standardisation framework. Industry standards are set within a sector. Local standards are issued at the provincial level. Group standards are adopted by social organisations such as associations, and enterprises may also adopt their own enterprise standards.

For a foreign-invested enterprise, the level at which it engages determines the channel it uses and the committee it deals with. Engagement is usually a matter of joining an existing drafting or consultation process rather than of initiating a standard, and the applicable procedures are set by the standardisation rules in force.

How foreign parties take part

The following channels are a practical summary of how foreign-invested enterprises commonly engage with standardisation under the current framework. This part is presented as practical orientation and is kept separate from the official policy text above.

  • Participation as a drafting unit. A foreign-invested enterprise may take part in the formulation or revision of a national standard or an industry standard as one of the drafting units, through the process that the relevant committee applies.
  • Participation through a committee or association. An enterprise may engage through a domestic standardisation technical committee or an industry association that takes part in the relevant field.
  • Participation in group standards. An enterprise may contribute to group standards adopted by social organisations, which sit alongside national, industry and local standards.

These channels describe the ordinary routes through which enterprises engage. They do not change the procedures or the authority that the standardisation rules assign.

National standards in foreign languages

National standards published in foreign languages serve a translation and communication function: they help overseas headquarters, group affiliates and supply-chain partners understand the technical requirements that apply in China. For a foreign-invested enterprise whose parent group works in a different language, a foreign-language edition of a relevant national standard can reduce the cost of internal alignment.

The preparation and release of foreign-language editions follow the official standardisation workflow. The existence of a foreign-language edition does not by itself alter the legal status of the underlying standard, and enterprises should treat the Chinese original as the reference text.

Practical preparation points

The following points are practical observations drawn from the current standardisation management system and market-access policy. They are separated from the official policy text above.

  • Identify the committee. Establish which standardisation technical committee has jurisdiction over the field, and confirm the applicable procedure for the level of standard involved.
  • Prepare technical materials. Assemble the technical documentation and the test or verification data that a drafting or consultation process is likely to require.
  • Manage intellectual property and trade secrets. Because drafting involves sharing technical detail, arrange in advance how intellectual property and confidential commercial information will be handled during the process.

Questions enterprises commonly raise

  • “Can a foreign-invested enterprise lead a Chinese national standard?” The policy texts encourage participation; they do not confer a right to lead or direct the formulation of a national standard. Participation follows the applicable standardisation procedure, and the role an enterprise may take is determined within that procedure.
  • “Does a foreign-language edition change what applies?” No. The foreign-language edition is a translation and communication tool. The Chinese text of the standard remains the reference, and the legal status of the standard is unchanged.
  • “Is standards participation a route around sector restrictions?” No. Where a sector falls under the negative list for foreign investment or under specific licensing, those access rules continue to apply independently of any standards work.

The connection to market access

The market-access document and the new-quality-productivity document approach standards from two directions. The market-access document ties standards participation to the coordination of frontier research across enterprises, institutions and localities. The new-quality-productivity document places standards organisations within the set of actors encouraged to develop in China, alongside foreign venture-capital institutions, and links them to a global innovation-cooperation network. For an enterprise, the practical consequence is that standards engagement is best planned together with the market-access and research-collaboration questions it may already be pursuing, rather than in isolation.

Related considerations

Participation in standards work is distinct from market access in the narrower sense. The fields named in the market-access document describe where coordinated research and standards engagement is encouraged; they do not by themselves change the entry conditions for any sector. Where a sector is subject to the negative list for foreign investment or to specific licensing, the applicable access requirements continue to be governed by those rules. Enterprises should confirm sector-specific conditions against the official texts in force, and treat the practical points above as orientation rather than as a statement of entitlement.

Export controls and the unreliable-entity list: a screening guide for foreign buyers in China |

Overview

China’s export-control regime rests on a defined legal framework and a set of official listing and declaration procedures. For foreign-invested enterprises that buy, resell or re-export controlled goods in China, the practical task is not to interpret policy intent but to run a reliable screening and licensing process. This guide sets out the framework, the declaration and licensing mechanics, the recent listing actions announced by the Ministry of Commerce, and a four-dimension screening method that procurement and compliance teams can apply.

The tone throughout is deliberately procedural: the measures are described as they are published — by reference to the applicable laws and regulations, and to the stated purpose of safeguarding national security and interests and fulfilling non-proliferation and other international obligations.

The legal framework

The cornerstone is the Regulation of the People’s Republic of China on Export Control of Dual-Use Items, which has applied since 1 December 2024. It sits alongside the Export Control Law and the rules governing the Unreliable Entity List. Together they define which items are controlled, how exports are licensed, and what obligations attach to entities that are listed.

At the border, GACC Announcement No. 77 of 2026 unifies declaration standards across general trade, express and cross-border e-commerce channels, with no exception or exemption. In other words, the channel a shipment travels through does not change the declaration obligation: the same control requirements apply to a conventional container, an express parcel and a cross-border e-commerce consignment.

Declaration and licensing mechanics

For controlled items, a licence is obtained through MOFCOM’s unified business system platform. The applicant submits supporting materials including a technical description and an end-user certificate, and the review period is 45 working days. Once a licence is in hand, the declaration stage carries its own requirement: the remarks column of the customs declaration must state that the goods are export-controlled items and give the applicable control code. Getting the code right is what allows the declaration to be processed as a controlled shipment rather than as ordinary cargo.

For procurement and logistics teams, the sequence is therefore: screen the item and the counterparty, apply for the licence in good time, and make sure the customs broker carries the control marking and code into the declaration. The 45-working-day review period is the planning constraint that most often catches companies out when they treat a controlled item like a routine purchase.

Recent listing actions

Several listing actions published by MOFCOM in 2026 and late 2025 are relevant to supply-chain screening.

Export-control control list — 20 Japanese entities (29 June 2026). MOFCOM listed 20 Japanese entities assessed as participating in enhancing Japan’s military strength. The measures prohibit export operators from exporting dual-use items to those entities, and prohibit foreign organisations and individuals from transferring or providing dual-use items originating in the People’s Republic of China to them. Related activities already under way are to be stopped immediately; where an export is genuinely necessary in special circumstances, the export operator is to apply to MOFCOM. The announcement took effect on the date of publication.

Unreliable Entity List — announcement No. 10 of 2025. This listed foreign entities including an anti-drone technology company and TechInsights and its branches. The measures prohibit those entities from engaging in China-related import-export activities, prohibit them from making new investment in China, and prohibit organisations and individuals in China from conducting related transactions or cooperation with them — in particular transmitting data or providing sensitive information to them.

Export-control control list — seven EU entities (24 April 2026). In its published question-and-answer, the MOFCOM spokesperson stated that the action under law targets only a small number of EU military-related entities, and that the measures concern only dual-use items, do not affect normal China-EU trade, and that law-abiding EU entities have nothing to worry about. Before the measures were announced, China had notified the European side through the bilateral export-control dialogue mechanism.

The screening method in practice

A workable screening process runs on four dimensions:

  1. Check the control list. Compare the item against the *Catalogue of Dual-Use Items and Technologies Subject to Import and Export Licence Administration*, verifying the model and performance parameters rather than relying on a generic product name.
  2. Analyse the end-use attribute. Assess whether the item could be used in military or weapons-of-mass-destruction-related fields.
  3. Review technical parameters. Precision, speed and power are the usual triggers — for example, high-precision five-axis machining centres.
  4. Confirm the customer and the ultimate use. Establish who the end user is and what the goods will actually be used for.

Machine tools offer a concrete illustration. Control code 2B201 covers numerically controlled machine tools including lathes, milling machines, grinding machines, multi-axis machining centres and roll-forming machine tools. Indicative parameters include: a lathe with a machining diameter greater than 35 mm and a positioning accuracy of less than 6 μm; a milling machine with positioning accuracy of less than 6 μm, or two or more contouring rotary axes, or five or more simultaneous axes; and a grinding machine with positioning accuracy of less than 4 μm. These thresholds are why screening by product category alone is unreliable — the same broad category can be controlled or uncontrolled depending on its specifications.

What this means for foreign-invested buyers

  • Screen before you commit. Run the four-dimension check at the sourcing and contracting stage, not at the declaration desk, so that a control finding does not derail a shipment already in motion.
  • Budget for the licence timeline. The 45-working-day review is a planning assumption, not a formality; build it into procurement lead times for controlled items.
  • Mind the counterparty. Listing measures can prohibit transactions and cooperation, not merely the physical export of goods; check counterparties against the relevant lists before onboarding.
  • Keep the reassurance in view. The official position is that measures of this kind target specific dual-use items and specific listed entities, and do not affect normal commercial dealings; the published Q&A on the EU listing states plainly that law-abiding entities have nothing to worry about.
  • Document everything. Technical descriptions, end-user certificates and the correct control code on the declaration are the evidence base that makes a compliant shipment defensible.

Foreign Financial Institutions’ Roundtable and the Widening Use of Cross-border RMB: Shenzhen, Hetao and the Greater Bay Area |

Overview

On 21 September 2026, the People’s Bank of China (PBOC) held a roundtable with foreign financial institutions. The central bank said it listened to the views and suggestions of those institutions and studied further work on improving the business environment and advancing the high-level opening-up of the financial sector.

The roundtable is a signal-setting event rather than a rule-making one, but it sits alongside a set of concrete, measurable developments in the Guangdong–Hong Kong–Macao Greater Bay Area (GBA). Together they describe the direction in which cross-border RMB use is being extended: from trade settlement, where the numbers are already large, into capital-account entry, account opening and household-level financial services.

This note sets out the roundtable, then the Shenzhen and Guangdong figures, and finally the practical implications for foreign-invested groups and financial institutions operating in the region.

The roundtable and its context

The 21 September 2026 roundtable is the clearest recent official statement of intent on the financial-sector opening-up agenda. The PBOC’s stated purpose was twofold: to hear from foreign financial institutions and to study how to further optimise the business environment and promote the high-level opening-up of the financial industry.

For foreign banks, insurers and asset managers with a China presence, the significance lies in the channel. A roundtable is a mechanism through which operational feedback — on licensing, on cross-border fund movement, on the practical friction of doing business — reaches the regulator directly. The published account does not list individual participants or commitments, so the event is best read as a statement of engagement rather than a list of measures.

Shenzhen: the scale of cross-border RMB settlement

Shenzhen supplies the hard numbers. In the first half of 2026, the city’s cross-border RMB settlement reached RMB 3.8 trillion, up 37.9 per cent year on year. The settlement total kept Shenzhen third nationwide.

The composition matters more than the headline. Cross-border RMB receipts and payments in goods trade totalled RMB 836.4 billion, up 50.2 per cent year on year. That growth lifted the RMB share of the city’s local and foreign currency receipts and payments by nearly 5 percentage points, to 31 per cent.

In other words, roughly one yuan in three of Shenzhen’s cross-border goods-trade settlement is now denominated in RMB. For a trading or manufacturing group with a Shenzhen entity, the practical effect is that RMB invoicing is no longer a niche choice; it is a mainstream settlement option with an established banking infrastructure behind it.

Hetao: capital-account entry without a dedicated account

The most structurally interesting change is at the capital-account level. On 12 June 2026, a pilot for the facilitation of RMB capital-account entry for foreign direct investment was put into effect in the Hetao park.

Under the pilot, qualifying foreign-invested enterprises and research institutions in the park may receive overseas RMB capital directly into an ordinary RMB basic account or general settlement account. They no longer need to open and maintain a dedicated capital-account for this purpose.

That is a meaningful reduction in administrative overhead. A dedicated capital account carries ongoing obligations — separate bookkeeping, ongoing reporting, and the need to manage the account even when there is no capital movement. Allowing ordinary RMB accounts to receive capital removes a standing compliance task for the entities that qualify, and shortens the path from remittance to usable funds.

Free trade accounts and their reach

Shenzhen’s free trade account pilot has also widened. The number of pilot banks expanded to seven. Account transaction value rose by more than 90 per cent year on year, and the accounts had served more than 1,200 business entities cumulatively.

Free trade accounts are the plumbing that makes cross-border RMB and foreign-currency movement more flexible for entities that qualify for them. The doubling of transaction value, on a base that already covered a thousand-plus entities, indicates that the accounts are being used for real operational flows rather than being opened and left idle.

Guangdong: household-level and cross-border services

Guangdong’s data extend the story beyond corporate treasury into household finance. As of the end of July 2026, Hong Kong and Macao residents had opened nearly 500,000 mainland bank accounts through agency witnessing in Guangdong. Those accounts recorded over 104 million transactions, worth more than RMB 55.7 billion.

The property-purchase channel is the notable case. Greater Bay Area mainland cities were the first to run a “settle first, top up later” pilot for property purchase settlement and payment. It has supported more than 4,000 Hong Kong and Macao residents in remitting over RMB 10 billion of purchase funds. SAFE recognised the approach and promoted it nationwide, with the eligible population extended to overseas individuals generally.

Alongside these, Guangdong introduced “Yuegang Retirement Link” and “Yueao Retirement Link 2.0”, launched the country’s first batch of cross-border RMB housing provident fund withdrawal services in Guangzhou, and organised banks to match precisely with 14 Nansha start-up parks, offering simplified account opening to Hong Kong and Macao entrepreneurs.

Practical implications

Three points follow for foreign-invested groups and financial institutions.

First, the RMB share of goods-trade settlement in Shenzhen has reached 31 per cent. Treasury teams that still default to foreign-currency invoicing should treat RMB as a fully comparable option, particularly where the counterparty is in the Greater Bay Area.

Second, the Hetao capital-account pilot removes a dedicated-account requirement for qualifying entities. Groups with, or considering, a research or investment presence in Hetao should confirm eligibility, because the change reduces recurring administrative work rather than only one-off set-up cost.

Third, the free trade account expansion and the household-level services in Guangdong point in the same direction: the infrastructure for moving RMB across the boundary is being broadened at both the corporate and the individual level. For banks, that is a service-design question; for corporate groups, it is a treasury-design question.

Related considerations

The roundtable and the regional measures are complementary rather than identical. The roundtable is national in scope and engagement-focused; the Shenzhen and Guangdong figures are regional and operational. Read together, they suggest that the financial-sector opening-up agenda is being advanced through both dialogue with foreign institutions and concrete facilitation measures on the ground.

One caution on scope: this note covers cross-border RMB use and the related Greater Bay Area facilitation measures only. The broader data-zone proposals discussed in the region are a separate topic and are not analysed here.

Foreign Banks Lead the Nationwide Rollout of MNC Cross-Border Cash Pools: First Deals Land in September 2026 |

Overview

On 14 September 2026 the cross-border RMB and foreign-currency cash-pooling regime for multinational companies was extended from two pilot regions to the whole of China. The instrument is the Notice of the People’s Bank of China and the State Administration of Foreign Exchange on Matters Concerning the Cross-Border RMB and Foreign-Currency Fund Concentration Operation Business for Multinational Companies, numbered Yin Fa [2026] No. 163. Until that date the business had been tested in Beijing and Guangdong (including Shenzhen); from 14 September it is open to qualifying multinationals nationwide.

For a foreign-invested group, the interest lies less in the policy text, which has been analysed elsewhere, than in what happened in the weeks that followed. Foreign-invested banks announced their first transactions within days, provincial authorities reported their first filings, and the central bank convened a roundtable with foreign financial institutions. Read together, these developments show the regime moving from a framework on paper into live corporate treasury practice.

This note focuses on the implementation layer: the pace of the rollout, the three design changes that matter to group treasurers, the foreign banks that moved first, the first local filings in Chongqing and Sichuan, the Tianjin pilot rules, and the central bank roundtable. It is limited to the cash-pooling business and does not cover other cross-border regimes.

From two pilot regions to nationwide coverage

The regime began as a pilot in Beijing and Guangdong (including Shenzhen). From 14 September 2026 it applies nationwide. The change of geography is the headline, but its practical effect comes from the three design choices set out below.

The nationwide rollout also changes the population of eligible groups. The earlier framework was built around large, fully integrated groups with heavy cross-border flows. The notice now reaches further down the scale, so that a multinational of moderate size, with sound operations and a moderate volume of cross-border business, can take part. For a foreign-invested group that had previously judged the regime out of reach, the arithmetic of eligibility is worth revisiting.

Because the regime is now available across the country, the question for a group is no longer whether it sits in a pilot city, but whether its operating profile fits the entry conditions. That shift — from a geographic test to a profile test — is the practical meaning of the nationwide rollout.

Three changes that matter to group treasurers

Wider coverage. The notice relaxes the “large and comprehensive” entry bar, so that medium-sized multinationals whose operations are stable and whose cross-border business is moderate can also participate. The effect is to bring in groups that were previously below the standard threshold.

Greater financing flexibility. The quotas for external debt and outbound lending are raised, and the group is supported in pooling and sharing those quotas among its members. A group can therefore allocate borrowing and lending capacity where it is needed, rather than holding it entity by entity. For a treasurer, this turns a set of separate ceilings into a group-level resource.

Simpler process. The authority to handle filings and changes is devolved to the local SAFE branch where the lead enterprise is located. Changes to member enterprises that do not involve an adjustment of quotas may be handled directly at the co-operating bank. The notice also encourages the priority use of RMB.

Foreign banks move first

Foreign-invested banks were among the quickest to put the regime to use.

On 20 September 2026, HSBC Bank (China) announced that it had provided cross-border RMB and foreign-currency cash-pool services for two multinational companies, one of them Carrier. On 21 September 2026, DBS Bank (China) completed a transaction in Shanghai for a listed company that is a leader in a domestic food sub-sector. Standard Chartered Bank (China) has begun implementation.

The speed of these announcements reflects how directly the regime plugs into the multinational client base that foreign banks already serve in China. For a foreign-invested group, it means the service is available from institutions it may already bank with, rather than only from a domestic bank building the product from the ground up. For the banks, the cash-pooling business is a way to deepen treasury relationships with the groups they already serve.

The first local filings: Chongqing, Sichuan and Tianjin

Local rollout was quick as well.

In Chongqing, two multinational companies completed filings on the first day, 14 September 2026. Both are manufacturers; they are located in Banan District and Jiangjin District, and one of them is Chongqing Meilixin Technology Co., Ltd. The first-day timing shows that local filing capacity was ready when the regime took effect.

In Sichuan, a manufacturing multinational group based in Zigong completed a filing, as reported on 28 September 2026. The group’s pool covers 12 domestic member enterprises and 4 overseas member enterprises, and benefits its overseas subsidiaries in countries including Singapore, Brazil and Australia. The composition illustrates what the regime is designed for: a manufacturing group with a genuine overseas footprint, linking domestic members with subsidiaries across several continents.

In Tianjin, the SAFE Tianjin branch issued the Regulations of Tianjin Municipality on the Pilot Management of the Integrated RMB and Foreign-Currency Cash-Pool Business for Multinational Companies on 30 September 2026, numbered Jin Hui Fa [2026] No. 111. The regulations take effect 30 days after issuance. The local rule-making shows that the nationwide framework is being supplemented by provincial implementing rules, which in turn shape how a group files in that jurisdiction.

The central bank roundtable with foreign financial institutions

On 21 September 2026 the People’s Bank of China held a roundtable with foreign financial institutions. The stated purpose was to hear the views and suggestions of foreign financial institutions and to study further steps to improve the business environment and advance the high-level opening of the financial sector.

The timing, a week after the cash-pooling regime went nationwide, places the roundtable in the same policy window. For foreign banks and their clients, it indicates that foreign financial institutions are being treated as a channel for feedback as the opening measures are implemented.

Practical implications for foreign-invested groups

Three practical points follow.

First, eligibility should be re-tested. Because the entry bar has been lowered, a group that once fell outside the regime may now qualify. The test is not size alone but the stability of operations and the volume of cross-border business.

Second, quota pooling changes treasury planning. With external-debt and outbound-lending quotas raised and shareable within the group, a treasurer can plan around the group’s aggregate capacity rather than each entity’s individual ceiling. That is a planning change, not merely a filing change.

Third, the filing route is now shorter. Devolving filing and change authority to the local SAFE branch, and allowing non-quota member changes at the co-operating bank, reduces the number of steps between a decision and its implementation.

A foreign-invested group considering the regime would typically review which entities should be members, how the group’s external-debt and outbound-lending quotas are currently used, which bank will act as co-operating bank, and whether the group’s flows are best served in RMB or in foreign currency. The notice’s encouragement of the priority use of RMB is a design point worth weighing in that review.

China’s Exit and Entry Administration Regulation Takes Effect: Intermediary Filing and the Compliance Boundary | 《

Overview

The State Council’s Regulation on the Administration of Exit and Entry (《国务院关于出境入境管理的规定》), State Council Decree No. 841, took effect on 15 September 2026. It was adopted at the 90th State Council executive meeting on 29 June 2026 and promulgated on 31 July 2026, and it contains 19 articles. Its stated purpose is to regulate exit and entry administration, protect the lawful rights and interests of persons entering and leaving China, and safeguard national sovereignty, security and development interests.

Because the Regulation touches on outbound travel, it has drawn wide discussion. The official reading is narrow and specific, and it is worth setting out plainly: the rules address illegal cross-border conduct and the intermediaries that facilitate it. They do not change the position of ordinary travellers who have lawful reasons to leave China. Tourism, family visits, study and business travel are unaffected, and the nationwide arrangement under which exit-entry applications may be handled at any competent office (全国通办) remains in place.

The four strands of the Regulation

Outbound safety-risk prevention. Foreign affairs, culture and tourism and other departments are to issue overseas security reminders and destination risk alerts in a timely manner. For citizens travelling to the highest-risk destinations, or to places where serious crimes endangering personal safety are frequent, the immigration administration may, where necessary, dissuade them from going. Dissuasion is advisory in nature; it is not a prohibition.

Truthfulness of purpose. Applications for exit, entry, stay and residence must state a purpose that is genuine and lawful. The authorities may ask about the circumstances and require supporting documents; where false materials are provided or false statements made, they have the power to decide not to issue the document applied for.

Exit-restriction measures. A person who obtains documents by fraud, or who has been subject to administrative detention for illegal exit or entry, may be barred from leaving China for between six months and three years after the penalty ends. A person who engages in illegal or criminal activities abroad that harm national security and interests may, after returning, be restricted from leaving for six months to three years. Where the violation of export-control, technology import-export and similar rules could endanger national industrial or technological security, the relevant departments may decide that the person is not permitted to leave.

Intermediary services under filing. Agencies and individuals that provide exit-entry intermediary services are subject to a filing regime rather than prior administrative licensing. A newly established agency must file with the local immigration authority within 15 days of establishment; existing agencies must complete filing within 90 days of the Regulation taking effect. Overseas enterprises and institutions may not provide such services directly within China, and agencies may not handle immigration matters for civil servants, military personnel and other persons of special status.

What the filing regime requires

To be filed, an agency must be lawfully established; its responsible person must have no record of criminal punishment for an intentional crime; and it must have the appropriate professionals, funding, premises and systems for personnel management, records retention, data security and compliance management.

The Regulation also lists conduct that agencies must not engage in: false advertising; assisting in the provision of false materials; handling certificates or procedures in violation of the rules; disclosing personal information; operating beyond the scope of their filing; and assisting cross-border illegal or criminal activity. Remedies and penalties include an order to rectify within a time limit, confiscation of illegal gains, fines and revocation of the business licence.

What the Regulation does not do

Public discussion has sometimes treated the Regulation as a general tightening of outbound travel. That reading is not supported by the official material. On 10 September 2026, the China Joint Internet Rumor-Busting Platform (中国互联网联合辟谣平台) issued a clarification stating that the claim that “outbound travel will be comprehensively tightened and ordinary people will find it harder to leave” is a misreading, and it cited the joint question-and-answer responses of the responsible officials of the Ministry of Justice, the Ministry of Public Security and the National Immigration Administration.

On the official account, the rules are aimed at illegal cross-border conduct and the intermediaries that organise it. Ordinary travellers with lawful purposes — including tourism, visiting relatives, study and business — continue to travel as before. The immigration service hotline 12367 remains available for enquiries.

Implications for foreign employers and expatriate executives

For foreign-invested companies and their expatriate staff, the Regulation is best understood as a compliance matter rather than a travel restriction:

  • Check your intermediary. If the group uses an agency to handle work permits, residence permits or visa extensions for expatriate employees or their families, confirm that the agency is within the filing regime and does not operate beyond its filed scope. Because overseas entities may not provide such services directly inside China, a “group headquarters handles it from abroad” arrangement should be reviewed.
  • Keep the stated purpose accurate. Because the Regulation emphasises truthfulness of purpose, the reason recorded for an entry, stay or residence should match the documents actually held. For business travellers and assignees, this is largely a documentation discipline.
  • Note the restriction triggers. The exit-restriction provisions are tied to defined conduct — fraudulently obtained documents, administrative detention for illegal exit or entry, illegal or criminal activity abroad that harms national security and interests, and conduct under export-control or technology import-export rules that may endanger industrial or technological security. Companies with cross-border technical and export-control exposure should make sure that travel for staff involved in sensitive transfers is planned with the group’s compliance function.
  • Keep the service channel. The 12367 hotline remains the standard channel for immigration enquiries, including for companies checking procedure.

Practical steps

  • Verify the filing status and filed scope of any agency your group uses for visa or residence-permit work.
  • Align each expatriate’s recorded purpose of stay with the permit actually held, and retain supporting documents.
  • Where staff are involved in export-control-sensitive technology, coordinate travel planning with the compliance function.
  • Use the 12367 hotline for procedural questions rather than informal advice.
  • Treat the Regulation as a fact-based update: lawful outbound travel for tourism, family visits, study and business is unchanged, and the nationwide handling policy remains in effect.

Applying for a Foreigner’s Work Permit Inside China: The Nine Statutory Situations and the A/B/C Talent Categories | 境内直接申请《外国人工作许可证》:九类法定情形与A/B/C三类人才分类的实操边界

Overview

Foreign nationals who take up work in China normally need a Foreigner’s Work Permit in China (《外国人工作许可证》). The permit sits within a wider framework, but the part that most often decides whether a hire can proceed on schedule is narrower and more practical: whether the application can be made inside China, and which talent category the applicant falls into.

This note focuses on those two questions. It sets out the eligibility conditions for both the employer and the applicant, explains the A/B/C talent categories and their boundaries, and then walks through the nine statutory situations in which an applicant may apply for the work permit directly inside China without first obtaining a work permit notice abroad.

Eligibility: the employer and the applicant

The rules place conditions on both sides of the employment relationship.

On the employer side, the entity must be lawfully established and have no serious illegal or dishonest records. The post must involve a special need for which no suitable domestic candidate is available. The wage offered must be no lower than the local minimum wage. Where the sector regulator requires prior approval, that approval must be obtained.

On the applicant side, the individual must be at least 18 years old, in good health, and free of criminal record. There must be a confirmed employer in China, and the applicant must hold the professional skills or corresponding knowledge the post requires. The role must be one for which China has a pressing shortage of qualified people.

These are cumulative conditions, not alternatives. A vacancy that is real and a candidate who is qualified are not enough on their own if the post cannot be shown to need skills that are in short supply domestically.

The A/B/C talent categories

China classifies foreign workers into three categories, and the category determines the substantive thresholds that apply.

Category A — high-end foreign talent. Category A covers people who meet the “high-grade, precision and advanced, scarce” orientation and market demand. The category is exempt from age, degree and work-experience limits, and there is no numerical quota. In practice, Category A is the most flexible route and the one least constrained by the standard thresholds.

Category B — foreign professional talent. Category B requires a bachelor’s degree or above together with at least two years of relevant work experience. The applicant’s age must generally not exceed 60, though this may be relaxed where there is a genuine need. Category B is subject to quotas in line with market demand.

Category C — other foreign personnel. Category C covers people who meet domestic labour-market demand and take up temporary, seasonal, unskilled or service work consistent with national policy. The quota is set by national rules, and applicants can check the applicable arrangements through the national human resources and social security service platform.

Read together, the three categories form a ladder: A is open and uncapped, B is the mainstream professional route with degree, experience and age thresholds plus a market-demand cap, and C is a limited channel for short-term and service work.

The nine situations for applying inside China

The default route is to apply from abroad: the employer obtains a work permit notice, the applicant uses it to secure a work visa, and the work permit is then issued. But the rules allow a direct application inside China — the work permit only, without a separate notice — in nine statutory situations:

  1. Category A high-end foreign talent who entered on a lawful visa or residence document.
  2. A change of employer with the position and occupation unchanged, where the existing work-type residence permit is still valid. The original permit must first be cancelled, and the application must be made within 30 days.
  3. Foreign spouses and minor children of Chinese citizens, permanent residents, or foreigners lawfully employed in China, who hold a valid entry and residence document.
  4. Personnel in free trade zones and comprehensive innovation reform pilot zones who meet the local talent policy.
  5. Foreign personnel employed by a regional headquarters of a multinational company in China who meet the policy conditions.
  6. Foreign executives and professional technicians transferred within a corporate group to the same post.
  7. Personnel coming to China to implement intergovernmental agreements or accords.
  8. Representatives of foreign institutions in China who entered on a Z visa, or who convert from a short-term work permit to long-term employment within its validity.
  9. Other situations determined case by case by the competent approval authority — this ground cannot be applied by the applicant on their own initiative.

The list is exhaustive in form. Situation nine is a residual power of the authority, not a catch-all that an applicant can invoke.

The boundary that catches people out

The most consequential practical boundary concerns Category B and C applicants. If such an applicant entered China only on an L (tourist) or M (business) visa, and the case does not fall within the nine statutory situations, the applicant cannot apply for the work permit inside China. The application must follow the overseas route, which means leaving the country to complete it.

This is why the entry visa matters at the planning stage, not just at the border. A candidate who travels to China on a tourist or business visa expecting to convert in-country may find that the conversion is not available to them, and that the only route is to depart and re-enter under a work visa.

Separately, foreigners with permanent residence in China are exempt from the foreigner work permit when they work in the country. This follows from the Opinions on Strengthening the Service and Management of Foreigners’ Permanent Residence in China.

Processing times and channels

Processing times are set at the local level within a national framework. In the Weifang example, the statutory time limit is 20 working days and the committed time limit is 5 working days.

Channels are increasingly consolidated. In Xiangyang, Hubei, applications run through the “handle one matter efficiently” zone of the Hubei provincial government service portal, under national key matters — legal-person services — foreigner work in China “one matter”, with an offline counter at Window 26, fifth floor, Xiangyang Citizens Service Centre. The online and offline channels are a delivery mechanism; the substantive tests remain the eligibility conditions, the talent category and the nine situations set out above.

Practical implications

Three points follow for employers and HR teams.

First, decide the category early. Whether a hire is A, B or C determines the degree, experience and age thresholds that apply, and whether a quota constrains the timing. Getting this wrong late in the process is costly.

Second, check the nine situations before the candidate travels. If the hire is a B or C applicant who would enter on a tourist or business visa, and none of the nine situations applies, the in-country route is closed. Planning the entry visa correctly avoids a departure and re-entry.

Third, treat the employer-side conditions as real. Lawful establishment, clean compliance records, a genuine special need and minimum-wage compliance are all part of the test. These are the points at which an otherwise strong application can stall.

A/B/C三类人才分类

Serious Dishonesty Lists in Financial Regulation: The Rules Effective 1 October 2026 and What They Mean for Foreign Banks |

Overview

On 1 October 2026, two instruments with direct relevance to financial institutions in China took effect on the same day. The first is the Provisions of the National Financial Regulatory Administration on the Administration of Lists of Seriously Dishonest Entities (Trial), issued as NFRA Order No. 3 of 2026 on 3 July 2026. The second is the State Administration of Foreign Exchange Notice on Further Improving the Foreign Exchange Administration of Domestic Foreign Exchange Loans.

For foreign banks, foreign-controlled financial institutions and their group treasury functions, the pairing is practical rather than coincidental. One instrument defines the conduct that leads to a place on a serious dishonesty list and the consequences that follow. The other reshapes how domestic foreign exchange loans are held and settled through accounts. Together they bear on licensing, governance and day-to-day account operations.

This article sets out the official content of both instruments, the listing triggers, the account rules, and the points foreign institutions may wish to examine. It stays within the official record and does not speculate about enforcement practice.

The serious dishonesty list rules

The Provisions are issued by the National Financial Regulatory Administration as Order No. 3 of 2026 and took effect on 1 October 2026.

The listing triggers are defined by reference to specified administrative penalties. Where a party violates laws and regulations and receives one of the following administrative penalties from the NFRA or its local offices, it is to be placed on the list of seriously dishonest entities:

  • a legal entity’s business licence or operating permit is revoked;
  • a lifetime qualification is cancelled or rescinded; or
  • a lifetime ban is imposed on working in the banking sector or on entering the insurance industry.

The design is deliberate. Each trigger corresponds to a sanction of the greatest severity, so that listing follows from conduct already determined through a formal administrative penalty rather than from a separate discretionary assessment. That structure matters for how institutions keep records: the evidence that would be relevant to a listing decision is the same evidence generated by licensing, qualification and disciplinary processes.

The consequences operate at two levels. At the institution level, revocation of a licence or permit concerns the entity’s ability to carry on regulated business. At the individual level, the cancellation or rescission of a lifetime qualification, and the lifetime bans on banking work or insurance entry, attach to named persons. For a foreign-controlled institution, both levels feed into group-wide fitness and propriety assessments.

The domestic foreign exchange loan rules

The State Administration of Foreign Exchange Notice on Further Improving the Foreign Exchange Administration of Domestic Foreign Exchange Loans also took effect on 1 October 2026. It changes how domestic foreign exchange loans are administered in three respects.

First, domestic foreign exchange loans are subject to dedicated account management. The dedicated account becomes the operational locus for the loan.

Second, for qualifying domestic foreign exchange loans that have a goods or services export background, funds may be credited directly to a current-account foreign exchange settlement account. This route recognises the trade background of the borrowing and allows funds to move through the account that the trade flow already uses.

Third, settlement and purchase management is simplified, and the relevant administrative licensing is cancelled. The direction is consistent with the broader shift toward bank-handled foreign exchange business under principles of due diligence, with the administrative approval step removed where the trade background is present and conditions are met.

For a foreign bank acting as a lender, an account bank or both, the practical work is in classification and documentation: confirming which loans carry the required export background, confirming the conditions are met, and ensuring the dedicated account structure is reflected in the bank’s own procedures.

Practical implications for foreign banks and foreign-controlled institutions

Licensing and supervisory records. Because listing follows from specified penalties, the accuracy and completeness of licensing records, qualification files and disciplinary documentation become the front line. A clean and well-maintained record is the practical safeguard.

Personnel fitness and propriety. The individual-level triggers — lifetime qualification and lifetime bans — mean that senior management and key function records should be current, and that group appointments in China should be checked against qualification status.

Account operations. The dedicated account requirement and the direct-credit route for qualifying export-backed loans change operational flows. Treasury and transaction-banking teams should confirm that account structures, internal controls and reporting reflect the new rules.

Documenting trade background. The direct-credit route depends on a goods or services export background. Institutions that rely on it should be able to evidence that background, since it is the condition that opens the route.

Coordination across the group. For a foreign-controlled institution, a listing trigger at any entity or individual level has consequences beyond the entity concerned. Group compliance, legal and human resources functions should share a common view of how records are kept.

Related measures effective the same day

Two further measures took effect on 1 October 2026 and may be relevant to financial institutions with digital operations or consumer-facing lending.

The Public Security Organs’ Measures for the Supervision and Inspection of Cyberspace Security comprises 23 articles. It identifies the objects of supervision and inspection as including network operators, data processors and personal information processors. It sets out inspection methods such as online patrol, offline verification, routine inspection and special inspection. It requires that, under the coordination mechanisms for national cyber security and data security, departments strengthen co-ordination and conduct joint inspections so as to reduce the burden on enterprises. It also provides that public security organs may, based on inspection findings, require rectification, send public security advisory letters and impose penalties.

Separately, the Ministry of Finance, the People’s Bank of China and the NFRA jointly issued a notice implementing an interest subsidy policy for residential home purchase loans from 1 October 2026, with an implementation period provisionally set at one year. It is described as the first time central government finance has provided interest subsidies for commercial individual housing loans. For institutions active in mortgage lending, this is a market-development measure rather than a supervisory one, but it will affect product and channel planning over the coming year.

Practical steps

  1. Review licensing, qualification and disciplinary records for accuracy, since these are the records that correspond to the listing triggers.
  2. Confirm that domestic foreign exchange loan procedures reflect dedicated account management and the direct-credit route for qualifying export-backed loans.
  3. Check that trade-background documentation can be produced on demand for loans relying on the direct-credit route.
  4. Align group compliance, legal and human resources records so that institution-level and individual-level status can be verified consistently.
  5. Where digital operations are material, review arrangements against the cyberspace security inspection measures, including data and personal information handling.

  • 法人机构被吊销经营许可证或者业务许可证;

Traditional Chinese Medicine Knowledge Protection: What the September 2026 Draft Regulation Means for Foreign Pharmaceutical and Healthcare Companies |

Overview

On 18 September 2026, the State Council executive meeting reviewed and approved in principle the Draft Regulation on the Protection of Traditional Chinese Medicine Knowledge. In the official account, traditional Chinese medicine theory, techniques and formulas are described as important resources for China’s own innovation, and the requirement is to comprehensively strengthen their protection and management. The draft has not yet been published in full.

For foreign pharmaceutical, healthcare and wellness companies working in or with China, the development matters for a practical reason. It sits alongside a wider set of intellectual property measures that took effect or moved through the system in 2026, from the revised Trademark Law to the IP Protection and Application 15th Five-Year Plan. Together they shape how traditional knowledge, research collaboration and brand assets are documented and defended.

This article sets out the official wording, the protection system as described, the institutional arrangements in the 15th Five-Year Plan, and the practical points foreign companies may wish to consider. It deliberately does not speculate beyond the official record.

The September 2026 decision

The executive meeting approved the draft and set the direction of policy. Traditional Chinese medicine theory, techniques and formulas are treated as important resources for China’s own innovation, and the task set is to comprehensively strengthen protection and management.

The regulation is to establish a protection system for traditional Chinese medicine knowledge. Under that system, after registration and review-based recognition, a holder enjoys a set of rights: to indicate identity, to transmit and use the knowledge, to give informed consent, to share in benefits, to integrity protection, and to require disclosure of source.

The official account also encourages medical institutions to proactively investigate and discover traditional Chinese medicine proven formulas, secret formulas and techniques, and to carry out development and research on them.

Because the full text has not been published, no article numbers, effective date, registration procedure or definitional thresholds are available. Companies should treat any such details as pending until an official release appears, and should not rely on descriptions that circulate without an official source.

What the 15th Five-Year Plan already provides

The draft regulation is not an isolated initiative. The IP Protection and Application 15th Five-Year Plan (State Council document No. 30 of 2026, issued on 27 July 2026) had already placed it within a wider programme.

The Plan calls for accelerating improvement of the patent-related legal system, for comprehensively revising the Trademark Law and its implementing regulations, and for issuing the Regulation on the Protection of Traditional Chinese Medicine Knowledge. It also directs strengthening access and benefit-sharing systems for traditional knowledge, folk literature and art, and improving intellectual property protection rules for algorithms and AI-generated output as well as for platform-economy development. It further calls for exploring data intellectual property protection rules.

The Plan sets out milestones. By 2030, China’s comprehensive intellectual property strength and international competitiveness are to be further enhanced, with decisive progress in building an intellectual property power. Looking to 2035, comprehensive intellectual property competitiveness is to rank among the world’s leading.

For a company mapping its China research and brand strategy, the Plan is useful because it shows the direction of travel across several instruments at once rather than the detail of a single new rule.

Adjacent intellectual property developments in 2026

A nationwide briefing tour on new intellectual property rules began in Jinan on 20 September 2026, covering the Shandong and Anhui region. The briefings addressed three instruments.

The revised Trademark Law writes the principle of good faith into the law, targets bad-faith filings and the hoarding of trademarks, tightens supervision of trademark agencies and strengthens industry credit constraints. It was adopted on 26 June 2026 and takes effect on 1 January 2027.

The revised Regulation on the Protection of Layout Designs of Integrated Circuits brings layout designs performing functions such as integrated photonics and quantum into the statutory scope of protection and establishes an originality declaration system.

The revised Measures for the Prioritised Examination of Patents steer prioritised examination resources toward emerging industries and key core technology programmes, and establish a central-local coordination mechanism.

Read together with the traditional knowledge regulation, these measures point in a consistent direction: more explicit documentation of what is claimed, who holds it and where it came from.

Practical implications for foreign pharmaceutical and healthcare companies

Due diligence on traditional knowledge. Where a project touches formulas, techniques or sources of traditional knowledge, the rights described in the official account — identity, transmission and use, informed consent, benefit sharing, integrity protection and disclosure of source — suggest that provenance and consent questions may become part of the record. Companies may wish to document how a formula or technique was obtained and on what terms.

Collaboration agreements. Research with hospitals, institutes and practitioners should be documented, with clarity on background and foreground rights, on publication, and on how jointly created results are handled.

Patent and brand layout. The Plan’s direction on patents and the revised Trademark Law both reward early, well-documented filing strategies. A portfolio that depends on distinctive names and marks should be checked against the good-faith and bad-faith filing provisions as they take effect.

Digital and AI-related work. The Plan’s references to algorithms, AI-generated output and data intellectual property are relevant to digital health, AI-assisted screening and data-driven research, where ownership of outputs and datasets is often unsettled.

Watch the official record. Because the draft regulation is not yet published in full, the specific registration route, recognition criteria and benefit-sharing mechanics remain to be seen. Planning should be revisited when the text and any supporting measures are released.

Related considerations

Foreign-invested companies in the healthcare and wellness sectors already work within sector-specific rules on drugs, devices, healthcare services and advertising. The traditional knowledge regulation adds a knowledge-protection layer rather than replacing those rules. Keeping the two layers distinct — what may be made and sold, and what knowledge may be used and on what terms — helps avoid conflating a licensing question with a market-access question.

Hainan’s 30% value-added duty exemption after closure: where local processors still hit a wall |

Overview

Hainan’s free trade port (FTP) began island-wide closure operation on 18 December 2025. For importers and processors, the most consequential change is how “zero-tariff” treatment is now organised. After closure, the scope of zero-tariff goods moved from positive-list to negative-list management, covering 6,637 tariff lines. Alongside it sits the processing value-added rule: goods whose value-added through processing in Hainan reaches or exceeds 30% are exempt from import duty when they enter the mainland market through the “second line.”

The design intent is straightforward — let the island import inputs freely, encourage real processing on the island, and only waive the mainland-facing duty when enough value has genuinely been added locally. The operational reality, as a September 2026 industry salon in Hainan made clear, is more uneven: large and well-resourced enterprises are using the policy, while many smaller local processors say it remains out of reach.

The closure regime in numbers

Uptake has been rising. From closure through the end of July 2026, Hainan’s zero-tariff imports totalled RMB 3.624 billion, up 40.1% year on year, and the number of beneficiary entities increased to 102. Those figures cover the zero-tariff import side; the value-added exemption sits on top of it as the mechanism that decides whether processed goods can cross into the mainland duty-free.

The combination of a negative-list import regime and a value-added threshold changes the compliance question for foreign-invested manufacturers. Instead of asking whether a product is on an approved list, the practical question becomes whether the local processing step adds enough value — and whether the enterprise can document that calculation to customs standards.

Customs facilitation and designated sites

Customs authorities have paired the tax regime with throughput-oriented facilitation. Announced measures include intelligent quarantine approval operating on an “instant application, instant approval, instant completion” basis, 7×24 hour appointment inspection, a green channel for fresh agricultural products, and inspection and quarantine certificates issued “in the cloud.” These are supported by designated supervision sites, including Yangpu Port for imported grain, the Yangpu International Container Terminal for imported fruit, and the Yangpu Leima site for imported meat.

For importers, the practical value lies in predictability: appointment inspection and cloud-issued certificates reduce the standing time that erodes margins on perishable or time-sensitive cargo, and the designated-site network gives a clearer map of where specific categories must be routed.

The automotive case: from policy to products

The most visible industrial application is in vehicles. At a Hainan session of the 2026 World New Energy Vehicle Conference on 23 September 2026, officials and companies pointed to concrete results: the 30% value-added domestic-sales duty exemption has been applied, special-vehicle modification has achieved batch export, and new business models — including “both ends outside” vehicle modification outside the bonded zone and bonded maintenance of power batteries — have begun to take shape. Hainan also reported that China’s first hot-and-humid road test base for export vehicle type-setting has located in Qionghai, and set out a “three bases” strategic goal with a “chain, aftermarket, digital” direction.

The automotive picture matters beyond cars. It shows the policy working end to end — import inputs, process locally, add sufficient value, then either sell into the mainland duty-free or export. It is a template that other processing sectors can study, provided they can meet the same documentation and filing standards.

Where local SMEs hit the wall

The gap appears at the smaller end of the market. At a 21 September 2026 salon hosted under the Zhongshan deliberative platform, business representatives described a recurring problem: some local small and medium-sized processing enterprises find it hard to enjoy the 30% value-added duty exemption. The reasons cited were operational rather than conceptual — a lack of professional customs-declaration and compliance teams, operating procedures that are not clear enough, and a filing threshold perceived as high. The result, in their words, is a policy that is “visible but unusable.”

Related structural constraints were also raised: the island’s agricultural industry chain is short and breeding operations are relatively small in scale, while supporting services such as cross-border cold-chain logistics and comprehensive foreign-trade services are not yet fully developed. The enterprises’ recommendations were concrete: refine the operating procedures, simplify the filing process, lower the entry threshold, strengthen policy communication and enterprise coaching, and run regular training on closure-related compliance and import-export policy.

For foreign investors weighing a Hainan processing operation, this is a useful signal about where advisory and shared-service support is likely to be most valued in the near term.

Business-environment and digital-trade signals

Alongside the tax and customs measures, Hainan is moving on the regulatory environment. At the same salon, the provincial department for business-environment construction described work to introduce rules on “second-line port” clearance credit management and on intermediary services in government services. It also pointed to the adoption of “one consolidated inspection” and “code-based inspection” practices; a province-wide standardised catalogue of regulatory and enforcement items covering 46 fields and 6,680 items; and a reduction in existing administrative inspection items from 1,956 to 1,613. A three-year campaign on historical issues affecting enterprises reported that, of 950 identified cases province-wide, 834 had been closed, an 87.79% completion rate.

On the digital side, at a 24 September 2026 promotion event in Hangzhou, Hainan — the guest province of the fifth Global Digital Trade Expo — highlighted the operation of the world’s first commercial undersea data centre and held an entry ceremony for the first batch of enterprises into the Hainan aerospace data cross-border processing trade zone.

What foreign companies should watch

  • The value-added calculation is the pivot. Eligibility for the mainland duty exemption turns on documenting a 30%-or-above local value-added. Build the costing and documentation model before, not after, committing to an island processing line.
  • Facilitation is measurable and usable. Instant quarantine approval, appointment inspection and cloud-issued certificates are operational tools; map your cargo categories to the designated supervision sites to capture the time savings.
  • The automotive template is transferable in principle. The vehicle sector shows the end-to-end path working; sectors with comparable import-process-export flows can study it, subject to the same filing standards.
  • Support services are a live gap. The SME feedback points to demand for filing support, compliance coaching and cross-border logistics — an opening for service providers as well as a risk to plan around.
  • The regulatory environment is being tidied in parallel. Clearance-credit rules, consolidated inspection and a smaller inspection catalogue all reduce day-to-day friction for compliant operators.

Practical steps

  • Before structuring mainland-bound shipments, confirm whether your goods meet the 30% value-added threshold and prepare the supporting cost documentation.
  • Re-check product eligibility against the negative-list scope covering 6,637 tariff lines, rather than any earlier positive-list assumption.
  • Align logistics and inspection planning with the designated supervision sites and the appointment-inspection and cloud-certificate options.
  • If you rely on smaller local processors, assess their filing and compliance capacity early and consider shared or outsourced support.
  • Track the province’s clearance-credit and inspection-reform measures, which shape the operating environment for island processing.

Services Opening After the National Services Conference: Foreign-Invested Value-Added Telecom Pilots Reach 221 |

Overview

At a special press conference in late September 2026, the National Development and Reform Commission (NDRC) set out the progress of China’s drive to expand and upgrade services. The account begins with a National Services Conference held in early April 2026 and runs through the measures taken since. For foreign investors, the headline number is the growth of the foreign-invested value-added telecom business pilot, which has risen to 221 enterprises.

The press conference is a stock-take rather than a new rule. Its value lies in the official data it supplies: how many priority tasks have been set, how many supporting measures have followed, how many provinces have convened their own conferences, and how the services sector has performed. Together these figures describe the operating environment into which foreign-invested services businesses are being invited.

This note sets out the national push, the telecom pilot numbers, the macroeconomic picture, the three tracks of opening, and the practical points a foreign investor would weigh. It deals with services opening and does not cover the separate cash-pooling or manufacturing regimes.

The national push: conference, tasks and supporting measures

The sequence starts with the National Services Conference in early April 2026. After the conference, the NDRC, working with 40 departments, identified 131 priority tasks covering the two years 2026 and 2027. The task list is the organising device: it turns the conference’s direction into a set of time-bound items owned by named departments.

Within half a year, departments had issued 81 supporting measures, and more than sixty per cent of the priority work showed clear progress. At the provincial level, 27 provinces had convened their own services conferences, which is a signal that the agenda is being carried down rather than left at the centre.

For a foreign-invested services business, the structure matters as much as the numbers. A task list with named owners and supporting measures is the machinery through which access commitments reach the level at which licences and approvals are actually handled.

Foreign-invested value-added telecom pilots reach 221

The most concrete indicator for foreign investors is the value-added telecom business pilot. The first batch was launched in February 2025. Since then, 91 new foreign-invested enterprises have been added, bringing the total to 221.

Value-added telecom services are the layer of the telecom market above basic carriage — services such as app stores, internet access and related offerings. Because telecom has historically been a sector with foreign equity restrictions, the pilot is the route through which foreign-invested participation is tested. The growth from the first batch to 221 enterprises is the clearest official measure of how that route has been used.

Services as the main growth engine

The press conference also supplied the macroeconomic backdrop.

In the first half of 2026, services contributed 66.1 per cent of China’s economic growth, up 5.9 percentage points on the same period a year earlier. Since April, the services business activity expectation index has stayed above 55 per cent for five consecutive months — a level that indicates expansion in the sector’s own expectations.

Cross-border services tell a similar story. In the first seven months of 2026, spending in China by overseas visitors rose 27.8 per cent year on year, and China’s services exports rose 17.1 per cent. The two flows together narrowed the services trade deficit by about 16 per cent.

For foreign investment, the sector’s weight is direct: according to Wang Ya of the Ministry of Commerce’s foreign investment administration, services now account for about seventy per cent of foreign investment actually used. In other words, services is no longer a marginal category in inbound investment but the dominant one.

Three tracks of opening

The opening programme is described as resting on three tracks.

Widening market access. Since 2024, pilots to expand opening have been run in selected regions in three fields: cloud computing, wholly foreign-owned hospitals, and biotechnology. The plan is to steadily expand opening pilots in vocational skills training institutions, vocational colleges, and high-level science, engineering, agriculture and medical universities. Foreign institutions are to be supported in using treasury bond futures and other risk-management tools, and in lawfully conducting fund investment advisory business.

Guiding the direction of foreign investment. Foreign investment is to be guided toward producer services and modern services. The Catalogue of Industries for Encouraging Foreign Investment is to be revised and reissued. The tax exemption on imported research supplies for foreign-invested research and development centres is to be continued. Functional institutions such as regional headquarters and R&D centres are to be attracted.

Pilot demonstration. Since 2025, nine new cities have been added to the comprehensive pilot for expanded services opening. In telecom, the foreign equity caps on app stores, internet access and similar services have been removed. In healthcare, foreign doctors are supported in opening clinics, and overseas medical professionals in short-term practice. In finance, international factoring is to be explored, and cross-border trade and investment settlement is encouraged through the multilateral central bank digital currency bridge and digital RMB bilateral cross-border channels.

Alongside these, technology business incubators were for the first time graded as excellent-class or standard-class, and a first list of 416 was published. The first national platform for foreign-related legal services is being built.

Practical implications for foreign investors

Three practical points follow.

First, telecom is worth a fresh look. With foreign equity caps removed on app stores, internet access and similar services, and with 221 enterprises already in the pilot, a foreign-invested digital or e-commerce business that had assumed telecom was closed to it may find a route through the pilot.

Second, the direction of encouragement is now explicit. Producer services and modern services are named as the target, the encouraging catalogue is being revised, and the R&D-centre import exemption is being continued. A group planning a regional headquarters or a research centre has a clearer picture of where policy support points.

Third, the settlement and risk-management toolkit is widening. Support for using treasury bond futures, for fund investment advisory, and for cross-border settlement via the digital currency bridge and digital RMB channels expands what a foreign-invested financial or services entity can do onshore.

A foreign-invested services group considering China would typically map its activity against the three tracks: whether its sector has an access pilot, whether it fits the encouraged direction, and whether it can use the financial tools now on offer. The figures from the press conference — 221 telecom pilots, 66.1 per cent growth contribution, seventy per cent of inbound investment — are the official markers of how far that opening has already run.
