- China’s foreigner work permit has two routes: applying from abroad, which needs both a work permit notice and a work permit, and applying directly inside China, which needs only the work permit and is limited to nine statutory situations.
外国人来华工作许可有两条路径:境外申请需办理《外国人工作许可通知》与《外国人工作许可证》两项,境内直接申请只需办理《外国人工作许可证》,且仅限九类法定情形。
- The employer must be lawfully established with no serious illegal or dishonest records, the post must require special skills for which no suitable domestic candidate is available, and pay must be no lower than the local minimum wage.
用人单位须依法设立、无严重违法失信记录,岗位须有特殊需要且国内暂缺适当人选,工资不得低于当地最低工资标准。
- The applicant must be at least 18 years old, in good health, free of criminal record, have a confirmed employer in China, and hold the professional skills or knowledge the post requires.
申请人须年满18周岁、身体健康、无犯罪记录、境内有确定用人单位,并具备岗位所需的专业技能或相应知识水平。
- Category A (high-end foreign talent) is aligned with the “high-grade, precision and advanced, scarce” orientation and is exempt from age, degree and work-experience limits, with no quota.
A类(外国高端人才)符合”高精尖缺”导向,可不受年龄、学历和工作经历限制,且无数量限制。
- Category B (foreign professional talent) requires a bachelor’s degree or above plus at least two years of relevant work experience, with age generally not exceeding 60 and subject to market-demand quotas.
B类(外国专业人才)须具备学士及以上学位并有2年及以上相关工作经历,年龄一般不超过60周岁,并按市场需求实行数量限制。
- Category C (other foreign personnel) covers temporary, seasonal, unskilled or service work that meets domestic labour-market demand, with quotas set by national rules and checkable on the national human resources and social security service platform.
C类(其他外国人员)指满足国内劳动力市场需求、从事符合国家政策规定的临时性、季节性、非技术性或服务性工作,数量限制按国家有关规定执行,可在全国人社政务服务平台查询。
- The nine statutory situations for applying directly inside China include Category A talent already lawfully in China, job changes with an unchanged role, spouses and minor children of qualifying persons, free-trade-zone talent, regional headquarters of multinationals, intra-group transfers, intergovernmental agreements, Z-visa representatives and case-by-case approvals.
境内直接申请的九类法定情形包括:持合法签证或居留证件入境的A类人才、岗位职业不变的变更用人单位、符合条件人员的外籍配偶及未成年子女、自贸试验区人才、跨国公司在华地区总部人员、企业集团内部同岗位调动、执行政府间协议来华人员、驻华机构代表及主管部门个案认定。
- Category B and C holders who entered only on an L (tourist) or M (business) visa and fall outside the nine situations cannot apply inside China and must apply from abroad, while permanent residents are exempt from the work permit.

Overview
Foreign nationals who take up work in China normally need a Foreigner’s Work Permit in China (《外国人工作许可证》). The permit sits within a wider framework, but the part that most often decides whether a hire can proceed on schedule is narrower and more practical: whether the application can be made inside China, and which talent category the applicant falls into.
This note focuses on those two questions. It sets out the eligibility conditions for both the employer and the applicant, explains the A/B/C talent categories and their boundaries, and then walks through the nine statutory situations in which an applicant may apply for the work permit directly inside China without first obtaining a work permit notice abroad.
Eligibility: the employer and the applicant
The rules place conditions on both sides of the employment relationship.
On the employer side, the entity must be lawfully established and have no serious illegal or dishonest records. The post must involve a special need for which no suitable domestic candidate is available. The wage offered must be no lower than the local minimum wage. Where the sector regulator requires prior approval, that approval must be obtained.
On the applicant side, the individual must be at least 18 years old, in good health, and free of criminal record. There must be a confirmed employer in China, and the applicant must hold the professional skills or corresponding knowledge the post requires. The role must be one for which China has a pressing shortage of qualified people.
These are cumulative conditions, not alternatives. A vacancy that is real and a candidate who is qualified are not enough on their own if the post cannot be shown to need skills that are in short supply domestically.
The A/B/C talent categories
China classifies foreign workers into three categories, and the category determines the substantive thresholds that apply.
Category A — high-end foreign talent. Category A covers people who meet the “high-grade, precision and advanced, scarce” orientation and market demand. The category is exempt from age, degree and work-experience limits, and there is no numerical quota. In practice, Category A is the most flexible route and the one least constrained by the standard thresholds.
Category B — foreign professional talent. Category B requires a bachelor’s degree or above together with at least two years of relevant work experience. The applicant’s age must generally not exceed 60, though this may be relaxed where there is a genuine need. Category B is subject to quotas in line with market demand.
Category C — other foreign personnel. Category C covers people who meet domestic labour-market demand and take up temporary, seasonal, unskilled or service work consistent with national policy. The quota is set by national rules, and applicants can check the applicable arrangements through the national human resources and social security service platform.
Read together, the three categories form a ladder: A is open and uncapped, B is the mainstream professional route with degree, experience and age thresholds plus a market-demand cap, and C is a limited channel for short-term and service work.
The nine situations for applying inside China
The default route is to apply from abroad: the employer obtains a work permit notice, the applicant uses it to secure a work visa, and the work permit is then issued. But the rules allow a direct application inside China — the work permit only, without a separate notice — in nine statutory situations:
- Category A high-end foreign talent who entered on a lawful visa or residence document.
- A change of employer with the position and occupation unchanged, where the existing work-type residence permit is still valid. The original permit must first be cancelled, and the application must be made within 30 days.
- Foreign spouses and minor children of Chinese citizens, permanent residents, or foreigners lawfully employed in China, who hold a valid entry and residence document.
- Personnel in free trade zones and comprehensive innovation reform pilot zones who meet the local talent policy.
- Foreign personnel employed by a regional headquarters of a multinational company in China who meet the policy conditions.
- Foreign executives and professional technicians transferred within a corporate group to the same post.
- Personnel coming to China to implement intergovernmental agreements or accords.
- Representatives of foreign institutions in China who entered on a Z visa, or who convert from a short-term work permit to long-term employment within its validity.
- Other situations determined case by case by the competent approval authority — this ground cannot be applied by the applicant on their own initiative.
The list is exhaustive in form. Situation nine is a residual power of the authority, not a catch-all that an applicant can invoke.
The boundary that catches people out
The most consequential practical boundary concerns Category B and C applicants. If such an applicant entered China only on an L (tourist) or M (business) visa, and the case does not fall within the nine statutory situations, the applicant cannot apply for the work permit inside China. The application must follow the overseas route, which means leaving the country to complete it.
This is why the entry visa matters at the planning stage, not just at the border. A candidate who travels to China on a tourist or business visa expecting to convert in-country may find that the conversion is not available to them, and that the only route is to depart and re-enter under a work visa.
Separately, foreigners with permanent residence in China are exempt from the foreigner work permit when they work in the country. This follows from the Opinions on Strengthening the Service and Management of Foreigners’ Permanent Residence in China.
Processing times and channels
Processing times are set at the local level within a national framework. In the Weifang example, the statutory time limit is 20 working days and the committed time limit is 5 working days.
Channels are increasingly consolidated. In Xiangyang, Hubei, applications run through the “handle one matter efficiently” zone of the Hubei provincial government service portal, under national key matters — legal-person services — foreigner work in China “one matter”, with an offline counter at Window 26, fifth floor, Xiangyang Citizens Service Centre. The online and offline channels are a delivery mechanism; the substantive tests remain the eligibility conditions, the talent category and the nine situations set out above.
Practical implications
Three points follow for employers and HR teams.
First, decide the category early. Whether a hire is A, B or C determines the degree, experience and age thresholds that apply, and whether a quota constrains the timing. Getting this wrong late in the process is costly.
Second, check the nine situations before the candidate travels. If the hire is a B or C applicant who would enter on a tourist or business visa, and none of the nine situations applies, the in-country route is closed. Planning the entry visa correctly avoids a departure and re-entry.
Third, treat the employer-side conditions as real. Lawful establishment, clean compliance records, a genuine special need and minimum-wage compliance are all part of the test. These are the points at which an otherwise strong application can stall.

概述
外国人在中国就业,通常需要办理《外国人工作许可证》。该许可证处在一个更宽的制度框架之中,但真正经常决定一名雇员能否按期到岗的,是更具体、更实务的两个问题:能否在境内申请,以及申请人属于哪一类人才。
本文聚焦这两个问题:说明用人单位与申请人两方面的准入条件,解释A/B/C三类人才的划分及其边界,再逐一梳理可在境内直接申请《外国人工作许可证》、无需事先在境外办理工作许可通知的九类法定情形。
准入条件:用人单位与申请人
规则对劳动关系两端都设定了条件。
在用人单位一端,主体须依法设立,且无严重违法失信记录;岗位须有特殊需要,且国内暂缺适当人选;所付工资不得低于当地最低工资标准;属于行业主管部门前置审批的,须先经批准。
在申请人一端,个人须年满18周岁、身体健康、无犯罪记录;须境内有确定用人单位,并具备岗位所需的专业技能或相应知识水平;岗位还须属于国内急需紧缺的专业人员范围。
这些条件是叠加关系,而非二选一。岗位真实、候选人合格,若无法说明该岗位需要国内紧缺的技能,仍然不够。
A/B/C三类人才分类
中国把外国人才分为三类,类别决定了适用的实体门槛。
A类——外国高端人才。 A类指符合“高精尖缺”导向和市场需求导向的人员,可不受年龄、学历和工作经历限制,且无数量限制。实务中,A类是最灵活、最不受标准门槛约束的路径。
B类——外国专业人才。 B类须具备学士及以上学位,并有2年及以上相关工作经历;年龄一般不超过60周岁,确有需要的可适当放宽。B类按市场需求实行数量限制。
C类——其他外国人员。 C类指满足国内劳动力市场需求、从事符合国家政策规定的临时性、季节性、非技术性或服务性工作的人员。其数量限制按国家有关规定执行,申请人可通过全国人社政务服务平台查询适用的安排。
三者合起来构成一个阶梯:A类开放且不设数量上限;B类是主流的专业路径,设有学历、经历与年龄门槛,并受市场需求额度约束;C类是面向短期与服务性工作的有限通道。
境内直接申请的九类情形
默认路径是在境外申请:用人单位先取得《外国人工作许可通知》,申请人据此取得工作签证,随后签发《外国人工作许可证》。但规则允许在九类法定情形下直接在境内申请——只办工作许可证,无需另行办理工作许可通知:
- 持合法签证或居留证件入境的外国高端人才(A类)。
- 变更用人单位、岗位职业不变,且原工作类居留许可仍在有效期内。须先注销原许可,并在30日内提出申请。
- 中国公民、永久居留人员、合法就业外国人的外籍配偶及未成年子女,持有效入境居留证件。
- 自贸试验区、全面创新改革试验区中符合地方人才政策的人员。
- 受聘于跨国公司在华地区总部、符合政策条件的外籍人员。
- 企业集团内部同岗位调动的外籍高管与专业技术人员。
- 执行政府间协议、协定来华的人员。
- 驻华机构代表持Z字签证入境,或在短期工作许可有效期内转为长期聘用。
- 审批主管部门个案认定的其他情形——此项不得由申请人自行套用。
该清单在形式上是穷尽的。第九类是主管部门的裁量性权限,而非申请人可自行援引的兜底条款。
最容易踩线的边界
最具实操后果的边界,落在B类、C类申请人身上。此类人员若仅持L字(旅游)或M字(商务)签证入境,且不属于九类法定情形,则不得在境内直接申请工作许可,须按境外申请流程办理,即需出境完成。
这正是为什么入境签证在规划阶段就很重要,而不只是入境时的形式问题。一名候选人若持旅游或商务签证来华、期望在境内转换,可能发现并不具备转换资格,唯一路径是离境后持工作签证重新入境。
另外,在中国永久居留的外国人在华工作免办外国人工作许可。这一口径出自《关于加强外国人永久居留服务管理的意见》。
办理时限与渠道
办理时限在国家框架下由地方确定。以潍坊为例,法定时限为20个工作日,承诺时限为5个工作日。
办理渠道日趋集约。在湖北襄阳,申请通过湖北省政务服务网”高效办成一件事”专区,进入国家重点事项—法人办事—外国人来华工作”一件事”,线下窗口设在襄阳市市民服务中心五楼26号窗口。线上与线下渠道属于交付方式;实体判断标准,仍是前文所述的准入条件、人才分类与九类情形。
实务含义
对用人单位与人力资源团队而言,有三点。
其一,尽早确定类别。岗位属于A、B还是C,决定了适用的学历、经历与年龄门槛,以及额度是否影响时间安排。在流程后段才发现类别判断有误,代价很高。
其二,在候选人出行前核对九类情形。若该岗位属B类或C类申请人、且拟持旅游或商务签证入境,而九类情形均不适用,则境内路径是关闭的。把入境签证规划正确,可以避免一次离境与重新入境。
其三,把用人单位一侧的条件当成实质条件。依法设立、合规记录清白、存在真实特殊需要、符合最低工资要求,都属于审核内容。这些正是本来条件不错的申请可能受阻的地方。
