China’s 15th Five-Year Plan and the Foreign Work-Visa System: A Guide for Employers | “十五五”规划与外国人才工作许可制度:用人单位指引

The *15th Five-Year Plan for the Development of Human Resources and Social Security* (published July 2026) gives unusual prominence to attracting and servicing foreign talent. For foreign-invested companies that hire expatriates — R&D centres, regional headquarters, factories and professional-services firms — the plan signals a more coordinated, digital and talent-friendly immigration posture over 2026–2030.

What the plan says

In the section on introducing foreign expertise and servicing foreign experts, the plan calls for:

  • Improving the foreign-work management system, strengthening linkages with the high-skilled talent migration system, and optimising the classification standard for foreigners working in China.
  • A multi-department coordination mechanism for foreign talent.
  • Comprehensive reform pilots for foreign-expert service guarantees, a foreign-talent labour-and-personnel management system, smooth career-development channels, and a foreign-talent comprehensive service platform.
  • Equal basic public services for foreigners living and working in China.
  • Foreign-expert recognition and awards (including the Chinese Government Friendship Award) and programs such as the National Foreign Experts Program and the International Young Talent Exchange Program.
  • Mutual recognition of overseas professional qualifications in engineering and technology, and a digital-technology engineer certification system.

A companion implementation read-out stresses that, by 2030, online services for work permits, returnees and professional-title review will be deepened, supporting the “invest in people” agenda.

The A/B/C classification in practice

China’s work-permit classification remains the operational core:

  • Category A — High-end talent: scientists, leading tech talent, international entrepreneurs and specialised professionals meeting “high-precision-scarce” and market-demand criteria, or scoring 85+ on the points-based table. Exempt from age, education and work-experience limits.
  • Category B — Professional talent: aligns with the Catalogue for Guiding Foreigners Working in China; requires a bachelor’s degree or above and at least two years’ relevant experience, with the age cap set at the statutory retirement age. Waivers apply for urgently-needed talent, innovation entrepreneurs and points-based (60+) candidates.
  • Category C — Ordinary: managed under quotas and other state provisions.

Pilot concessions are widening

Local pilots are relaxing the traditional constraints. The Guangzhou–Foshan measures (issued February 2026) illustrate the trend:

  • Category A is not subject to age limits; Category B’s age cap follows the statutory retirement age.
  • Outstanding foreign graduates with a master’s or above from Chinese universities (or recognised foreign universities), with a confirmed employer, may apply without the two-year experience requirement; urgently-needed young scientific talent on state/provincial/city projects may also be exempted.
  • Mutual recognition of Category A permits across the two cities (“one-place approval, two-city recognition”) removes duplicate document submission.
  • Intra-group transfers within multinational regional headquarters are streamlined — no criminal-record or medical-report re-submission within 30 days of deregistration.

Why it matters for foreign employers

The plan’s emphasis on coordination, digitalisation and service platforms should reduce the friction of repeated filings and inconsistent local interpretation. For employers, the practical levers are: (i) classify roles correctly to capture A/B waivers; (ii) use pilot concessions for hard-to-fill R&D and specialist posts; and (iii) prepare for a more integrated, single-window foreign-talent service experience.

Practical steps

  1. Build the A/B/C map. Score each expatriate role against the points table; push genuinely high-end roles to A to unlock waivers.
  2. Use graduate and youth waivers. Where a role fits urgent-need or young-talent criteria, drop the two-year experience bar via pilot cities.
  3. Leverage intra-group transfer. For regional-headquarters moves, use the 30-day streamlined pathway.
  4. Prepare classification evidence. Keep degree certificates, reference letters and points calculations audit-ready.
  5. Watch the platform rollout. Consolidate filings as the foreign-talent comprehensive service platform matures.

A/B/C分类的实践

  1. 建立A/B/C映射。

Practitioner Quick Reference

  • 15th Five-Year HR plan: foreign-talent management linked to high-skilled migration and a coordination mechanism.
  • A / B / C grid: A exempt from age, education, experience; B needs degree + 2 years (waivable); C quota-managed.
  • Pilot waivers live: Guangzhou-Foshan drops the 2-year bar for qualifying graduates and youth talent.
  • Intra-group transfer: 30-day streamlined path for regional-HQ moves.

Common Pitfalls

  • Misclassifying to grab waivers: forcing a B role into A invites rejection and retroactive exposure.
  • Assuming nationwide uniformity: pilot concessions (age, experience) are city-specific, not automatic nationally.
  • Neglecting the service platform: filings will consolidate; fragmented entity-level processes will need re-engineering.

China’s new K visa for young foreign tech talent (Order 814) and family visas

  • On 7 August 2025, the State Council issued Order No. 814 adding a new “K” visa to China’s ordinary-visa catalogue, expressly for incoming foreign young science-and-technology talent; it takes effect on 1 October 2025.
  • The K visa targets STEM graduates (bachelor’s or above) from recognised domestic or overseas universities/research institutions, or those working in education or research in STEM fields — with no requirement for a Chinese employer or invitation letter.
  • Unlike most work-linked visas, the K visa is granted on age and educational/experience criteria alone, and promises more generous entry-count, validity and stay periods plus easier application procedures.
  • This is China’s 13th ordinary-visa category, sitting alongside the existing R (talent) and Z (work) visas but intentionally lowering the threshold for young global tech entrants.
  • Foreign employees on Z/R visas can bring spouses and children under 18 on S1/S2 visas; S1 is for long-term stay (over 180 days) and S2 for short-term visits, each requiring the principal’s passport, residence permit and kinship proof.
  • For foreign-invested firms, the K visa widens the talent funnel — useful for hiring global graduates, interns and researchers without first establishing a local legal entity or sponsored work permit.

China’s new K visa for young foreign tech talent (Order 814) and family visas | 中国新增 K 字签证(814号令)与家属签证

Overview

China’s visa toolkit just gained a new category. On 7 August 2025, the State Council promulgated Order No. 814 — the Decision to Amend the Regulations on the Administration of Entry and Exit of Foreigners, which inserts a “K” visa into the ordinary-visa catalogue for foreign young science-and-technology talent, effective 1 October 2025. Together with the familiar R (talent) and Z (work) visas, the K visa signals a deliberate push to attract early-career global tech people — without the usual prerequisite of a Chinese employer.

This article covers who qualifies for the K visa, how it differs from R/Z, the family (S1/S2) visa rules that matter to foreign employees already in China, and practical implications for foreign-invested enterprises. It is general information, not legal advice.

The legal change

Order 814 amends the 2013 Regulations on the Administration of Entry and Exit of Foreigners in two places:

  • Article 6 gains a sixth sub-item: “(6) K visa, issued to foreign young science-and-technology talent entering the country.”
  • Article 7 gains a corresponding sub-item setting out that K-visa applicants must meet the conditions and requirements for foreign young sci-tech talent prescribed by the competent Chinese authorities and submit supporting documents.

The Order was passed at the 63rd executive meeting of the State Council on 16 July 2025, signed by Premier Li Qiang on 7 August 2025, and takes effect on 1 October 2025. It is the implementation of a talent-strategy tilt repeatedly signalled by the 20th Party Congress and the Third Plenum — “science and technology are the primary productive force, talent the primary resource, innovation the primary driver.”

Who qualifies for the K visa

According to the joint explanation by the Ministry of Justice, Ministry of Foreign Affairs, the Ministry of Public Security and the National Immigration Administration, the K visa is issued to foreign young sci-tech talent who:

  • graduated with a bachelor’s degree or above in science, technology, engineering or mathematics (STEM) from a recognised domestic or overseas university or research institution; or
  • work in education or research in those STEM fields at such institutions.

The precise conditions and required documents will be published on the websites of Chinese embassies and consulates abroad. Applicants should watch those notices for the final eligibility detail.

How the K visa differs

Relative to the existing 12 ordinary-visa categories, the K visa is distinctive on three axes:

  1. No domestic sponsor required. Most work-linked routes (Z work visa, R talent visa) presuppose a Chinese employer or inviting unit. The K visa is granted on age and educational/experience criteria alone — it does not require a Chinese hiring or invitation entity.
  2. More generous terms. The authorities state the K visa will offer holders more favourable entry-count, validity and stay periods than typical categories.
  3. Broader post-entry activity. K-visa holders may engage in exchanges in education, science and technology, culture, as well as entrepreneurship and business activities.

In short, the K visa is China’s 13th ordinary-visa class, purpose-built to lower the entry barrier for young global tech talent and to let them explore, build and collaborate before locking into an employment relationship.

Family visas for foreign employees already in China: S1 and S2

Foreign staff who enter on a Z (work) or R (talent) visa and obtain a work-type residence permit can bring family. The relevant visas are S1 and S2, both for the spouse, children under 18, and parents of a foreigner staying or residing in China for work, study or other non-diplomatic reasons:

  • S1 visa — for family members of a foreigner who is to reside long-term in China; issued when the intended stay exceeds 180 days. Holders must apply for a residence permit for family reunion within 30 days of entry.
  • S2 visa — for short-term (generally ≤180 days) family visits, business or other personal matters.

Common documentation: the principal’s valid passport and residence permit, proof of kinship (marriage/birth certificates, often notarised and legalised), and an invitation letter. Rules on who qualifies as a “family member” and on document legalisation follow the local exit-entry authority’s stated requirements.

What this means for foreign-invested enterprises

For FIEs and their HR teams, the K visa changes the talent calculus:

  • Wider top-of-funnel. Global STEM graduates and young researchers can come to China to explore, network and start ventures without a prior job offer or a locally established entity — useful for campus recruiting, hackathons, research collaboration and incubator pipelines.
  • Bridge to employment. A K entrant who later takes a role can transition to a Z (work) or R (talent) visa and residence permit through the normal work-permit pathway; the K visa is an entry door, not a work authorisation substitute.
  • Family planning. When sponsoring Z/R staff, budget for S1/S2 processing of spouses and children, and start document legalisation early — it is the step that most often delays a family’s arrival.
  • Compliance. K-visa holders may not simply take up employment; engaging in paid work still requires the appropriate work visa and permit. Treat K as a mobility and exploration tool, not a hiring shortcut.

Practical steps

  1. For prospective young talent: monitor Chinese embassy/consulate sites for the K-visa eligibility list and document checklist once published; prepare degree and (if applicable) employment/study proof in STEM.
  2. For employers: incorporate K into campus and research-outreach plans; keep Z/R as the work-authorisation path for actual hires; brief global mobility teams on the distinction.
  3. For relocating staff: initiate S1/S2 kinship-document legalisation early; align on long-stay (S1 + residence permit) vs short-visit (S2) needs.
  4. Stay current: the supporting rules and any quota or field-list details will be refined by the competent authorities — verify against the latest official notices before advising candidates.

Expatriate IIT Status in China: Handling Residence-Day Changes Under the Shanghai Tax Memo |

Why this matters now

In 2026, Shanghai’s tax authority published a consultative memorandum (《关于外籍个人境内停留时间变化有关个税问题的备忘录》) on a recurring problem for foreign-invested employers: at the first payroll withholding of a tax year, the employer must estimate whether each expatriate will be a resident or non-resident individual for the year, because actual cumulative stay days cannot be known in advance. When the year ends differently from the estimate — an employee leaves early and falls short of 183 days, or stays longer than planned and crosses it — the memo sets out the reporting timeline and the re-computation rules. The memo is grounded in the Individual Income Tax Law, the State Council Implementing Regulation (Decree No. 707), MOF/SAT Announcement No. 35 of 2019 and SAT Announcement No. 61 of 2018. For payroll, HR and tax teams managing expatriates, it provides the operational template for status determination, mid-year correction and year-end reconciliation.

The status framework in brief

Under the IIT Law, a resident individual is one who has a residence in China, or who, without a residence, cumulatively stays 183 days or more in China in a tax year. Resident individuals are taxed on China- and foreign-source income under comprehensive-income rules, may claim special additional deductions or the expatriate tax-free allowance, and must file an annual reconciliation. A non-resident individual — no residence in China and fewer than 183 cumulative days — is taxed only on China-source income, does not file an annual reconciliation, and only enjoys the eight categories of expatriate tax-free allowances. Because actual days cannot be known at the first filing, the rules require an estimate based on the labour contract, term of appointment, entry plan and expected stay; the employer withholds on that basis.

The three correction scenarios in the memo

The memo walks through three scenarios where the estimate and reality diverge.

Scenario one: pre-judged as a resident, actually fewer than 183 days (the employee “Bob” left early). From the date it becomes clear the 183-day condition will not be met until 15 days after the end of the tax year, the taxpayer must report to the competent tax authority. The tax is recomputed for the full year as a non-resident: refunds or top-ups follow, and any top-up tax is collected without late-payment surcharge.

Scenario two: pre-judged as a non-resident, actually 183 days or more (the employee “Anna” stayed longer). The withholding method during the year does not change — no mid-year status switch. After year-end, the individual files the annual comprehensive-income reconciliation as a resident, comparing the final resident liability with tax withheld and settling the difference. If the individual departs China and does not plan to return in the year, the reconciliation may be done before departure.

Scenario three: the estimated stay was not more than 90 days (or, for treaty residents, not more than 183 days within the treaty period), but the actual stay exceeded the threshold. The taxpayer must report by the 15th day of the month following the month in which the 90-day (or 183-day) threshold is reached, recompute the wage-salary tax for earlier months and pay the difference, again without late-payment surcharge.

Practical implications for employers

For foreign-invested employers, the memo translates into a concrete compliance routine. First, establish a stay-days ledger for every expatriate, tracking entries and exits, because the classification and all corrections turn on cumulative days. Second, at the first payroll of the year, document the basis for the estimated status — contract term, assignment plan, expected schedule — so the estimate is defensible. Third, monitor for mid-year triggers: early termination, extension, or travel patterns that will cross a threshold. Fourth, when a trigger occurs, report within the defined windows (15 days after it becomes clear the resident threshold will not be met, by 15 days after year-end in the relevant cases, or by the 15th day of the month following the month the stay threshold is crossed) and recompute tax. Fifth, coordinate payroll and tax teams so corrections are implemented consistently across the affected months.

Compliance notes

The memo is a consultative explanation of existing rules, not new law. Its value is procedural clarity: the estimate-first approach is lawful, and the correction windows avoid surcharges for genuine changes of circumstance. But the deadlines are real — missing the reporting window can expose the employer to under-withholding issues and the employee to surcharges in other scenarios. The 90-day and 183-day thresholds interact with tax treaties, so the applicable treaty’s residence-stay period (usually 183 days) must be tracked separately where the individual is a tax resident of a treaty country. Finally, the memo concerns wage-salary taxation of non-resident and resident-without-residence individuals; it does not change the six-year rule for long-term residents or other residence rules, which payroll teams should continue to apply.

Hainan talent & tax measures expanded |

Overview

The Hainan Free Trade Port (FTP) pairs its well-known 15% corporate income tax (CIT) for encouraged industries with an equally important individual income tax (IIT) relief for talent. Under the *Notice on IIT Policies for High-end and Urgently-needed Talent in the Hainan FTP* (Cai Shui [2020] No. 32), individuals working in the FTP who are recognised as high-end or urgently-needed talent pay an effective IIT no higher than 15%: the portion of actual tax burden above 15% is exempted. The policy was originally scheduled to expire at the end of 2024 but was extended to 31 December 2027 by Cai Shui [2025] No. 4, and in 2025 Hainan refined the eligibility and residency rules. For a foreign high-end professional, this can turn a marginal top rate of 45% into an effective 15% — a decisive factor in locating regional or R&D staff in Hainan. This article explains the cap, who qualifies, the 2025 residency refinements, and how to claim.

The 15% effective IIT cap: what it is

Cai Shui [2020] No. 32 provides that for high-end and urgently-needed talent working in the Hainan FTP, the portion of their individual income tax actual burden exceeding 15% is exempted. The relief applies to income sourced from the Hainan FTP, specifically: comprehensive income (工资薪金、劳务报酬、稿酬、特许权使用费 — wages and salaries, remuneration for labour services, author’s remuneration, and royalties); business-operation income (经营所得); and talent-subsidy income recognised by Hainan. The taxpayer enjoys the policy when filing the annual IIT reconciliation (汇算清缴) in Hainan. In effect, the excess over a 15% effective rate is refunded/exempted, so qualifying individuals are capped at roughly 15% regardless of the statutory progressive brackets that otherwise reach 45% at the top.

It is important to distinguish this from the general foreign-individual IIT treatment. Since 2022, under Cai Shui [2018] No. 164, foreign individuals no longer enjoy the former housing, language-training and children-education allowance exemptions and instead take the standard special additional deductions The Hainan 15% cap is a separate, Hainan-specific relief that sits on top of the normal computation and is the item that matters most for senior foreign hires.

Who qualifies: high-end and urgently-needed talent

Eligibility is by “list management” (清单管理). The taxpayer must (a) work in the Hainan FTP, (b) have income sourced from Hainan, and (c) be recognised as high-end or urgently-needed talent under Hainan’s catalogue. The specific catalogue and procedures are set by Hainan province in consultation with the Ministry of Finance and the State Taxation Administration. In practice, “high-end talent” covers leading scientists, senior technical and management personnel in priority industries, holders of recognised qualifications, and talents meeting provincial/municipal high-end criteria; “urgently-needed talent” covers technical and management backbone in Hainan’s key developing industries. Because the policy is designed to attract real substance, an entity must be registered in and substantively operate in the Hainan FTP, and the individual must hold a labour or employment contract of at least one year with that entity — documents that must be retained for five years.

Residency and the 2025 refinements

The original rule required accumulation of 183 days of residence in the Hainan FTP within a tax year. The 2025 refinements (the new *Measures for the Administration of the High-end and Urgently-needed Talent List enjoying IIT Policies*, issued as 琼府 [2025] No. 43, and the implementing announcement by the Hainan Department of Finance and four other departments) make the rule more workable for people who travel. Two changes stand out. First, reasonable off-island business travel, leave and training days are now counted toward the residence tally, while an actual residence of no fewer than 90 days is set as the floor — balancing flexibility with anti-abuse. Second, for specific personnel in aerospace, shipping and offshore oil-and-gas exploration, where frequent travel is inherent, the 183-day test is waived subject to meeting social-insurance and contract conditions. The measures also tighten “substantive operation” checks to prevent shell companies from capturing the relief.

How to claim and the application path

Most eligible individuals are identified through data sharing and need not apply. The tax authority pushes the list of persons with annual income above RMB 300,000 to the human-resources department, which checks island-days and credit standing and then transfers qualifying names to the tax authority for reminder filing. For the exempt categories — certain industry-specific personnel and those residing 90–182 days — a submission is required: industry-specific personnel file an application via the electronic tax bureau by 1 March each year; those in the 90–182 day band receive a reminder, publicly公示 their off-island travel/leave/training for no less than five working days, then declare via the Hainan government service platform or Haiyiban app. Qualifying taxpayers claim the relief when filing the annual reconciliation — comprehensive income between 1 March and 30 June, and business-operation income between 1 January and 31 March. A non-resident individual who cannot enter China to file may appoint an agent or apply to the human-resources department at least 30 days in advance; overpaid tax is refunded upon approval.

What to do next

  • Confirm your role and industry fall within Hainan’s high-end / urgently-needed talent catalogue before relocating staff.
  • Ensure the employing entity is registered in and substantively operates within the Hainan FTP, with at least a one-year contract per person.
  • Plan residence: target the 90-day actual-residence floor, and document reasonable off-island travel/leave/training toward the 183-day tally.
  • For aerospace/shipping/offshore-oil personnel, prepare the social-insurance and contract evidence to use the waived-residency path.
  • File the annual reconciliation in Hainan (comprehensive income 1 Mar–30 Jun; business income 1 Jan–31 Mar) to receive the excess-above-15% exemption.
  • Retain the labour/employment contract and substantive-operation proof for five years.

Individual Income Tax Incentives for Foreign Talent in China: The Greater Bay Area, Hengqin and Hainan (2026 Continuity) |

Attracting global talent is a stated priority of China’s opening policy, and the individual income tax (IIT) relief for overseas high-end and urgently-needed talent is a central lever. Three regional regimes — the Guangdong–Hong Kong–Macao Greater Bay Area (GBA), Hengqin, and the Hainan Free Trade Port — all cap the effective IIT burden at roughly 15% and exempt the subsidy itself. All three are extended into 2027.

Greater Bay Area

Under the GBA policy (财税〔2023〕34号, valid through 31 December 2027), Guangdong and Shenzhen subsidise the IIT paid by overseas high-end and urgently-needed talent in the nine Pearl River Delta cities, by the gap between the tax actually paid and the amount computed at an effective 15% rate; the annual subsidy cap is RMB 5 million per taxpayer. Eligible income covers wages/salaries, remuneration, author’s remuneration, royalties and business income. Shenzhen’s 2026 filing guide (for the 2025 tax year) requires the applicant to work in Shenzhen for 90+ days in the year, hold a contract with a local entity, and be recognised as high-end or urgently-needed. A taxpayer qualifying for both the GBA and the Qianhai or Hetao schemes may choose only one — no stacking.

Hengqin

The Hengqin Guangdong–Macao Deep Cooperation Zone policy (财税〔2026〕2号, effective 1 January 2026 to 31 December 2027) waives the IIT portion above a 15% effective burden for domestic and foreign high-end and urgently-needed talent (managed by a talent list), and for Macao residents, waives the portion above the Macao tax burden. Covered income is comprehensive income (the four items), business income, and locally recognised talent-subsidy income, enjoyed at annual settlement in Hengqin.

Hainan Free Trade Port

The Hainan FTP policy (财税〔2025〕4号, through 31 December 2027) caps the effective IIT rate at 15% for high-end and urgently-needed talent on comprehensive income, business income, and recognised talent-subsidy income sourced from Hainan. As the FTP moves toward island-wide closure, the talent regime is a pillar of its competitiveness for foreign specialists.

How it works in practice

The relief is delivered as a government subsidy/exemption, not a rate change in the statute. The talent must first pay IIT at the statutory progressive rates, then claim the regional subsidy at annual settlement (or enjoy the exemption where the measure directly waives the excess). Because the subsidy itself is exempt from IIT, the net effect is a 15%-equivalent burden. Employers should help talent obtain the local recognition, track days-of-presence, and avoid double-claiming overlapping zones.

Practical steps

  1. Get recognised. Secure high-end/urgently-needed talent status under the local list.
  2. Compute the 15% cap. Compare actual IIT to the 15% computed amount; the gap is the subsidy.
  3. Choose one scheme. If in an overlap zone, elect a single programme for the year.
  4. Meet the presence test. Keep local work-day evidence (e.g., 90+ days for Shenzhen).
  5. File on time. Use the local fiscal bureau’s annual guide; retain recognition and payment records.

Practitioner Quick Reference

  • 15% effective cap: GBA, Hengqin and Hainan all cap the IIT burden at roughly 15% for qualifying talent.
  • Subsidy is exempt: the regional subsidy itself is exempt from IIT; net effect is a 15% burden.
  • No stacking: overlapping GBA/Qianhai/Hetao schemes allow only one election per year.
  • Presence test: Shenzhen requires 90+ local work days; keep day-count evidence.
  • File annually: use the local fiscal bureau’s guide; retain recognition and payment records.

Common Pitfalls

  • Double-claiming zones: electing two overlapping schemes triggers clawback.

Tax Residency for Foreign Individuals in China: The 183-Day Test, the Six-Year Rule and Treaty Relief

  • In China, tax residency turns on domicile or an aggregate 183-day stay in a tax year; a resident is taxed on worldwide income, a non-resident only on China-source income.
  • “Domicile” means habitual residence from household, family or economic ties — not property ownership — so an individual may be domiciled without owning a home.
  • A non-domiciled days-based resident with fewer than six consecutive 183-day years may, after filing, exempt foreign-source income paid by an overseas payer.
  • Any single departure exceeding 30 days within a 183-day year restarts the consecutive-year count, and full worldwide taxation matures only after six such years.
  • A non-resident staying 90 days or fewer is exempt on China-source pay borne by and paid from abroad; the 90-day and 183-day bands split the wage-income treatment.
  • Senior managers are taxed on China-paid wages regardless of where duties are performed, and treaty residents may claim employment-article relief computed under formula two.
  • Practical compliance hinges on immigration records, deliberate 30-day departures, the 2019 start of the six-year clock, filing for the Article 4 relief and intercompany cost-sharing terms.

Tax Residency for Foreign Individuals in China: The 183-Day Test, the Six-Year Rule and Treaty Relief |

Overview

For a foreign individual working in China, the key personal-income-tax question is simple to state but easy to get wrong: are you a tax resident or a non-resident? The answer determines whether China can tax your worldwide income or only your China-source income, and it cascades into the 90-day and 183-day thresholds, the six-year rule, the senior-manager rules and any treaty relief. This article sets out the statutory tests as they stand in 2026, grounded in the Individual Income Tax Law, its implementing regulations (State Council Decree No. 707) and the two 2019 public announcements (No. 34 and No. 35) that operationalise them. It does not cover subsidies or preferential tax rates.

Two tests: domicile and days

There are two independent routes into resident status, and either one is sufficient on its own.

The first is domicile (住所). Under Article 2 of the implementing regulations (国令第707号), “having a domicile” in China means habitual residence arising from household registration (户籍), family or economic-interest ties — not ownership of property. An individual who, because of family or economic connections, habitually resides in China is treated as domiciled even without owning a house or holding a permanent-residence card. This is a facts-and-circumstances test, and it is deliberately decoupled from real estate.

The second is the day-count. Under Article 1 of the IIT Law, an individual without a China domicile who resides in the mainland for an aggregate of 183 days or more within a single tax year is a resident individual for that year. The tax year runs from 1 January to 31 December under the Gregorian calendar. Residence, for this purpose, is measured in days, not in intent.

The 183-day threshold

Article 1 draws the central line. A resident individual — by domicile or by the 183-day test — is taxed on worldwide income (income sourced both inside and outside China). A non-resident individual — no domicile and not resident, or an aggregate stay below 183 days in the tax year — is taxed only on China-source income.

The practical stakes are large: a non-resident on a short assignment keeps foreign-source pay outside the Chinese tax net entirely, while a resident, once the six-year clock matures, can be taxed on everything. The 183-day line is therefore the pivot of every assignment plan.

The six-year rule and the 30-day reset

Article 4 of the implementing regulations gives a limited carve-out for the days-based resident who is not domiciled. If, in each year in which the individual has stayed 183 days or more, the consecutive run of such years is fewer than six, the individual may — upon filing with the in-charge tax authority (备案) — be exempt from IIT on income sourced outside China and paid by an overseas entity or individual.

Two mechanics matter. First, the reset: if in any one of those 183-day years the individual leaves China for a single continuous period exceeding 30 days, the consecutive-year count restarts from zero. Second, the maturity: once the individual has six consecutive 183-day years without such a reset, the carve-out falls away and worldwide income is fully taxable.

Public Announcement No. 34 (2019) pins down the counting. “The prior six years” means the six consecutive tax years from the year before the current one back to six years before it. The starting year of this count is 2019 (inclusive) or later — years before 2019 do not count. So an individual who first hit 183 days in 2019 and has stayed every year since, with no single departure over 30 days, becomes fully worldwide-taxable only from 2025 (the sixth consecutive year). Days are counted as aggregate stays; a day counts only if the individual stays a full 24 hours, and a partial day does not count.

The 90-day safe harbour

Article 5 of the implementing regulations offers deeper relief for the short stayer. A non-resident who stays in the mainland for no more than 90 days in a tax year is exempt from IIT on the China-source portion of income that is paid by an overseas employer and not borne by that employer’s institution or establishment in China. In plain terms: a brief visit financed from abroad escapes Chinese tax even on the China-attributable slice.

Four scenarios for wage income

Public Announcement No. 35 (2019) organises wage-and-salary treatment into four cases, all built on attributing income to the China work period by an apportionment formula across days worked in and outside China.

  1. Non-resident, aggregate stay ≤ 90 days: tax is due only on wages attributable to the China work period and paid or borne by a China employer (formula one). “China employer” includes domestic units and persons as well as an overseas unit’s China institution or establishment; if that China employer is under assessed-collection or has no taxable revenue so the wages are not booked, the wages are still deemed paid or borne by it.
  2. Non-resident, stay > 90 but < 183 days: the wages attributable to the China work period are taxed in full (whether paid in or outside China), while the overseas-work portion is not (formula two).
  3. Days-based resident, fewer than six consecutive 183-day years and meeting Article 4 relief: all wages are taxed except the portion attributable to the overseas work period and paid by an overseas unit or individual (formula three).
  4. Days-based resident, six consecutive years with no relief: all China and overseas wages are taxed.

The common thread is attribution to the China work period, while the payer test (who pays or bears the wage) decides the rest.

Senior managers

Senior management personnel (高管人员) are subject to a special sourcing rule. Wages paid or borne by a China payer are treated as China-source income regardless of where the duties are performed. For a senior manager who is a resident individual, the computation follows the ordinary days-based-resident rules set out above. For a non-resident senior manager, the days rule applies with a twist: if the stay in the year is ≤ 90 days, all China-paid income is included; if the stay is > 90 but < 183 days, all China-paid income plus the China-source income paid from overseas is included. The manager’s presence in China thus matters less than who pays.

Treaty relief

Where the individual is a tax resident of a treaty partner and qualifies for relief under the “income from employment” article of the relevant double-taxation agreement, the wage income may be exempt from Chinese IIT, with the wage income amount computed under formula two. Where the treaty provides otherwise, the treaty governs. Announcement No. 35 took effect from 1 January 2019; a non-resident who overpaid under the prior rules on income received after that date may apply for a refund in accordance with the law. To claim treaty relief, the individual must keep the supporting documentation required under the non-resident treaty-benefit administration rules.

Annual reconciliation

A domiciled or days-based resident individual with comprehensive income must, after the year ends, aggregate the annual wage-and-salary, remuneration for labour services, author’s remuneration and royalties income amounts and compute IIT; where a reconciliation filing (汇算清缴) is required, it must be made. When computing the comprehensive-income amount, the special additional deductions (专项附加扣除) may be claimed. The pre-2022 option for a foreign individual to choose either the eight subsidies (housing, children’s education, language training and the like) or the special additional deductions — but not both — is noted only in passing; it is covered in another article on this site (No. 182).

Practical planning

Several operational points follow from the rules above.

  • Keep immigration records. Passport stamps and border-control records prove every day count; retain them for the full limitation period.
  • Plan the 30-day departure inside any 183-day year. The reset only works if a single continuous absence exceeds 30 days within a year in which you have already crossed 183 days; schedule it deliberately.
  • Understand that the six-year timer starts in 2019. Years before 2019 are irrelevant; if your first 183-day year was 2019, full worldwide taxation arrives no earlier than 2025, and a planned reset can defer it.
  • Honour the filing obligation. The Article 4 relief requires a filing (备案) with the in-charge tax authority; without it the exemption is unavailable even where the facts qualify.
  • Watch the cost-sharing agreement. Whether wages are “paid or borne” by the China entity or the headquarters is decided by the intercompany cost-allocation arrangement and directly changes the taxable scope under scenarios one and three.
  • Keep treaty-benefit files. Treaty relief must be supported by the documents required under the non-resident treaty-benefit administration rules, retained for inspection; a missing file defeats the claim.

Foreign talent individual income tax incentives in China (2026): allowances, the 15% Greater Bay Area cap and Hengqin | 2026

Overview: a layered incentive map

China uses individual income tax (IIT) to attract global talent while keeping a broad base. For foreign-invested enterprises hiring expatriates, three layers matter in 2026: (1) the national foreign-individual allowance preference; (2) the Greater Bay Area (GBA) 15% cap subsidy; and (3) the Hengqin cooperative zone 15% cap. This article maps each for HR and mobility teams.

The national foreign-individual allowance preference

The Ministry of Finance and the State Taxation Administration (STA) continue the policy on foreign individuals’ housing, language-training and children-education allowances. Per the STA’s published guidance, a foreign individual who qualifies as a resident individual may choose either the special additional deductions under the IIT law or the exemption on allowances for housing, language training and children’s education under earlier notices (财税字〔1994〕020号, 国税发〔1997〕54号, 财税〔2004〕29号) — but not both. Once chosen, the election is locked for the tax year. The policy is currently in force through 31 December 2027.

Exempt items foreign individuals may claim

Under the STA’s consolidated Q&A, foreign individuals temporarily enjoy exemption on: non-cash or reimbursement-form housing, meal and relocation subsidies; reasonable business-travel subsidies (domestic/overseas); home-visit, language-training and children-education expenses; dividends/bonuses from FIEs; and, where qualifying, salary income of foreign experts sent by the World Bank, UN agencies, UN-aid projects, aid-country experts, and cultural/exchange experts whose pay is borne by the foreign government under bilateral or inter-governmental programs. These are the building blocks of a low effective rate for genuinely resident expatriates.

The Greater Bay Area 15% cap

For overseas (including Hong Kong, Macao and Taiwan) high-end and urgently-needed talent working in the GBA, the finance and tax authorities grant a subsidy equal to the IIT amount exceeding the 15% effective rate, and that subsidy is exempt from IIT. The applicable scope covers the nine Pearl River Delta cities (Guangzhou, Shenzhen, Zhuhai, Foshan, Huizhou, Dongguan, Zhongshan, Jiangmen, Zhaoqing). The policy is extended and in force through 31 December 2027 (originally 财税〔2019〕31号, extended by 财税〔2023〕34号). Employers in Guangzhou, Shenzhen and elsewhere in the GBA should confirm the local “talent list” administration.

Hengqin: a 15% cap plus a Macao differential

On 2 February 2026, the Ministry of Finance and the STA issued a notice continuing the Hengqin Guangdong–Macao Deep Cooperation Zone IIT preference. From 1 January 2026 to 31 December 2027, for domestic and foreign high-end and urgently-needed talent working in Hengqin, the portion of IIT exceeding 15% is exempted. A separate rule exempts the portion of Macao residents’ IIT exceeding the Macao tax burden. Covered income includes comprehensive income (wages, remuneration, author’s remuneration, royalties), business income, and government-recognized talent-subsidy income, enjoyed at annual IIT settlement.

Residency, the 183-day rule and treaties

Whether a foreign employee is a tax resident drives the choice above. Under the IIT law, an individual present in China for 183 days or more in a tax year is generally a tax resident (subject to treaty tie-breaker and the “six-year” rule for worldwide income). Many double-taxation agreements provide relief on salaries, dependent personal services and director fees; the STA’s treaty-benefit regime lets qualifying individuals claim reduced rates. Mobility teams should model residency and treaty positions before year-end, because the foreign-individual allowance election is annual.

Annual settlement and employer duties

The annual IIT settlement (汇算清缴) reconciles withholdings against the chosen regime and any treaty benefits. Employers must: (1) document which regime each foreign employee elected; (2) retain evidence of allowances and the talent-list determinations; (3) file and withhold correctly during the year; and (4) support the employee’s settlement. Because the election is locked per tax year, getting the choice right upfront avoids a costly reversal.

Practical steps for FIEs hiring foreign talent

  1. Classify each expat as resident or non-resident early in the assignment year.
  2. Model the two national routes (special additional deductions vs. allowances) and pick the lower-burden one.
  3. Check GBA / Hengqin eligibility if the role sits in Guangdong or Hengqin; pursue the talent list.
  4. Confirm treaty benefits where salary is treaty-covered.
  5. Lock the annual election and keep evidence; brief payroll.
  6. Plan the year-end settlement so refunds or top-ups are handled cleanly.

Greater Bay Area Talent Tax Subsidy: How Foreign and HK/Macao/Taiwan Staff Cap Their China IIT at 15% | 粤港澳大湾区境外人才个税补贴:外籍与港澳台雇员如何将内地个税实际负担降至15%

Overview: Why Talent Tax Cost Decides China Assignments

For a foreign-invested enterprise staffing a project in southern China, the decisive budget line is rarely rent or corporate income tax — it is the cost of placing a senior engineer or research lead on the ground. Mainland individual income tax (IIT) reaches a 45% marginal rate on comprehensive income, while the Hong Kong SAR levies salaries tax at a 15% standard rate; employers that gross up packages absorb that gap. The Greater Bay Area (GBA) talent subsidy exists to close it.

The Legal Basis: Caishui [2023] No. 34

The operative instrument is the *Notice on Continuing the Preferential Individual Income Tax Policy for the Guangdong–Hong Kong–Macao Greater Bay Area*, issued by the Ministry of Finance and the State Taxation Administration as Caishui [2023] No. 34 on 18 August 2023, running through 31 December 2027. The text is short by design: it names the paying authorities, defines the subsidy basis, exempts the subsidy from tax, and delegates operational detail to provincial and municipal rules.

A Subsidy, Not a Rate Cut

Under No. 34, Guangdong Province and Shenzhen Municipality grant a financial subsidy to overseas high-end talent and urgently needed talent working in the GBA, measured by the differential between the mainland IIT burden and the Hong Kong SAR individual income tax burden. The subsidy is itself exempt from individual income tax.

The two-layer design matters. The employee still pays mainland IIT in full at ordinary rates; only afterwards does municipal finance return the excess, and that return is not taxed again. There is no preferential withholding rate, and no relief an employer can grant at payroll.

Who and Where: The Nine Pearl River Delta Cities

The money comes from mainland municipal budgets and covers overseas personnel — including people from the Hong Kong SAR, the Macao SAR and the Taiwan region — working in the nine Pearl River Delta cities:

CityCityCity

The Hong Kong SAR and the Macao SAR belong to the GBA but do not disburse this subsidy; the city of employment decides which rulebook applies.

Recognising “High-End” and “Urgently Needed” Talent

No. 34 defines neither term: talent recognition and the subsidy measures follow the relevant provisions of Guangdong Province and Shenzhen Municipality. That produces two parallel rule-sets — a provincial framework used by Guangzhou, Zhuhai, Foshan and the others, and a separate Shenzhen regime — each with its own catalogue, thresholds, filing platform and window. This is where most claims fail: an employee who qualifies in one city may fall outside the catalogue next door.

The 15% Effect, Explained

Because the Hong Kong SAR salaries-tax standard rate is 15%, the effect is usually summarised in one line: a qualifying individual’s effective mainland IIT burden is levelled to roughly 15%, with the excess refunded. That describes an outcome, not the law. Statutory rates are unchanged, and the amount received depends on each city’s method and any cap. Present it as an expected net position, never as a guaranteed rate.

The Expatriate Allowance Exemption: An Annual Either/Or

A separate nationwide arrangement lets foreign individuals treat eight allowance categories — housing allowance, language training fees, children’s education fees and others — as tax-exempt benefits instead of claiming the special additional deductions. It currently runs through 31 December 2027. The choice is a true either/or, and once made it cannot be changed within the tax year.

PointEight-allowance exemptionSpecial additional deductions
EligibleForeign individuals onlyAll resident taxpayers
BasisDocumented actual expenseFixed statutory amounts
ElectionLocked for the tax yearLocked for the tax year

The GBA subsidy is computed on mainland tax actually borne, so this election feeds straight into it.

Policy Momentum in 2026: FDI Action Plan and CEPA Upgrade

The *Action Plan for Stabilising and Optimising the Use of Foreign Investment* (Shangzifa [2026] No. 97), issued by MOFCOM, the NDRC and the Ministry of Finance on 16 June 2026 with State Council approval, points the same way. Its section on foreign-invested R&D centres commits to facilitating the introduction of high-level foreign talent; its market-access section calls for a comprehensive upgrade of the CEPA arrangements with the Hong Kong SAR and the Macao SAR, opening services sectors to investors from the two SARs first.

What the FDI Data Says About Talent Demand

At MOFCOM’s briefing on 23 July 2026, actual use of foreign investment in the first half of 2026 was RMB 402.14 billion. Structure matters more than total: high-tech industries grew 33.2% year on year to a record 42.4% share; R&D and design services rose 82%; technology-transfer services rose 57.1%. These activities cannot be staffed locally at short notice, so after-tax pay for key researchers increasingly decides where a project lands.

Practical Steps for Employers and Assignees

  1. Confirm location and catalogue. The workplace must be one of the nine cities, and the individual must meet that city’s high-end or urgently needed talent criteria.
  2. Plan around the tax year. Claims are made by tax year, normally in a concentrated window the following year, and mainland tax must be paid in full first.
  3. Assemble evidence early. Employment contracts, social insurance or IIT payment certificates, and proof of qualifications, title or salary threshold.
  4. Check every city separately. Shenzhen and Guangzhou differ on platforms, windows and catalogues; do not reuse one checklist.
  5. Model the election. Compare the two regimes before the year starts — the choice is then locked.
  6. Keep the file. This is local fiscal money; retain complete application and disbursement records.

Withholding tax on outbound payments |

Overview

When a China resident enterprise pays certain cross-border amounts to a non-resident — most importantly dividends, interest and royalties — Chinese tax law imposes a withholding tax (WHT, 预提所得税) at the payer. The mechanism is “source withholding” (源泉扣缴): the Chinese payer is the withholding agent and must deduct the tax from each payment. The headline statutory rate is 10% of the gross amount, but that rate is frequently reduced to 5% (or lower) where a bilateral tax treaty applies and the recipient qualifies. Understanding when 10% bites, how the filing works, and how to reach the treaty-reduced rate is essential for any foreign investor receiving income from a China entity. This article focuses on the outbound-payment mechanics; the eligibility and “beneficial owner” test for treaty relief are covered in our companion *Tax treaty benefits for foreign investors*.

The 10% statutory rate and what it applies to

The legal basis is the *Enterprise Income Tax Law* (EITL). Article 37 provides that for the income described in Article 3(3) earned by a non-resident enterprise, tax is collected by source withholding, with the payer as withholding agent; the tax is withheld from each payment or each payment due. Article 4 sets the rate for such non-resident income at 20%, but the EITL Implementation Regulations reduce it to 10%. The relevant Article 3(3) income is the passive, China-sourced income of a non-resident with no establishment in China: dividends and bonus (equity investment income), interest, rent, and royalties. Critically, the taxable base is the full amount received (收入全额) — there is no deduction for costs or expenses borne by the non-resident (EITL Article 19). So a USD 1,000,000 royalty paid out generally carries a USD 100,000 WHT at the statutory rate.

The source-of-income rules matter for determining whether China can tax at all. Under the Implementation Regulations, dividends are sourced where the paying enterprise is resident; interest, rent and royalties are sourced where the payer/enterprise or individual bearing or paying the income is located. In practice, a payment by a China company to an overseas parent for a dividend, loan interest or licence fee is China-sourced and within the WHT net.

Filing, withholding and the outbound payment tax recordal

The payer’s obligation is mechanical and time-bound. Under EITL Article 40, the withholding agent must pay each withheld amount into the treasury within seven days of the withholding and file the withholding enterprise-income-tax return with the local tax authority. The detailed procedural rules are in SAT Announcement [2017] No. 37 (*Issues concerning source withholding for non-resident enterprise income tax*), which also sets the FX conversion to RMB at the central parity rate on the withholding-incurred date.

Separately, cross-border service-trade and similar outbound payments are subject to a tax recordal (税务备案) before remittance. Under the SAT/SAFE rule (Announcement [2013] No. 40, as applied), a domestic payer making a single outbound payment of services, royalties and similar items of USD 50,000 equivalent or more must complete the tax recordal; below that threshold the recordal is generally not required. This recordal is about the outbound payment channel, not the WHT rate, and it sits alongside (not in place of) the withholding obligation where both apply. The non-resident recipient’s own treaty-benefit claim, where relevant, is handled under SAT Announcement [2019] No. 35 (*Administration of non-resident taxpayers enjoying tax-treaty benefits*) — a self-assessment regime in which the non-resident determines eligibility and enjoys the benefit, retaining supporting materials for follow-up administration.

The treaty-reduction path

China has an extensive network of bilateral tax treaties (see *Tax treaty benefits for foreign investors*), and these routinely cut the 10% WHT. A typical dividend article gives a 5% rate where the beneficial owner is a company directly holding at least 25% of the payer’s capital, and 10% otherwise; interest and royalty articles often reduce to 10%, 7% or lower depending on the treaty. The path to the reduced rate is therefore: (1) confirm a treaty exists between China and the recipient’s jurisdiction; (2) confirm the recipient is a treaty resident and the “beneficial owner” of the income; (3) have the payer apply the reduced rate when withholding, supported by the recipient’s tax-residence certificate and beneficial-owner evidence; (4) retain the file for post-event administration. Where the recipient fails the beneficial-owner test or the main-purpose test, the 10% statutory rate (or general anti-avoidance) applies. Hong Kong and Macao are covered by separate Mainland–HK and Mainland–Macao arrangements that follow the same beneficial-owner logic.

Practical checklist

Getting this right protects both the payer (who is liable if it under-withholds) and the recipient (who wants the lowest lawful rate). Key disciplines: compute WHT on the gross amount, not net; withhold and remit within seven days; complete the outbound payment tax recordal for service/royalty payments at or above the USD 50,000 threshold; obtain the non-resident’s tax-residence certificate before applying any treaty rate; and document the beneficial-ownership analysis. Treat the WHT and the treaty claim as one coordinated exercise, decided before the payment date rather than reconciled after it.

What to do next

  • Identify whether each outbound payment is a dividend, interest, royalty, rent or other Article 3(3) item — this determines WHT exposure.
  • Withhold at 10% of the gross amount by default, and remit to the treasury within seven days of withholding.
  • Complete the outbound payment tax recordal for service/royalty payments of USD 50,000 equivalent or more before remitting.
  • To use a treaty rate, obtain the recipient’s tax-residence certificate and run the beneficial-owner test first.
  • Apply the reduced treaty rate at the withholding stage, with supporting documents retained for follow-up administration.
  • Coordinate the WHT, the treaty claim and the remittance date as a single plan, not separate steps.

Overview

Two tax tracks matter most for technology firms:

  1. Value-added tax (VAT) exemption on technology transfer, technology development, and the related technical consulting and technical services.
  2. Corporate income tax (CIT) incentives for encouraged IC and software enterprises, plus the general 15% rate for high-tech enterprises.

Both tracks are open to foreign-funded enterprises (FIEs) established in China, provided they meet the substantive requirements (genuine R&D, qualified contracts, proper filing).

VAT exemption under the 2026 transitional measures

The Ministry of Finance and State Taxation Administration Announcement No. 10 of 2026 sets out transitional measures linked to the coming into force of the VAT Law. For the period 1 January 2026 to 31 December 2027, the following are exempt from VAT:

  • Transfer of technology (technology transfer);
  • Technology development (commissioned or cooperative R&D that yields new technology);
  • Related technical consulting and technical services directly associated with the above.

This exemption preserves the long-standing “four-tech” VAT exemption (technical transfer, technical development, and related technical consulting/services) that would otherwise have been recast by the new VAT Law. Claimants generally must register the technology contract with the local science and technology authorities and obtain a tax exemption filing or record from the tax office.

Practical points for foreign firms

  • Licensing IP into China, or providing development services from a Chinese entity, can fall within the exemption if the contract qualifies.
  • Pure trading of goods, or services not “technical” in nature, is out of scope.
  • Keep contract wording aligned with the catalog definitions and obtain the local S&T bureau record.

CIT incentives for IC and software

Encouraged IC design, equipment, materials, packaging/testing, and software enterprises have historically enjoyed a “two years exempt, three years half” CIT holiday (exempt in the first two years of profitability, 50% reduced in the following three). Specific measures such as Cai Shui [2020] No. 45 and related documents continue to apply, subject to the encouraged-industry catalog and qualifying conditions (e.g., core business share, R&D intensity, staff qualifications).

Key software enterprises

“Key” (national-priority) software enterprises that satisfy the catalog and qualification rules are taxed at a reduced 10% CIT rate once recognized.

High-tech enterprises

Regardless of IC/software status, enterprises recognized as High and New Technology Enterprises (HNTE) pay a preferential 15% CIT rate (versus the standard 25%). Recognition requires core自有 IP, R&D spend thresholds, and revenue composition rules.

IncentiveRate / benefitTypical eligibility
VAT exemption (tech transfer & development)0% VATQualified tech contract, S&T record
Encouraged IC / software CIT holiday0% (Y1–2), 12.5% (Y3–5)Encouraged-industry catalog, substance
Key software enterprise10% CITPriority catalog + recognition
High-tech enterprise (HNTE)15% CITHNTE recognition, R&D intensity

Why this matters for market entry

Foreign technology companies often hesitate to localize IP or R&D in China for tax or control reasons. The combination above lowers the effective tax cost of:

  • Setting up a Chinese R&D center that licenses back to group;
  • A Chinese software/IC design entity selling qualified products;
  • Cross-border technology development contracts executed through a Chinese vehicle.

Because the VAT exemption is time-bound to end-2027, firms should plan contract timing and filings early. The CIT incentives are longer-lived but catalog-dependent, so eligibility should be confirmed with advisers before relying on them.

  • 技术转让;
  • 技术开发(委托或合作研发形成新技术);

  • 设立中国研发中心并向集团许可技术;
  • 中国软件/IC设计实体销售合格产品;
