China’s 2026 Batch of Major Foreign Investment Projects: 13 Flagship Projects Worth USD 13.4 Billion | 2026

Overview

In October 2026 two strands of official information on foreign investment appeared close together. The National Development and Reform Commission (NDRC) released a new batch of 13 flagship major foreign investment projects with a planned investment value of USD 13.4 billion. Separately, the Ministry of Commerce (MOFCOM) reported that 84 key foreign investment projects had been added nationwide since the start of the year, with a total planned investment of USD 19.46 billion.

The two figures are often read together, and it is worth being precise about what they are. Both are planned investment amounts. They are not capital already paid in, and they are not a measure of realised inflows. The lists from which they come are compiled through a selection process run by central and local authorities; a company does not enter a list merely by filing an application of its own accord.

This article sets out what was announced, how the underlying mechanism works, and what the two main channels mean in practice for a foreign investor deciding where to place a project.

Key developments in 2026

The new flagship project batch. The NDRC released a new batch of 13 flagship major foreign investment projects with planned investment of USD 13.4 billion. The newly selected projects are mainly in manufacturing, including electronics manufacturing, chemicals, automobiles and electrical machinery. “Mainly in manufacturing” is the official description of how the batch is composed.

The key project statistics. MOFCOM reported that 84 key foreign investment projects were added nationwide this year, with total investment of USD 19.46 billion, spanning machinery and equipment, chemicals and energy, automobiles and healthcare. MOFCOM said it would continue to track the implementation progress of projects, foster a better business environment and further consolidate the base for attracting foreign investment.

The mechanism behind the lists. Two elements sit behind these numbers. The first is the working group for major foreign investment projects, together with rolling updates to the lists of major and key foreign investment projects. The second is the Action Plan for Stabilising, Consolidating and Improving the Use of Foreign Investment (Shang Zi Fa [2026] No. 97), dated 16 June 2026 and approved by the State Council. That document provides that reinvestment projects in China by qualifying foreign-invested enterprises may be included in the lists of major and key foreign investment projects and enjoy the corresponding support policies. It also points to the new edition of the Catalogue of Industries for Encouraging Foreign Investment as a guide for where investment should go.

The four benefits under the encouraged catalogue. Investing in an industry listed in the 2025 edition of the Catalogue of Industries for Encouraging Foreign Investment can bring four main benefits, as summarised on an official question-and-answer page. First, self-use equipment imported within the total investment amount is exempt from customs duty, except for products that the state has designated as not exempt. Second, land-intensive encouraged industrial projects receive priority in land supply, and the transfer floor price may be set at no less than 70% of the national minimum transfer price standard for industrial land at the corresponding grade; long-term leasing, leasing before transfer and flexible-term transfer are also supported in order to lower initial land costs. Third, investment in the western regions and Hainan province may pay corporate income tax at a reduced rate of 15%. Fourth, where an overseas investor reinvests profits distributed by a domestic enterprise directly, and the investee engages in an industry in the national catalogue of the 2025 edition and meets the relevant conditions, a tax credit is available.

Supporting data. The State Administration of Foreign Exchange’s Balance of Payments Report for the first half of 2026 showed equity foreign direct investment of USD 63.8 billion in the first half, up 55% year on year. Within that total, the net increase in capital funds — which reflects longer-term investment intent — was USD 43.1 billion, and reinvestment of earnings by foreign-invested enterprises in China rose 31% year on year.

Practical implications for foreign businesses

The practical question for a foreign investor is how a project reaches the point where it attracts the working group’s attention and the benefits described above. In substance there are two routes, and they are complementary rather than alternative.

The first is inclusion in the major or key foreign investment project list. This is a selection process. Projects are identified and compiled by central and local authorities according to procedure; it is not a self-declaration scheme in which a company files and automatically qualifies. Inclusion brings working-group tracking and service, and access to the green channels that accompany it. The June 2026 Action Plan adds a specific pathway for expansion: where a qualifying foreign-invested enterprise reinvests in China, that reinvestment project can itself be brought into the lists.

The second route is investment direction. Where a project falls within the 2025 edition of the Catalogue of Industries for Encouraging Foreign Investment, the four benefits described above become relevant — duty-free import of self-use equipment within the total investment, priority land supply with a floor-price mechanism, the 15% rate in the western regions and Hainan, and the tax credit for qualifying profit reinvestment. Which of these applies depends on the facts of the project and on the conditions attached to each benefit.

Two cautions belong with the numbers. First, the USD 13.4 billion and USD 19.46 billion are planned investment amounts; they should not be read as capital already deployed. Second, the figures describe projects that have passed a selection process, not the general level of foreign investment, and they are best read alongside the balance-of-payments data rather than as a substitute for it.

For a company weighing a China project, the practical sequence is therefore to check whether the intended activity falls within the encouraged catalogue, to assess whether the project’s scale and profile make it a candidate for list inclusion through the competent authorities, and to build the timing of any reinvestment decision around the availability of the tax credit. None of these steps is automatic, and each depends on the applicable rules and on the assessment of the authorities concerned.

The 140th Canton Fair: Guangzhou Customs’ 12 Facilitation Measures and the Clearance Guide |

Overview

On 9 October 2026, Guangzhou Customs held a press conference at which it released the Measures of Guangzhou Customs in Support of the 140th China Import and Export Fair of 2026 — 12 measures in total — and the Customs Clearance Guide for the 140th Canton Fair of 2026. The two documents set out how customs will handle exhibits, personnel and goods connected with the session.

This article focuses on the customs dimension of the fair. It does not restate the fair’s overall scale or its three-phase arrangement, which are covered separately. The material below reproduces the measures and the clearance guide as described by Guangzhou Customs, and separates the official description from practical observation.

The 140th Canton Fair is held in the year that marks the 70th anniversary of the fair’s founding. Guangzhou Customs notes that it has set up expedited channels for inbound exhibits at key ports at each session since the 133rd Canton Fair.

The 12 facilitation measures

The 12 measures cover a range of customs functions connected with the fair. The areas they address include:

  • Efficient clearance for exhibits and personnel — supporting the smooth entry and exit of exhibition goods and the people attending the fair.
  • On-site staffing — Guangzhou Customs dispatches officers to serve at the venue during the fair.
  • In-hall inspection of imported exhibits — a measure new to this session, described in more detail below.
  • Food and cosmetics imported for exhibition — supporting the entry of food and cosmetics to be displayed at the fair.
  • Tax treatment of exhibits purchased after the fair — supporting exhibits that are purchased after the fair in enjoying tax preferences.
  • Streamlined departure tax-refund verification — optimising the model for verifying departure tax refunds.
  • A pilot reform of “batch inspection (quarantine)” for exports — implementing the pilot for export goods.
  • Support for agricultural and food exports — a measure new to this session, described below.

The measures are published as a single document of 12 items. The list above groups them by the function they serve; it does not assign the items to numbered positions.

In-hall inspection of imported exhibits

The measure new to this session is the support for in-hall inspection of imported exhibits. Zeng Qi, deputy director of the Port Supervision Division of Guangzhou Customs, explained the background.

Under the ordinary arrangement, exhibits that require inspection must complete inspection at the port before the enterprise can move them to the exhibition hall for set-up. Under in-hall inspection, the inspection can be carried out after the exhibits reach the hall. Guangzhou Customs describes the practical effect in two ways.

First, the port unpacking step is saved. This gains time for transport and set-up, and saves logistics and warehousing costs. Second, the exhibits are unpacked only once, avoiding a second round of unpacking and moving, which reduces the risk of damage. This is described as particularly helpful for the safe set-up of high-value, precision and fragile exhibits.

Support for agricultural and food exports

The other measure new to this session concerns exports of agricultural products and food. An exporting enterprise, or a farming and breeding base, may obtain a recommendation from the agriculture and rural affairs department in advance. With that recommendation, when the enterprise submits an application for overseas recommendation to customs, it is exempt from the on-site assessment that customs would otherwise carry out.

This is a procedural facilitation on the export side. It reduces one step in the process of obtaining an overseas recommendation, and it applies to the enterprises and bases that hold the prior recommendation from the agriculture department.

The clearance guide and the first inbound exhibits

The Customs Clearance Guide for the session sets out eight areas: Canton Fair filing; approval and admission of exhibits; declaration of inbound materials; inspection and release of exhibits; supervision during the fair; disposal of exhibits; supervision of personnel and personal effects; and equipment for press interviews. The guide is the reference document for participants handling the customs side of the fair.

The first batch of inbound exhibits cleared through Guangzhou Customs on 27 September 2026, entering China through the Nansha port in Guangzhou. The batch consisted of teapots, coffee machines, ceramic tableware and similar items made in Türkiye, totalling 84 items with a combined weight of about 12.3 tonnes. By 9 October, 10 batches of exhibits had entered through ports including Nansha port and Baiyun Airport.

On the tax side, the official description is that all exhibits temporarily imported during the fair may enjoy measures such as customs officers being stationed in the exhibition hall to supervise them, and exemption from submitting a tax guarantee to customs, which reduces the pressure on enterprises’ use of funds. Exhibits that are purchased after the fair enjoy tax preferences in accordance with the applicable rules. The official framing is not that all exhibits are duty-free; it is that temporarily imported exhibits are exempt from submitting a tax guarantee, and that exhibits purchased after the fair are treated under the relevant tax preferences.

Practical notes for exhibitors

  • Plan around the two new measures. In-hall inspection can shorten the path from port to hall for fragile or high-value exhibits, and the export facilitation removes an assessment step for enterprises that hold a prior agriculture-department recommendation.
  • Use the clearance guide as the checklist. The eight areas in the guide map to the tasks an exhibitor must complete, from filing and declaration to disposal of exhibits after the fair.
  • Distinguish the two tax treatments. Temporary import is linked to exemption from submitting a tax guarantee; purchase after the fair is linked to the applicable tax preferences. These are separate matters and should be handled separately.
  • Check timing early. The first batch cleared on 27 September and further batches followed through early October, so exhibit logistics run in the weeks before the fair opens.

Domestic Foreign Exchange Loans Under Dedicated Account Management: The SAFE Notice Effective 1 October 2026 |

Overview

The State Administration of Foreign Exchange Notice on Further Improving the Foreign Exchange Administration of Domestic Foreign Exchange Loans took effect on 1 October 2026. The Notice concerns domestic foreign exchange loans — that is, foreign exchange lending between a lender and a borrower within China — and it addresses how such loans are held in accounts and how their data is reported.

The Notice is short in its core content. It provides that domestic foreign exchange loans are subject to dedicated account management; it requires lenders to report the various data items of domestic foreign exchange loan business in a timely and accurate manner in accordance with the data collection standards for foreign exchange business of financial institutions; and it makes clear that the account management system is to be improved.

This article sets out the official content of the Notice, the policy background of the multi-year facilitation packages, the recent foreign exchange reserve data, and the points foreign-invested enterprises may wish to examine. It stays within the official record and does not invent article numbers, account names or penalty provisions that are not part of the verified content.

What the Notice provides

The first point is dedicated account management. Domestic foreign exchange loans are to be administered through a dedicated account, so that the loan has a defined operational locus rather than being handled through accounts used for other purposes.

The second point is data reporting. Lenders are required, in accordance with the data collection standards for foreign exchange business of financial institutions, to report the various data items of domestic foreign exchange loan business in a timely and accurate manner. This places the reporting obligation on the lender and ties it to an existing data collection standard.

The third point is that the account management system is to be improved. This is a directional statement: it indicates that the arrangements for how the accounts are structured and administered are to be refined further.

For a foreign-invested enterprise that borrows in foreign exchange within China, or for a financial institution that lends to one, the practical centre of gravity is the dedicated account and the reporting that flows from it. The Notice itself does not, in the verified content, set out detailed account names or penalty provisions, and this article does not supply them.

Policy background: the multi-year facilitation packages

The Notice sits within a longer sequence of measures on cross-border investment and financing. At a State Council Information Office press conference on 17 July 2026, Xiao Sheng, Director of the Capital Account Management Department of the State Administration of Foreign Exchange, described that sequence.

According to that account, since 2023 the administration has rolled out “package” policies to facilitate cross-border investment and financing for three consecutive years, comprising nearly 20 measures. The measures described included facilitating the payment and use of funds by foreign-invested enterprises, supporting cross-border financing by science and innovation enterprises, reducing the negative list for the use of capital account income, and expanding the range of regions in which banks may handle foreign exchange registration. In terms of outcomes, some business processing times were shortened from three working days to same-day completion, and for some enterprises the number of documents required for review was halved.

Xiao Sheng also described a further package planned for 2026, in three categories. The first is to raise the level of facilitation for direct investment, including simplifying the procedures for settlement and payment under capital accounts. The second is to expand the high-level opening of cross-border financing, including expanding the range of entities to which cross-border financing facilitation policies apply, promoting the green foreign debt pilot nationwide, and optimising the macro-prudential management of cross-border financing. The third is to optimise the registration management of capital account business, including having some registration business handled directly by banks and increasing the types of capital account business that can be handled online.

It should be noted that these 2026 reform measures are to be released and implemented after the relevant working procedures are completed. As of the verification date, no formal document for the 2026 package had been issued, and it should not be treated as already in force. The Notice effective on 1 October 2026 is a separate, issued instrument.

Market context

Alongside the policy sequence, the administration publishes regular data on foreign exchange reserves. According to data released by the State Administration of Foreign Exchange on 7 October 2026, China’s foreign exchange reserves stood at USD 3,400.3 billion as of the end of September 2026, down USD 38.1 billion from the end of August, a decline of 1.11 percent.

This figure is background to the broader foreign exchange environment in which the account management rules operate. It is a data release rather than a statement about the Notice, and the two should be read separately.

Practical implications for foreign-invested enterprises

Financing arrangements. For a foreign-invested enterprise that borrows in foreign exchange within China, the dedicated account requirement bears on how the borrowing is set up and administered. Treasury and finance functions may wish to confirm that the account structure reflects the requirement.

Account operations. Because the loan is held through a dedicated account, the operational flow around drawdown, use and repayment runs through that account. Institutions that lend to foreign-invested enterprises should confirm that their own procedures align with the dedicated account arrangement.

Data reporting. The reporting obligation rests with the lender and is tied to the data collection standards for foreign exchange business of financial institutions. Lenders should confirm that the relevant data items are reported in a timely and accurate manner, and borrowers should be prepared to provide the information their lender needs.

Watching the pending package. The 2026 package described at the July press conference is not yet issued. Enterprises with cross-border financing plans may wish to follow official announcements, but should not treat the described measures as already effective.

Documentation. Because the Notice ties reporting to an existing data collection standard, keeping clean and current documentation of the borrowing and its use supports accurate reporting.

Related considerations

The Notice addresses domestic foreign exchange loans specifically. Other aspects of cross-border financing — such as the broader facilitation policies described at the July press conference, and the green foreign debt pilot and macro-prudential management mentioned in the planned package — are governed by their own instruments and timelines.

Foreign-invested enterprises may also consider how the Notice interacts with their wider financing structure, including the currency in which they borrow and the accounts they maintain. Because the verified content of the Notice is limited to dedicated account management, timely and accurate data reporting, and the improvement of the account management system, enterprises should look to the official text and to their banks for the detailed operational requirements.

Green and Low-Carbon Provisions in the Opinion on Developing New Quality Productive Forces | 《

Overview

The Opinion on Developing New Quality Productive Forces, issued in October 2026, sets out a framework for China’s economic development. This article looks only at one dimension of it: the green and low-carbon provisions, and what they mean in practice for foreign companies active in green industries. It does not cover the Opinion’s wider structure or its provisions on foreign venture capital and data flows, which are addressed separately.

The relevant text sits in the third part of the Opinion, “focusing on innovating the development model”. It is short but specific, and it is best read alongside the existing investment framework rather than in isolation.

What the green and low-carbon clauses say

The third part opens by setting a direction: “focusing on innovating the development model; build a green, low-carbon and circular economic system, improve the policy toolbox for green development, and actively advance the energy revolution.”

The energy paragraph then elaborates. Focused on the carbon-peaking and carbon-neutrality goals, the text calls for:

  • the orderly development of advanced nuclear fission energy;
  • building a power system with a high proportion of renewable energy;
  • improving policies for the consumption and regulation of new energy;
  • organising demonstration and roll-out of major application scenarios, and accelerating the greening of energy use across production and daily life;
  • advancing the revolution in energy consumption, supply, technology and systems, and strengthening international co-operation in all respects.

Two features stand out. First, the clause pairs generation-side language — renewable power and nuclear fission — with consumption-side language — new-energy consumption and regulation. Second, it closes with “all-round international co-operation”, which places the energy transition within a cross-border frame rather than a purely domestic one. That closing phrase is the main hook for foreign participation, and it is a statement of direction rather than a list of specific openings.

Sector boundaries: nuclear power and the negative list

The phrase “orderly development of advanced nuclear fission energy” should be read carefully. It appears in a paragraph about the energy mix, and it signals that advanced nuclear fission is part of the long-term energy picture. It does not, by itself, change the rules on who may invest in nuclear power.

Nuclear power remains a sector governed by the Catalogue of Industries for Foreign Investment and the Negative List for Foreign Investment Access. Foreign investment in nuclear power is restricted, and specific access is subject to the current negative list. A reader should therefore treat the energy paragraph as a technology-and-supply statement, not as a statement that nuclear operations are open to foreign investment. Where a project touches nuclear, the applicable rule is the negative list as it stands, not the energy clause.

The same discipline applies to the renewable-energy language. The Opinion states a direction — a power system with a high proportion of renewables, and improved consumption and regulation policies. It does not, in this text, set out capacity targets or consumption ratios. Investors should rely on the specific implementing documents that follow, not on inferred numbers.

The encouraged-investment catalogue as the practical frame

For a foreign company in green industries, the operative document is the Catalogue of Industries for Encouraging Foreign Investment. According to public reports, the 2025 edition contains 1,679 entries in total, a net increase of 205 over the 2022 edition, with 303 entries revised. Of these, the national catalogue has 619 entries (100 added, 131 revised) and the catalogue for central and western regions and other areas has 1,060 entries (105 added, 172 revised). The catalogue guides foreign investment towards advanced manufacturing, modern services and the central, western and north-eastern regions and Hainan. It takes effect on 1 February 2026, when the 2022 edition is repealed.

These figures are reported by the media and should be treated as publicly reported information rather than as text of the Opinion. Their significance for green industries is that encouraged-catalogue entries are the main mechanism through which green manufacturing, new-energy equipment and environmental services are signalled as welcome areas. A company should check whether its activity appears in the catalogue, and should read that against the sector restrictions in the negative list.

Practical implications for foreign green-industry investors

The following are practical observations, not official commitments:

  • Read the two lists together. The encouraged catalogue and the negative list work as a pair. An activity can be encouraged in general and still restricted in a specific sub-sector; the negative list governs the restriction.
  • Match the technology to the direction. The Opinion’s language points to renewable generation, new-energy consumption and regulation, and demonstration scenarios. A company whose technology fits one of these directions has a clearer policy reference point.
  • Treat nuclear separately. Given that nuclear power is governed by the negative list, a nuclear-related project should be assessed under that regime rather than under the energy paragraph.
  • Watch for implementing documents. The Opinion sets direction. Capacity targets, consumption rules and incentive details will come through separate implementing documents; those, not the Opinion alone, will carry the operational detail.
  • Use the regional dimension. The encouraged catalogue’s regional sections indicate that investment in the central, western and north-eastern regions and Hainan is a specific focus, which may be relevant to siting decisions.

Related considerations

The Opinion also frames the transition as one that runs across consumption, supply, technology and systems, and it links this to international co-operation. For a foreign investor, the practical consequence is that green-industry opportunities in China are defined by the interaction of a policy direction, the encouraged-investment catalogue and the sector restrictions in the negative list. None of these alone is decisive. The Opinion provides the direction; the lists provide the operational boundaries; and the implementing documents that follow will provide the specifics.

  • 有序发展先进核裂变能;
  • 构建高比例可再生能源电力系统;
  • 完善新能源消纳和调控政策措施;
  • 组织重大应用场景示范和推广,加速全社会生产生活用能绿色化进程;

  • For foreign companies the practical relevance is analytical rather than a formal commitment: the policy direction points to clearer registration pathways, but no specific BCI approval timelines, acceptance numbers or product names have been published.

Brain-computer interface medical devices: China’s innovative registration policy direction |

Overview

In October 2026, the 2026 International Biomedical Industry Innovation Beijing Forum was held in Yizhuang, Beijing. At the forum’s “Neuromodulation and Brain-Computer Interface Technology Industry Development Forum”, an official from the Medical Device Registration Management Department of the National Medical Products Administration (NMPA) set out the regulator’s current reading of brain-computer interface (BCI) medical devices and the registration policy direction attached to them.

According to the remarks, BCI has been incorporated into China’s 15th Five-Year Plan and written into the Government Work Report, and is expressly positioned as a future industry. On that basis, the regulator said it would put in place supporting innovative registration and management policies to systematically support the research, development and translation of BCI medical devices.

The remarks are a policy-direction statement rather than a new rule. They describe how the existing medical-device registration system is being oriented towards BCI, and they rest on a set of published industry figures that show how the registration base and the innovation-support toolkit have grown.

Key developments

The official’s remarks combined a positioning statement with concrete numbers on China’s medical-device registration landscape.

  • Registration base. As of end-July 2026, China had more than 347,000 valid medical-device registrations and filings, spanning Class III registration certificates, Class II registration certificates and Class I filings.
  • Annual approvals. In 2025, the NMPA approved 14,187 medical-device registrations, an increase of 8 per cent year on year.
  • Clinical translation programme. The “Spring Rain Action” for the translation of clinical innovations in medical devices had collected more than 400 Class III medical-device products, covering high-end tracks such as BCI, interventional surgical robots, AI diagnostic software and high-end interventional implants and biomaterials. 22 quality projects had been placed into an expedited pre-review green channel.

Read together, these figures describe a large and still-growing registration pipeline, and a deliberate effort to move selected high-end products through review faster than the ordinary queue.

Standards first: the pre-review and standards toolkit

Alongside the registration figures, the remarks described the regulator’s operating approach as “front-loading regulation and standards first”.

On standards, the BCI field has seen:

  • three industry standards issued;
  • ten national standards and three industry standards initiated (立项); and
  • one international-standard proposal submitted.

The published standards cover core technical links including EEG acquisition, signal transmission, motor-intention decoding and device reliability.

On regulation, the approach includes:

  • advance planning of regulatory-science research;
  • pre-application technical guidance for a number of both invasive and non-invasive products; and
  • unified rules for product naming and classification.

The “standards first” logic matters for a technology like BCI, where the boundary between a medical device, a consumer wearable and a research instrument can be genuinely unclear. Naming and classification rules, and the existence of standards for core components, are the practical preconditions for a device to move into a defined registration pathway.

Next steps in regulation

The official set out the next steps in general terms: continuing to deepen reform of the medical-device review and approval system and to increase support for high-end innovative devices. Specific measures mentioned included:

  • optimising the review mechanism for “globally new” products;
  • providing front-loaded services such as clinical-trial pre-review and technical consultation; and
  • thereby accelerating the market launch of landmark products.

These are direction statements. They indicate where the regulator intends to concentrate facilitation effort, not the terms on which any individual product will be reviewed.

Practical implications for foreign companies

The following points are analytical observations, not official commitments. They describe what the policy direction may mean for foreign BCI and neurotechnology companies considering the China market.

  • The direction of travel is clearer, the details are not. A stated intent to build supporting innovative registration policies for BCI signals that the regulator is treating the field as a priority. It does not, on its own, change any filing requirement, and no BCI-specific approval timeline, acceptance number or product name has been published.
  • Classification and naming are the first practical questions. Because the regulator is unifying naming and classification rules for BCI, a company’s early task is to understand how its product would be classified and named under the Chinese system, since that determines the registration pathway.
  • Standards participation is a defined channel. With national and industry standards under development and an international-standard proposal submitted, there is an active standards-setting process. Foreign companies commonly monitor or participate in such processes through their China entities or industry associations, though the terms of participation follow the applicable standards rules.
  • Patent and intellectual-property positioning deserves early attention. BCI spans hardware, signal-processing algorithms and software. Companies usually review how their patent portfolio maps onto the Chinese classification and standards landscape before committing to a registration strategy. This is a commercial and legal planning point, not a statement of any regulatory preference.
  • Translation programmes are a signal, not a guarantee. The “Spring Rain Action” pipeline shows that a subset of high-end products is being routed into an expedited pre-review channel. Being in a high-priority field is relevant context, but selection for such programmes is a separate process.

Related considerations

For a foreign company, the sensible reading of these remarks is as a map of the regulator’s priorities rather than a set of entitlements. The registration figures show scale; the standards activity shows the field maturing towards defined technical requirements; and the “front-loading” language shows where facilitation effort is being directed. A company planning a China BCI strategy would typically combine this policy context with a product-specific review of classification, standards alignment, patent position and the appropriate registration pathway, and would confirm current requirements against the latest official publications before relying on any particular route.

  • 累计发布3项行业标准;
  • 立项10项国家标准、3项行业标准;

  • 提前布局监管科学研究;
  • 对多款侵入式、非侵入式产品开展前置技术指导;

  • 优化”全球新”产品审评机制;
  • 提供临床试验预审、技术咨询等前置服务;

Visa-Free Entry to China: What It Covers and What It Does Not | 免签入境中国:可以做什么、不可以做什么

Overview

China operates several distinct visa-free arrangements for foreign nationals. They are often discussed together, but they have different eligibility rules, different permitted areas and different limits on how long a traveller may stay. This note sets out the boundaries of three of them: the unilateral visa-free policy, the 240-hour visa-free transit, and the 30-day visa-free entry to Hainan. It focuses on what a visa-free arrival does and does not permit, and on how the stay period is counted.

The starting point is that a visa-free arrangement is a limited permission, not a general waiver of visa requirements. It covers short-term visits for defined purposes, within a defined area, for a defined period. Anything outside that scope — including work, study and news reporting — still requires a visa obtained before travel.

The three arrangements

Unilateral visa-free entry. Under this policy, ordinary-passport holders from the eligible countries may enter China without a visa for business, tourism or family visits of up to 30 days. Public reports describe the list as covering 50 countries, including Canada, Australia, New Zealand, the United Kingdom, France and Germany, and state that the policy has been extended to 31 December 2026. The National Immigration Administration’s published answers set out a further breakdown: for Brunei, the visa-free policy for ordinary-passport holders has no stated end date; for Russia, it runs to 14 September 2026; and for the remaining 46 countries, it runs to 31 December 2026. The two accounts should be read against the latest official announcements.

240-hour visa-free transit. Under this arrangement, a traveller transiting China to a third country or region may enter without a visa for no more than 240 hours (10 days) within the designated areas. It requires an ordinary passport and a connecting ticket to the third country or region with confirmed dates and itinerary. Public reports describe the eligible list as having grown to 57 countries, with entry available from 65 open ports. This item rests on public reporting and should be confirmed against the National Immigration Administration’s releases.

30-day visa-free entry to Hainan. Under this arrangement, citizens of the eligible countries may enter through Hainan’s open ports and stay visa-free for no more than 30 days within the administrative area of Hainan Province. Public reports describe the eligible list as having grown to 61 countries. This item is likewise based on public reporting.

What visa-free entry allows, and what it does not

During a visa-free stay under these arrangements, a traveller may carry out short-term activities such as tourism, business and trade, visits and family visits. Activities that require prior approval — work, study and news reporting — must still be covered by a visa obtained before travelling. A visa-free arrival is therefore not a substitute for the correct permit where the purpose of the trip falls outside the permitted short-term activities.

The arrangements also differ in the area in which the visa-free stay may be spent. The 240-hour transit has designated areas, and the Hainan arrangement is confined to the administrative area of Hainan Province. Travellers should confirm the permitted area for the arrangement they intend to use, because the area condition is part of the arrangement itself.

Counting the stay and the documents required

According to the National Immigration Administration’s published answers, the visa-free stay period is counted from the day after entry and may run for 30 consecutive calendar days. In other words, the day of arrival is not counted as the first day of the permitted stay.

On documents, a foreign national using these policies should hold an ordinary passport that remains valid for the intended travel in China. Holders of documents other than an ordinary passport — such as travel documents, or temporary or emergency certificates — are not covered by the visa-free arrangements.

On tour groups, the published answers state that an eligible foreign national may use the visa-free policy whether travelling in a tour group or individually.

The answers also address the situation where a traveller who entered visa-free later loses or damages the passport. In that case, the border inspection authority verifies identity, entry records or a loss report, together with supporting materials issued by the relevant embassy or consulate in China. Where the materials are correct and there is no violation such as overstaying the visa-free period, exit procedures may be handled in accordance with the law.

Practical steps before travel

  • Confirm the arrangement that fits the trip. If the trip is a direct visit for business, tourism or family reasons, the unilateral policy may apply. If the traveller is passing through to a third country or region, the transit arrangement may apply. If the stay is confined to Hainan, the Hainan arrangement may apply.
  • Check the passport. An ordinary passport, valid for the intended travel in China, is the basic requirement for all three arrangements.
  • Prepare the supporting document for transit. The 240-hour transit requires a connecting ticket to the third country or region with confirmed dates and itinerary.
  • Match the purpose to the permitted activities. If the trip involves work, study or news reporting, obtain the visa before travelling.
  • Note the area condition. For the transit and Hainan arrangements, stay within the designated area or the province, as applicable.
  • Verify the latest list and dates. Because published counts and end dates differ, confirm against the National Immigration Administration and the relevant Chinese embassy or consulate.

Common points of confusion

  • “Visa-free” does not mean “no rules.” It is a permission with a purpose, an area and a time limit attached.
  • The 30-day period is not the same in every arrangement. The unilateral policy and the Hainan arrangement both refer to 30 days, but the transit arrangement refers to 240 hours within designated areas. These are different measures and should not be mixed.
  • A visa-free arrival is not a work permit. Employment still requires the appropriate visa and permit obtained through the proper channels.

A note on country counts and dates

The number of countries covered, and the end dates of the policies, have been described differently in different official answers and reports. The unilateral visa-free list has been described in one account as 50 countries; the 240-hour transit list as 57 countries; and the Hainan list as 61 countries. Each figure relates to a different arrangement and should not be transferred from one to another. Policy is adjusted from time to time. Before travelling, travellers should rely on the latest announcements of the National Immigration Administration and of Chinese embassies and consulates abroad.

Market Regulation Innovation Across the Whole Chain After Hainan’s Island-Wide Closure |

Overview

On 30 September 2026, the Information Office of the Hainan Provincial People’s Government held a press conference. Lin Gang, Deputy Director and Press Spokesperson of the Hainan Provincial Administration for Market Regulation, described how Hainan threads institutional innovation through the whole chain of market regulation, with the stated aim of enabling enterprises to “enter, stay and grow well”.

The account covers four stages of the regulatory chain: access, service, supervision and enforcement. Read together, they describe a shift from treating market regulation as a gatekeeping function towards treating it as a continuous relationship with enterprises, spanning entry, day-to-day operation and the cultivation of the business.

This article sets out the official content of the press conference, the measures described at each stage, the landmark project cited as evidence of the approach, and the points foreign enterprises may wish to examine. It stays within the official record and does not speculate about how the measures will be applied in individual cases.

Institutional innovation at the access stage

At the point of market entry, Hainan is deepening the commitment-based immediate-entry system for market access. Under this approach, an enterprise that makes the required commitments can enter the market without waiting for prior approval, and the reform results are to be codified in local regulations so that the arrangement rests on a firmer legal footing.

Two further access-stage measures were described. The first is to open up cross-border notarisation, authentication and identity verification channels, which concern the paperwork that foreign investors and their representatives must complete when establishing or changing an entity in China. The second is to promote integrated management of foreign investment access and market access, so that the two sets of procedures are handled in a more coordinated way rather than as separate tracks.

For a foreign investor, these points bear on the practical sequence of establishment: how identity and corporate documents are verified, and how the foreign investment access regime connects with the general market access regime.

Service and supervision along the chain

At the service stage, Hainan is establishing an enterprise classification-based service system. Alongside it, the province describes “advance assistance” in the form of tailored guidance, and a “policy express” push mechanism that delivers policy information to enterprises. The stated direction is a move from access convenience towards whole-life-cycle cultivation, so that support continues after the entity has been set up.

At the supervision stage, Hainan applies credit-risk-classified “double random, one open” supervision. Inspection frequency is set differently according to credit rating. Trustworthy operators are described as being left undisturbed, while high-risk dishonest ones are subject to focused supervision. The province is also building a province-wide unified market regulation digital platform that uses big data and artificial intelligence to identify risk indicators, with the aim of shifting supervision from post-event handling towards prevention and in-process control.

At the enforcement stage, Hainan focuses on precise enforcement in key fields, coordinating whole-chain governance in areas such as the platform economy, prices and advertising.

Taken together, the four stages describe a single design: lighter friction at entry, continued service after entry, and supervision calibrated to the risk profile of the operator rather than applied uniformly.

The landmark project cited

The press conference pointed to a landmark project as evidence of the approach in practice. Siemens Energy (Hainan) Co., Ltd. was established on 18 December 2025 in the Yangpu Economic Development Zone, described as the first landmark manufacturing foreign-invested project after the launch of island-wide closure. The company began construction of a gas turbine assembly base and a service centre at the same time.

The timing is notable because it places a manufacturing investment in the early period after island-wide closure. For foreign manufacturers considering Hainan, the project is a concrete reference point for how an establishment and a construction start can proceed under the closure arrangements.

Practical implications for foreign enterprises

Establishment sequence. The access-stage measures — commitment-based immediate entry, codified reform results, cross-border notarisation and identity verification channels, and integrated foreign investment and market access management — bear directly on how an entity is set up and how documents are verified. Foreign investors may wish to confirm the current requirements for their own corporate documents and signatory arrangements.

Whole-life-cycle service. The service-stage measures suggest that after establishment, an enterprise may receive classification-based guidance and policy notifications. Understanding how an enterprise is classified, and which policy channels apply, can help a new entity make use of the available support.

Supervision by credit profile. Because inspection frequency is set by credit rating, the accuracy of an enterprise’s records and its compliance history become operational factors. A clean record is described as attracting lighter supervision, while high-risk dishonest conduct attracts focused attention.

Enforcement focus. The enforcement-stage priorities — platform economy, prices and advertising — indicate the fields in which whole-chain governance is being coordinated. Enterprises active in these areas may wish to review their arrangements accordingly.

Related considerations

The press conference should be read alongside the broader closure framework. Hainan’s island-wide closure is a system of arrangements that includes customs and tax treatment; this article addresses only the market regulation and access-side institutional innovation described at the press conference and does not restate customs or value data covered elsewhere.

The measures described are directional in nature. Terms such as “commitment-based immediate entry”, “whole-life-cycle cultivation” and “prevention and in-process control” describe the intended direction of reform. The specific requirements applicable to a given enterprise will depend on the published rules and on the sector in which it operates.

International arbitration and cross-border dispute resolution: developments from the 2026 China Arbitration Summit |

Overview

In October 2026, the 2026 China Arbitration Summit and the High-Level Dialogue on China’s Maritime and Commercial Arbitration were held in Beijing. The gathering coincided with two anniversaries: the 60th anniversary of the United Nations Commission on International Trade Law (UNCITRAL) and the 70th anniversary of the China International Economic and Trade Arbitration Commission (CIETAC).

Speakers set out the direction of China’s international arbitration development. Among them were Gao Xiaoli, Vice-President and a second-grade Grand Justice of the Supreme People’s Court; Anna Joubin-Bret, Secretary-General of UNCITRAL; Shen Hongyu, Chief Judge of the No. 4 Civil Division of the Supreme People’s Court; Teresa Cheng, Secretary-General of the International Organization for Mediation; and Yang Xiangbin, Director-General of the Public Legal Services Administration of the Ministry of Justice.

Key statements from the summit

On the judiciary. Gao Xiaoli said that over the past 60 years UNCITRAL has made an outstanding contribution to unifying the rules of international trade law. In recent years, she said, the Supreme People’s Court has worked to build an “arbitration-friendly” judicial environment through a series of practical measures: issuing judicial interpretations, publishing an annual arbitration report, compiling typical cases, and running joint training for arbitrators and judges. Going forward, the courts will, as before, support arbitration and will keep improving the quality and efficiency of judicial review of arbitration.

On the arbitral institution and international rules. Anna Joubin-Bret noted that since CIETAC became an observer to UNCITRAL in 2009, it has engaged deeply in discussions on topics such as electronic arbitration awards and the use of artificial intelligence in arbitration, and has carried out innovative practice in handling cases under UNCITRAL arbitration rules. She said UNCITRAL is ready to work with all parties to improve the rules of international commercial arbitration.

On judicial review and enforcement. Shen Hongyu said that, to advance the high-quality development of China’s international arbitration, Chinese courts in judicial review fully implement the relevant provisions of the new Arbitration Law, apply the New York Convention accurately, perform convention obligations in good faith and define public policy strictly and prudently, firmly safeguarding the public interest. Courts also actively promote the organic alignment of litigation, arbitration and mediation and work to build China into a preferred venue for the resolution of international commercial disputes. Going forward, he said, the courts will continue to perform their New York Convention obligations, implement the contents of the newly revised Arbitration Law, and do the supporting judicial interpretation work.

On mediation. Teresa Cheng said that mediation — a dispute-resolution approach that embodies Eastern wisdom — is gaining wider recognition in the international community as rules such as the Singapore Convention and the UNCITRAL Model Law on International Commercial Mediation take effect. She described the International Organization for Mediation as the first intergovernmental international legal organization dedicated to resolving international disputes through mediation.

Yang Xiangbin of the Ministry of Justice also delivered a keynote speech.

Legislative background

The remarks build on a legislative background. According to public materials, in 2025 the Standing Committee of the National People’s Congress successively revised the Arbitration Law, the Maritime Code and the Foreign Trade Law, with the revisions taking effect from 2026. The summit remarks therefore sit alongside a period in which China’s arbitration and foreign-related commercial legislation is being updated.

Practical implications for foreign companies

The following points are analytical observations, not statements of official policy. They summarise considerations commonly relevant to foreign companies when structuring cross-border dispute resolution involving China.

  • Dispute-resolution clause design. In foreign-related contracts, the dispute-resolution clause typically addresses the arbitral institution, the seat of arbitration, the governing law, the language and the number of arbitrators. These choices determine where and how a dispute will be heard and are usually settled at the drafting stage.
  • Cross-border enforcement. A key advantage of arbitration in cross-border disputes is that awards can be enforced across borders under the New York Convention, which the summit remarks described Chinese courts as applying accurately and in good faith. The enforceability of an award in the place where assets are located is usually a central drafting consideration.
  • Confidentiality and expertise. Arbitration proceedings are generally confidential, and parties can select arbitrators with relevant technical or industry expertise — both are common reasons parties choose arbitration over litigation for commercial disputes.
  • Alignment of mediation and arbitration. The summit highlighted the alignment of litigation, arbitration and mediation. Foreign companies may consider whether a tiered clause — mediation first, then arbitration — suits their commercial relationship, while noting that the enforceability of a mediated settlement depends on the applicable international framework.
  • Judicial review in China. Where an award is challenged or enforcement is resisted before a Chinese court, the review is conducted within the boundaries of Chinese law, including the strict and prudent approach to public policy described at the summit. Understanding these boundaries is relevant when assessing enforcement risk.

Related considerations

The summit remarks are best read as a statement of direction: a supportive judicial posture towards arbitration, continued engagement with international rules, and an emphasis on aligning litigation, arbitration and mediation. For a foreign company, the practical value lies in the detail of contract drafting and enforcement planning rather than in any single announcement. Companies typically confirm the current state of the applicable law, convention obligations and institutional rules before finalising a dispute-resolution strategy.

China’s Trade-Fair Platforms at 70 Years: The Canton Fair and the Wider System |

Overview

In 2026 the China Import and Export Fair — the Canton Fair — marks 70 years since its founding in 1957. The 140th session runs in three phases at the China Import and Export Fair Complex in Guangzhou from 15 October to 4 November 2026. The anniversary is a natural point to step back from a single session and look at the wider system of national trade-fair platforms, and at what a foreign company can realistically do with a fair visit.

This article separates two layers. The first is official: dates, names and standing facilitation arrangements that can be traced to public sources. The second is practical: how foreign companies commonly use these platforms, which is described below as practical observations drawn from current exhibition practice and customs supervision, not as official policy.

The platform system

China’s national-level exhibition platforms are differentiated by function. Based on their public positioning, they can be grouped as follows:

  • The Canton Fair — comprehensive goods trade, export-oriented, and described as “China’s No. 1 Fair”.
  • The China International Import Expo — a national exhibition with an import theme.
  • The China International Fair for Trade in Services — a platform for trade in services.
  • The Global Digital Trade Expo — a national-level specialised fair for digital trade.
  • The China International Consumer Products Expo — a platform for consumer goods.

For a foreign company, the choice of platform tends to follow the goal rather than the calendar: comprehensive sourcing and export contacts point to the Canton Fair; import-market entry points to the import expo; services, digital trade and consumer goods each have their own dedicated platform. Because the platforms differ in focus, a company can use more than one across a year, matching each visit to a specific objective.

The 140th Canton Fair is the anchor of the autumn season. It is held in three phases from 15 October to 4 November 2026, and it is the session that coincides with the fair’s 70th anniversary. That continuity — a single fair held without interruption since 1957 — is the reason it is often treated as a reference point for China’s foreign-trade exhibition system as a whole.

Standing facilitation for inbound exhibits

The practical machinery around the Canton Fair has become routine. Guangzhou Customs has set up expedited channels for inbound exhibits at major ports in every session since the 133rd Canton Fair. This is a standing arrangement, repeated each session, rather than a measure created for a single edition.

For the 140th session, the first batch of inbound exhibits cleared customs at the Nansha port on 27 September 2026. The batch consisted of teapots, coffee machines and ceramic tableware made in Türkiye — 84 items with a total weight of about 12.3 tonnes. As of 9 October 2026, exhibits had arrived in ten batches through ports including the Nansha port and Baiyun Airport. The fair is also described in customs statements as “China’s No. 1 Fair”, a label that reflects its scale and its long history.

For exhibitors, the relevant point is that the customs side is handled through a repeatable process: exhibits enter under temporary-admission arrangements, and the facilitation channels are in place at the ports each session. A foreign exhibitor preparing a first appearance is therefore working with an established procedure rather than a bespoke one.

What a fair visit is for

For a foreign company, the value of a fair visit is usually described in three practical steps.

First, market testing. A company can bring a sample range, observe how buyers respond, and compare its product against local and international competitors, without committing to a local entity.

Second, channel building. A fair is a concentrated meeting point for distributors, agents and potential partners. Conversations that would otherwise take months of travel can happen in a few days.

Third, compliance reconnaissance. A first visit lets a company learn, at low cost, what its product would need in terms of certification, labelling and customs treatment before it commits to entry.

None of these are official entitlements; they are the practical uses that foreign companies commonly make of exhibition platforms.

Practical notes for foreign exhibitors

The following points are practical observations based on current exhibition practice and customs supervision, and are not statements of official policy:

  • Temporary-admission filing. Exhibits entering for display are handled under temporary-admission arrangements. Filing should be prepared in advance, and the exhibitor should confirm which port and which channel apply.
  • Intellectual-property clearance first. Before exhibiting, check that the products and branding do not conflict with existing rights in China, and prepare the documents that support ownership.
  • Compliant advertising wording. Booth materials and on-site claims are subject to advertising rules; wording should be reviewed before printing.
  • Confirm the contracting party. When signing on-site, the exhibitor should confirm the legal identity of the counterparty and the entity that will perform the contract.
  • Plan the follow-up. A fair generates leads; the work of converting them happens after the visit, through the company’s own follow-up and, where relevant, through domestic investment-promotion channels.

Related considerations

The wider policy context treats these platforms as part of a cross-border exchange system. The state’s language on “actively building a global network for innovation co-operation” and on clustering advanced production factors in pilot free trade zones places exhibition and co-operation platforms within a broader framework of international exchange. For a foreign company, that framing is background rather than a specific entitlement: the practical steps remain registration, compliance preparation and follow-up.

A further practical consideration is timing. The Canton Fair’s three phases fall in October and early November, so a company planning an autumn visit should decide well in advance whether to attend one phase or move across phases, and should align its customs filing and travel arrangements with the phase that matches its product category. Because the facilitation channels at the ports are set up for each session, early preparation is the part of the process most within the exhibitor’s own control.

Taken together, the 70-year history of the Canton Fair and the differentiated set of national platforms give a foreign company a menu of entry points. The choice depends on the objective, and the preparation is largely the same across platforms.

China’s Opinions on Developing New Quality Productive Forces: The Foreign-Investment Provisions | 《

Overview

On 9 October 2026, the Central Committee of the Communist Party of China and the State Council issued the Opinions on Developing New Quality Productive Forces. The document organises its proposals around five areas of innovation and puts forward 19 priority measures. It is a comprehensive policy statement whose main subject is the domestic economy, but several of its provisions speak directly to foreign investors, to cross-border data movement, to pilot free trade zones and to the green transition.

This article reads the Opinions only for the provisions that touch on foreign investment and related areas, and reproduces the official wording where it matters. It does not extend the text beyond what the document says. Where a point is a practical observation rather than the wording of the Opinions, it is marked as such.

The foreign-investment provisions

The most direct foreign-investment language sits in the fourth area of the Opinions, on “solidly advancing institutional and mechanism innovation”. The document states that China will “allocate advanced production factors globally” and that it will “encourage foreign venture capital institutions, international standards organisations and others to develop in China”.

Two points follow from the official wording. First, foreign venture capital institutions and international standards organisations are named among the entities that are encouraged to develop in China. Second, the framing is about factors of production — capital, technology, talent and standards — being allocated on a global basis. The Opinions do not, in the provisions reproduced here, attach numbered sub-measures to specific foreign-investment entry thresholds, and it would be inaccurate to read the text as relaxing any particular admission rule. The wording is one of encouragement and direction.

The fourth area also states that China will “improve the market regulation system and increase the supply of innovative financial products”. These clauses are relevant to the wider operating environment in which foreign-invested enterprises run their business in China.

Data flows, pilot free trade zones and innovation networks

Three further provisions are of practical interest to foreign companies.

  • Cross-border data flow. The Opinions call for “establishing an efficient, convenient and secure mechanism for cross-border data flow”. The three adjectives — efficient, convenient and secure — are the terms the document uses to frame the mechanism. They indicate a direction of policy rather than a set of operational rules; the specific compliance requirements for data export continue to be governed by the applicable data and cybersecurity rules.
  • Pilot free trade zones as carriers. The Opinions state that pilot free trade zones are encouraged to “gather advanced production factors at home and abroad in line with their location, resource endowment and industrial strengths”. This positions the free trade zone network as a channel through which foreign capital, technology and talent can be concentrated.
  • Global innovation cooperation networks. The Opinions call for “jointly building science parks, Belt and Road joint laboratories and international advanced technology application centres and other platforms, and actively building a global innovation cooperation network”. For foreign companies in research-intensive sectors, these platforms describe the institutional forms through which cooperation is expected to take place.

The green dimension

The third area of the Opinions, on “advancing innovation in development models”, carries the environmental and energy content. It states that China will “build a green, low-carbon and circular economic system, improve the policy toolbox for green development and actively advance the energy revolution”.

It also sets out that, “focusing on the goals of peak carbon emissions and carbon neutrality, China will develop advanced nuclear fission energy in an orderly manner, build a power system with a high proportion of renewable energy, and improve policies and measures for the consumption and regulation of new energy”. The wording is deliberately qualified — “in an orderly manner” — and it describes a domestic energy system direction. It does not, in the text reproduced here, address foreign participation in specific energy sectors; any such participation would be governed by the applicable admission rules for those sectors.

What the Opinions do not say

It is as useful to note the limits of the text as its content. The provisions reproduced above do not set out new admission thresholds, do not name specific industries that are newly opened to foreign investment, and do not attach deadlines or transitional arrangements to the encouragement they express. They also do not replace the existing framework of admission administration, which continues to be governed by the applicable laws, regulations and negative lists.

The provisions on data flow describe a mechanism to be established rather than a completed regime. The provisions on pilot free trade zones describe a role for the zones rather than a list of measures to be taken in them. The provisions on energy describe a domestic system direction. A reader who needs to know what is permitted today should therefore continue to rely on the operative rules, and should treat the Opinions as an indication of where policy is heading.

Practical implications and constraints

For a foreign investor, the provisions above are best read as a statement of direction rather than a set of immediate procedural changes. They indicate that foreign venture capital, international standards bodies and foreign participants in innovation platforms are within the scope of what the policy encourages, and that pilot free trade zones and cross-border data mechanisms are named as the channels through which those aims are to be pursued.

The Opinions also state a set of constraints that belong in any complete reading. The document stresses that China will “adhere to establishing the new before abolishing the old and to seeking progress while maintaining stability, avoid shifting from the real economy to the virtual, avoid seeking excessive scale and completeness, and avoid creating bubbles, and avoid industrial hollowing-out or industrial breaks”. It further states that “it is strictly prohibited to misuse policies in violation of regulations under the name of developing new quality productive forces”.

These sentences are part of the official text and temper the opening measures. They signal that the policy is to be implemented with discipline, that the real economy is to remain the focus, and that the label of new quality productive forces is not to be used to justify irregular use of policy. A reader who takes only the encouraging clauses and leaves out these constraints would have an incomplete picture.
