Overview

The State Council’s Regulation on the Administration of Exit and Entry (《国务院关于出境入境管理的规定》), State Council Decree No. 841, took effect on 15 September 2026. It was adopted at the 90th State Council executive meeting on 29 June 2026 and promulgated on 31 July 2026, and it contains 19 articles. Its stated purpose is to regulate exit and entry administration, protect the lawful rights and interests of persons entering and leaving China, and safeguard national sovereignty, security and development interests.

Because the Regulation touches on outbound travel, it has drawn wide discussion. The official reading is narrow and specific, and it is worth setting out plainly: the rules address illegal cross-border conduct and the intermediaries that facilitate it. They do not change the position of ordinary travellers who have lawful reasons to leave China. Tourism, family visits, study and business travel are unaffected, and the nationwide arrangement under which exit-entry applications may be handled at any competent office (全国通办) remains in place.

The four strands of the Regulation

Outbound safety-risk prevention. Foreign affairs, culture and tourism and other departments are to issue overseas security reminders and destination risk alerts in a timely manner. For citizens travelling to the highest-risk destinations, or to places where serious crimes endangering personal safety are frequent, the immigration administration may, where necessary, dissuade them from going. Dissuasion is advisory in nature; it is not a prohibition.

Truthfulness of purpose. Applications for exit, entry, stay and residence must state a purpose that is genuine and lawful. The authorities may ask about the circumstances and require supporting documents; where false materials are provided or false statements made, they have the power to decide not to issue the document applied for.

Exit-restriction measures. A person who obtains documents by fraud, or who has been subject to administrative detention for illegal exit or entry, may be barred from leaving China for between six months and three years after the penalty ends. A person who engages in illegal or criminal activities abroad that harm national security and interests may, after returning, be restricted from leaving for six months to three years. Where the violation of export-control, technology import-export and similar rules could endanger national industrial or technological security, the relevant departments may decide that the person is not permitted to leave.

Intermediary services under filing. Agencies and individuals that provide exit-entry intermediary services are subject to a filing regime rather than prior administrative licensing. A newly established agency must file with the local immigration authority within 15 days of establishment; existing agencies must complete filing within 90 days of the Regulation taking effect. Overseas enterprises and institutions may not provide such services directly within China, and agencies may not handle immigration matters for civil servants, military personnel and other persons of special status.

What the filing regime requires

To be filed, an agency must be lawfully established; its responsible person must have no record of criminal punishment for an intentional crime; and it must have the appropriate professionals, funding, premises and systems for personnel management, records retention, data security and compliance management.

The Regulation also lists conduct that agencies must not engage in: false advertising; assisting in the provision of false materials; handling certificates or procedures in violation of the rules; disclosing personal information; operating beyond the scope of their filing; and assisting cross-border illegal or criminal activity. Remedies and penalties include an order to rectify within a time limit, confiscation of illegal gains, fines and revocation of the business licence.

What the Regulation does not do

Public discussion has sometimes treated the Regulation as a general tightening of outbound travel. That reading is not supported by the official material. On 10 September 2026, the China Joint Internet Rumor-Busting Platform (中国互联网联合辟谣平台) issued a clarification stating that the claim that “outbound travel will be comprehensively tightened and ordinary people will find it harder to leave” is a misreading, and it cited the joint question-and-answer responses of the responsible officials of the Ministry of Justice, the Ministry of Public Security and the National Immigration Administration.

On the official account, the rules are aimed at illegal cross-border conduct and the intermediaries that organise it. Ordinary travellers with lawful purposes — including tourism, visiting relatives, study and business — continue to travel as before. The immigration service hotline 12367 remains available for enquiries.

Implications for foreign employers and expatriate executives

For foreign-invested companies and their expatriate staff, the Regulation is best understood as a compliance matter rather than a travel restriction:

  • Check your intermediary. If the group uses an agency to handle work permits, residence permits or visa extensions for expatriate employees or their families, confirm that the agency is within the filing regime and does not operate beyond its filed scope. Because overseas entities may not provide such services directly inside China, a “group headquarters handles it from abroad” arrangement should be reviewed.
  • Keep the stated purpose accurate. Because the Regulation emphasises truthfulness of purpose, the reason recorded for an entry, stay or residence should match the documents actually held. For business travellers and assignees, this is largely a documentation discipline.
  • Note the restriction triggers. The exit-restriction provisions are tied to defined conduct — fraudulently obtained documents, administrative detention for illegal exit or entry, illegal or criminal activity abroad that harms national security and interests, and conduct under export-control or technology import-export rules that may endanger industrial or technological security. Companies with cross-border technical and export-control exposure should make sure that travel for staff involved in sensitive transfers is planned with the group’s compliance function.
  • Keep the service channel. The 12367 hotline remains the standard channel for immigration enquiries, including for companies checking procedure.

Practical steps

  • Verify the filing status and filed scope of any agency your group uses for visa or residence-permit work.
  • Align each expatriate’s recorded purpose of stay with the permit actually held, and retain supporting documents.
  • Where staff are involved in export-control-sensitive technology, coordinate travel planning with the compliance function.
  • Use the 12367 hotline for procedural questions rather than informal advice.
  • Treat the Regulation as a fact-based update: lawful outbound travel for tourism, family visits, study and business is unchanged, and the nationwide handling policy remains in effect.

《国务院关于出境入境管理的规定》(国务院令第841号)自2026年9月15日起施行。该规定于2026年6月29日经国务院第90次常务会议通过,7月31日公布,全文共19条。其立法目的是规范出境入境管理,保障出境入境人员的合法权益,维护国家主权、安全、发展利益。

由于该规定涉及出境事项,社会上讨论较多。官方口径具体而明确,值得如实说明:规定所规制的是非法跨境行为以及为其提供便利的中介服务,并未改变有合法出境事由的普通民众的出行安排。旅游、探亲、留学、商务出行不受影响,出境入境证件全国通办的政策安排也保持不变。

规定的四个方面

健全出境安全风险防范制度。 外交、文化和旅游等部门应及时发布国外安全提醒和旅游目的地风险提示。对前往风险等级最高的国家或地区、或严重危及人身安全案件高发地区的公民,移民管理机构必要时可以进行劝阻。劝阻属于提示性质,并非禁止。

明确事由真实性要求。 申请出境入境、停留居留,事由应当真实、合法。有关机关可以询问情况、要求出示相关文件资料;对提供虚假材料、作出虚假陈述的,有权决定不予签发。

完善出境入境限制措施。 以骗取方式取得证件,或曾因非法出境入境受过行政拘留处罚的,处罚执行完毕后可被限制出境6个月至3年;在境外从事危害国家安全和利益的违法犯罪活动的,回国后可被限制出境6个月至3年;违反出口管制、技术进出口管理等规定,可能危害国家产业安全、技术安全的,有关部门可以决定不准其出境。

规范出境入境中介服务。 对从事出境入境中介服务的机构和人员实行备案管理,而非前置行政许可。新设立机构应在设立15日内向所在地移民管理机构备案;现有机构应在该规定施行后90日内完成备案。境外企业、机构不得在中国境内直接提供出境入境中介服务;中介机构不得为公务员、军人等特殊身份人员办理移民业务。

备案管理的具体要求

中介机构备案需符合条件:依法设立;负责人无故意犯罪刑事处罚记录;具备相应的专业人员、资金、场所,以及人员管理、资料保存、数据安全、合规管理等制度。

规定同时列明中介机构不得从事的行为:虚假宣传、协助提供虚假材料、违规办理证件手续、泄露个人信息、超出备案范围经营、协助跨境违法犯罪。相应的处理与处罚措施包括责令限期整改、没收违法所得、罚款、吊销营业执照等。

规定并未做什么

公共讨论中,有时把该规定理解为对出境的全面收紧,这一理解与官方材料并不相符。2026年9月10日,中国互联网联合辟谣平台发布辟谣信息,指出出境将全面收紧、普通人出境变难的说法属于误读,并引用司法部、公安部、国家移民管理局负责人答记者问的口径。

按照官方口径,相关规则指向的是非法跨境行为及其组织者。有合法事由的普通旅客——包括旅游、探亲、留学、商务——出行安排不变。移民管理服务热线12367继续提供咨询。

对在华外资企业与外籍高管的影响

对外商投资企业及其外籍员工而言,该规定更宜作为一项合规事项来理解,而非出行限制:

  • 核查所委托的中介。 若集团委托中介为外籍员工及其家属办理工作许可、居留证件或签证延期,应确认该机构已纳入备案管理、未超出备案范围经营。由于境外企业、机构不得在中国境内直接提供此类服务,由集团总部在境外办理的安排应予复核。
  • 确保事由真实可核。 由于规定强调事由真实性,入境、停留居留所记载的事由应与实际持有的证件材料相符。对商务出行人员与外派人员而言,这主要是一项材料管理要求。
  • 注意限制措施的触发情形。 出境限制条款对应的是特定行为——骗取证件、因非法出境入境受过行政拘留处罚、在境外从事危害国家安全和利益的违法犯罪活动,以及违反出口管制、技术进出口管理规定且可能危害产业安全、技术安全的行为。存在跨境技术与出口管制风险的企业,涉及敏感转移的员工出行安排,应与集团合规部门一并规划。
