Social Insurance Enrollment for Foreign Employees & Bilateral Treaty Exemptions | 外籍员工社会保险登记与双边社保协定豁免

Overview

Payroll for a foreign hire in China is not just salary and individual income tax — social insurance is a mandatory, often underestimated layer. Foreign employees are, with narrow exceptions, treated the same as local staff for the five statutory insurances, and the cross-border twist is the network of bilateral social-security agreements that can exempt a national from part of the burden. This article walks HR and mobility teams through who must enroll, the timeline, the agreement-based exemptions, and how to keep it compliant. Legal basis & who must enroll

The Interim Measures for Foreigners Employed in China to Participate in Social Insurance (MOHRSS Order No.16, amended 2024) is the core rule. A “foreigner employed in China” means a non-Chinese national legally working with a work permit and residence permit, or a Permanent Resident ID. Employers registered in China that hire such persons — and in-China work units hosting foreigners dispatched from an overseas employer — must enroll them in basic old-age, basic medical, work injury, unemployment and maternity insurance.

The 30-day clock

Article 4 is the operative deadline: the employer must complete social-insurance registration within 30 days of the work permit. The work-permit issuing authority shares information with social-insurance agencies, so gaps are visible. Enrollment uses the local premium base and rate schedule — identical to Chinese employees — with employer and employee shares.

Bilateral social-security agreements (exemptions)

China has concluded social-security agreements with 13 countries: Germany, Korea, Denmark, Canada, Finland, Switzerland, Netherlands, Spain, Japan, Serbia, Luxembourg, Kyrgyzstan, and France (not yet in force). Under these agreements, a covered national temporarily sent to China may be exempted from certain insurances (commonly old-age and sometimes unemployment) for a defined period, upon presenting a Certificate of Coverage (参保证明) issued by the home-country agency.

Operational points:

  • Obtain the home-country certificate before arrival or as early as possible; retroactive exemption is not guaranteed.
  • The certificate names the exempted insurance(s) and validity period — keep it on file and renew before expiry.
  • Medical, work-injury and maternity are typically not exempted and remain compulsory.
  • Verify the current country list and scope in the 2026 Guide and on MOHRSS, as agreements are added/updated over time.

Enrollment steps (employer)

  1. Confirm the work permit + residence permit are issued.
  2. Open/extend social-insurance registration at the local agency or online portal within 30 days.
  3. Declare the premium base; deduct the employee share from salary and pay the employer share.
  4. If a bilateral certificate applies, submit it to obtain the exemption for the named insurance(s).
  5. Issue the 医保电子凭证 to the employee; retain records for inspection.

Dispatched (intra-group) foreigners

Where a foreigner is employed by an overseas group company and posted to a China branch/rep office, the in-China work unit is responsible for enrollment and contributions — the overseas employer cannot simply self-insure. This is a frequent compliance gap for secondments.

Interaction with tax (183-day rule)

Social insurance and individual income tax are separate systems but overlap in practice. The 183-day rule determines Chinese tax residency for IIT; it does not by itself create or remove the social-insurance obligation, which hinges on lawful employment and the work permit. HR should coordinate both workstreams so a new hire is enrolled for insurance and correctly taxed from day one.

What to do next

  • Set a calendar trigger: enroll every foreign hire within 30 days of the work permit — track it like a payroll deadline.
  • Ask relocated hires for a bilateral Certificate of Coverage before they fly; file for the exemption early.
  • Confirm which insurances are exempt vs. compulsory under the relevant agreement (medical/injury/maternity usually stay).
  • For secondments, make the in-China entity the enrollment party; don’t rely on the overseas employer.
  • Keep certificates, base declarations and payment proofs archived for labour-inspection readiness.

概述

法律依据与参保对象

核心规则是《在中国境内就业的外国人参加社会保险暂行办法》(人力资源社会保障部令第 16 号,2024 年修正)。”在中国境内就业的外国人”指持工作许可与居留证件合法就业,或持永久居留身份证的非中国籍人员。在中国境内依法注册登记的用人单位招用此类人员,以及接待境外雇主派遣外籍员工的境内工作单位,须为其参加基本养老保险、基本医疗保险、工伤保险、失业保险、生育保险。

30 日时钟

第四条是操作性死线:用人单位须自办理就业证件之日起 30 日内完成社会保险登记。就业证件签发机关会与社保经办机构共享信息,缺口可见。参保使用属地缴费基数与比例——与中国员工一致,由单位和个人分担。

双边社会保险协定(豁免)

中国已与 13 个国家签署社会保险协定:德国、韩国、丹麦、加拿大、芬兰、瑞士、荷兰、西班牙、日本、塞尔维亚、卢森堡、吉尔吉斯斯坦,以及法国(暂未生效)。依协定,被临时派往中国的覆盖国国民,凭本国经办机构签发的参保证明(Certificate of Coverage),可在规定期限内免除养老(通常含失业)等相应险种缴费。

操作要点:

  • 在来华前或尽早取得本国参保证明;豁免未必可补追溯。
  • 证明载明确免责种与有效期——留存并于到期前续办。
  • 医疗、工伤、生育通常豁免,仍属强制。
  • 协定国名单与范围会随时间增减更新,以 2026 版指引及人社部最新发布为准。

登记步骤(用人单位)

  1. 确认工作许可与居留证件已签发。
  2. 于 30 日内在属地社保经办机构或网上平台开立/续展社保登记。
  3. 申报缴费基数;从工资扣缴个人部分并缴纳单位部分。
  4. 若适用双边证明,提交以取得对应险种豁免。
  5. 向员工发放医保电子凭证;留存记录备查。

派遣(集团内)外籍员工

若外籍员工受雇于境外集团公司并被派往中国分支/代表机构,境内工作单位负责参保与缴费——境外雇主不能简单”自我保险”。这是借调中常见的合规盲区。

与个税(183 天规则)的衔接

社保与个人所得税是两套系统,但实务交叉。判定中国税收居民的183 天规则并不单独创设或免除社保义务,社保义务取决于合法就业与工作证件。HR 应协同两条线,使新员工自入职首日起既参保又被正确征税。

下一步建议

  • 设置日历触发:每名员工自工作许可起 30 日内参保——像薪酬死线一样跟踪。
  • 要求外派员工登机前取得双边参保证明,尽早申报豁免。
