China’s Opinions on Developing New Quality Productive Forces: The Foreign-Investment Provisions
- On 9 October 2026 the Central Committee of the Communist Party of China and the State Council issued the Opinions on Developing New Quality Productive Forces, which set out 19 priority measures across five areas of innovation.

- On foreign investment, the Opinions state that China will “allocate advanced production factors globally” and “encourage foreign venture capital institutions, international standards organisations and others to develop in China”.

Overview
On 9 October 2026, the Central Committee of the Communist Party of China and the State Council issued the Opinions on Developing New Quality Productive Forces. The document organises its proposals around five areas of innovation and puts forward 19 priority measures. It is a comprehensive policy statement whose main subject is the domestic economy, but several of its provisions speak directly to foreign investors, to cross-border data movement, to pilot free trade zones and to the green transition.
This article reads the Opinions only for the provisions that touch on foreign investment and related areas, and reproduces the official wording where it matters. It does not extend the text beyond what the document says. Where a point is a practical observation rather than the wording of the Opinions, it is marked as such.
The foreign-investment provisions
The most direct foreign-investment language sits in the fourth area of the Opinions, on “solidly advancing institutional and mechanism innovation”. The document states that China will “allocate advanced production factors globally” and that it will “encourage foreign venture capital institutions, international standards organisations and others to develop in China”.
Two points follow from the official wording. First, foreign venture capital institutions and international standards organisations are named among the entities that are encouraged to develop in China. Second, the framing is about factors of production — capital, technology, talent and standards — being allocated on a global basis. The Opinions do not, in the provisions reproduced here, attach numbered sub-measures to specific foreign-investment entry thresholds, and it would be inaccurate to read the text as relaxing any particular admission rule. The wording is one of encouragement and direction.
The fourth area also states that China will “improve the market regulation system and increase the supply of innovative financial products”. These clauses are relevant to the wider operating environment in which foreign-invested enterprises run their business in China.
Data flows, pilot free trade zones and innovation networks
Three further provisions are of practical interest to foreign companies.
- Cross-border data flow. The Opinions call for “establishing an efficient, convenient and secure mechanism for cross-border data flow”. The three adjectives — efficient, convenient and secure — are the terms the document uses to frame the mechanism. They indicate a direction of policy rather than a set of operational rules; the specific compliance requirements for data export continue to be governed by the applicable data and cybersecurity rules.
- Pilot free trade zones as carriers. The Opinions state that pilot free trade zones are encouraged to “gather advanced production factors at home and abroad in line with their location, resource endowment and industrial strengths”. This positions the free trade zone network as a channel through which foreign capital, technology and talent can be concentrated.
- Global innovation cooperation networks. The Opinions call for “jointly building science parks, Belt and Road joint laboratories and international advanced technology application centres and other platforms, and actively building a global innovation cooperation network”. For foreign companies in research-intensive sectors, these platforms describe the institutional forms through which cooperation is expected to take place.
The green dimension
The third area of the Opinions, on “advancing innovation in development models”, carries the environmental and energy content. It states that China will “build a green, low-carbon and circular economic system, improve the policy toolbox for green development and actively advance the energy revolution”.
It also sets out that, “focusing on the goals of peak carbon emissions and carbon neutrality, China will develop advanced nuclear fission energy in an orderly manner, build a power system with a high proportion of renewable energy, and improve policies and measures for the consumption and regulation of new energy”. The wording is deliberately qualified — “in an orderly manner” — and it describes a domestic energy system direction. It does not, in the text reproduced here, address foreign participation in specific energy sectors; any such participation would be governed by the applicable admission rules for those sectors.
What the Opinions do not say
It is as useful to note the limits of the text as its content. The provisions reproduced above do not set out new admission thresholds, do not name specific industries that are newly opened to foreign investment, and do not attach deadlines or transitional arrangements to the encouragement they express. They also do not replace the existing framework of admission administration, which continues to be governed by the applicable laws, regulations and negative lists.
The provisions on data flow describe a mechanism to be established rather than a completed regime. The provisions on pilot free trade zones describe a role for the zones rather than a list of measures to be taken in them. The provisions on energy describe a domestic system direction. A reader who needs to know what is permitted today should therefore continue to rely on the operative rules, and should treat the Opinions as an indication of where policy is heading.
Practical implications and constraints
For a foreign investor, the provisions above are best read as a statement of direction rather than a set of immediate procedural changes. They indicate that foreign venture capital, international standards bodies and foreign participants in innovation platforms are within the scope of what the policy encourages, and that pilot free trade zones and cross-border data mechanisms are named as the channels through which those aims are to be pursued.
The Opinions also state a set of constraints that belong in any complete reading. The document stresses that China will “adhere to establishing the new before abolishing the old and to seeking progress while maintaining stability, avoid shifting from the real economy to the virtual, avoid seeking excessive scale and completeness, and avoid creating bubbles, and avoid industrial hollowing-out or industrial breaks”. It further states that “it is strictly prohibited to misuse policies in violation of regulations under the name of developing new quality productive forces”.
These sentences are part of the official text and temper the opening measures. They signal that the policy is to be implemented with discipline, that the real economy is to remain the focus, and that the label of new quality productive forces is not to be used to justify irregular use of policy. A reader who takes only the encouraging clauses and leaves out these constraints would have an incomplete picture.
