Overview

On 30 October 2026 the General Administration of Customs issued Announcement No. 155 of 2026, giving effect to the Protocol on Upgrading the Free Trade Agreement between the Governments of China and Peru. The Protocol was approved by the State Council and applies from 1 November 2026. The revised Measures on the Administration of Origin of Import and Export Goods under the Agreement take effect on the same date, replacing the version promulgated by Customs Order No. 186 of 2010.

The revised text keeps the architecture of the old one — origin criteria, accumulation, minimal operations, de minimis, sets of goods, fungible materials, direct transport — and rewrites the parts that decide outcomes at the port. The agreement is not new; the test for what counts as Peruvian is.

What changed

Old goods must be collected at home. Under the wholly obtained criterion, goods collected in China or Peru must actually be collected there. Collection excludes goods imported from any other country or region and then consolidated in China or Peru. Scrap, second-hand equipment and end-of-life units shipped into Peru from elsewhere and re-exported therefore fail.

The minimal operations list has grown. The old text listed four operations that do not confer origin. The revised text lists thirteen, adding washing, filtering, simple grinding and simple mixing, and defines “simple” and “simple mixing”. A good that undergoes only such operations is not originating, whatever its final tariff line.

The certificate has been redesigned. Several fields and their completion instructions have changed. The certificate remains self-printable.

The nomenclature moved, the standard did not. Product-specific rules have moved from the 2007 edition to Harmonized System 2022 nomenclature. The substantive criteria for individual products are unchanged; what changes is the code that carries them.

Three conditions and the procedural chain

Preference still requires one of three conditions: wholly obtained in Peru, produced exclusively from originating materials there, or produced using non-originating materials that meet the product-specific rule on tariff shift, value content, manufacturing process or otherwise.

Around those conditions the Measures set accumulation, de minimis, sets of goods, fungible materials and direct transport, and then the procedural chain: application for and issuance of the certificate, the requirements for claiming preference at import, origin verification, and retention of documents.

Who it affects

Peruvian exporters of agricultural, mineral, fishery and manufactured goods; Chinese importers claiming preference; and the trading, toll-processing and refurbishment businesses in between.

The old-goods amendment targets one structure: material collected in a third country, consolidated in Peru, and presented as Peruvian. Recycling, refurbishment and used-equipment chains that treat Peru as a gathering point lose the argument that the goods were collected there. The test follows the first place of collection, not the last place of consolidation. A unit dismantled abroad, shipped to Peru in parts and exported to China as a consignment is exposed on exactly this point.

The minimal operations amendment catches labelling, repacking, simple sorting, simple mixing and simple grinding presented as local processing. Where a good once slipped through on a loose reading of “simple”, the list narrows the room.

Practical steps

  • Obtain a written origin declaration from the Peruvian supplier for each product, naming the criterion relied on and the 2022 tariff line.
  • For goods qualifying on value, keep the regional value content workings: material costs, originating and non-originating inputs, and the method applied.
  • For goods routed through a third country, keep through bills of lading, transhipment records and evidence of non-manipulation. Direct transport remains a condition of preference.
  • Re-check every certificate field against the new format before shipment; the old layout invites refusal.
  • Keep the origin file for the period the Measures require, and confirm that period against the current text rather than an internal template.
  • Brief brokers on the 2022 codes: the declaration and the certificate must use the same nomenclature, or a clerical gap reads as an origin problem.

Outlook

Scrutiny at the port will concentrate on two questions: where the goods were first collected, and what was done to them. A certificate that is formally complete but rests on a consolidation history will not survive verification.
