Overview

The State Taxation Administration has published the National Tax Administrative Penalty Discretion Benchmark (2026 Edition), which takes effect on 1 November 2026. Its significance lies in its geographic reach: for the first time, the standards guiding how tax authorities select and calibrate penalties apply uniformly nationwide.

The benchmark covers 9 categories and 66 tax administrative penalty items, and it was issued alongside a list of “minor violations not punished” covering 8 items. Together they change the framework within which a compliance failure is assessed, and they are relevant to any business that operates in more than one province.

Key developments in 2026

One benchmark for the whole country

Before this edition, discretion standards were set lower in the system: provinces adopted their own benchmarks, and later groups of provinces issued joint regional ones. A company operating in several provinces could face different treatment for the same violation, not because the law differed but because the standard did.

The 2026 edition consolidates this into a single national instrument with a common effective date. The change is one of standardisation: how existing items are graded and applied becomes uniform.

Nine categories, sixty-six items

The benchmark addresses 9 categories and 66 tax administrative penalty items. For each, it optimises three elements: the discretion tiers, the conditions under which each tier applies, and the specific standards attached to them.

The stated objectives are more reasonable division of items, more scientific discretion factors and a more precise scale. In practice these determine whether a set of facts is treated as minor, ordinary or serious, and so what penalty range a taxpayer can expect.

The “minor violations not punished” list

The accompanying list of penalty matters where a minor violation is not punished covers 8 items, distilled from the benchmark. It sits alongside the benchmark rather than replacing it, identifying circumstances in which a violation, though established, does not attract a penalty.

The list is best read as a defined exception, not a general leniency policy. Where its conditions are met, it provides a basis for arguing that no penalty should be imposed; where they are not, the ordinary benchmark applies.

How the benchmark arrived here

The reform moved from uniformity within a province, to uniformity within a region, to uniformity across the country.

In early 2025, provincial bureaus in the Northeast, Southwest, Northwest, Central-South, North China and East China regions successively issued joint regional benchmarks. Those were the intermediate step; the 2026 edition completes the progression at national level.

What local authorities are required to do

The announcement sets expectations for local tax authorities: penalties must be imposed strictly in accordance with the law, decisions must be made within the range of the discretion benchmark, and the lawful rights and interests of taxpayers and fee payers must be protected.

The instruction is directed at the authorities, not at taxpayers. The benchmark governs the exercise of public power; it does not add to, or relieve a company of, its obligations to register, file, report and pay on time.

Practical implications for foreign businesses

  • Read the benchmark as a predictability gain, not a discount. For a multi-province operation, the same facts should now be assessed against the same standard, making compliance design and provisioning more tractable.
  • Use the “minor violations not punished” list as a documented defence, and check its conditions first. The list covers 8 defined items. It is an exception with conditions, not a general exemption, so the file should show how each condition is met.
  • Keep the benchmark in its proper place. It constrains the authority’s choice of penalty; it does not change filing deadlines, documentation requirements or payment obligations. Compliance work upstream of an audit remains the primary risk control.
  • Revisit penalty provisioning across entities. Where a group has subsidiaries in several provinces, one standard gives a common basis for estimating exposure and explaining it to a parent or auditor.
  • Brief local finance teams on the 1 November date. The benchmark applies from that date, so reviews, voluntary disclosures or remediation that straddle the change should note which standard applies to which period.
  • Treat the two documents as a pair. The benchmark sets the tiers and the list carves out the exceptions; reading one without the other gives an incomplete picture of how a specific issue would be handled.
