Why this matters now

China’s foreign-investment policy has entered a “stabilise, retain and upgrade” phase. After a cycle of negative-list cuts and the full removal of manufacturing access restrictions, the policy question is no longer chiefly about *what is open* but about *how easy it is to operate, grow and reinvest*. The *Action Plan for Stabilising and Optimising Foreign Investment* (MOFCOM, NDRC and MOF, Document No. 97 of 2026, issued 16 June 2026 with State Council approval) is the most consolidated statement of that shift. Market access: services is the new frontier

Manufacturing foreign-access restrictions have been fully cancelled. The Plan therefore foregrounds services, which now account for roughly 70% of actually-utilised foreign capital. Concrete openings include:

  • expanding pilot openings for cloud computing, wholly-foreign-owned hospitals and biotech;
  • widening the opening of vocational training, schools and high-level science/engineering/agriculture/medical universities;
  • supporting Beijing’s comprehensive services-opening demonstration zone and piloting digital-economy and healthcare-modernisation measures;
  • upgrading the Closer Economic Partnership Arrangement (CEPA) with Hong Kong and Macao to open services to them first;
  • in finance, letting more foreign institutions use risk-management tools including government-bond futures, conduct fund-investment advisory business, and listing key foreign firms domestically.

The signal is clear: the marginal liberalisation now lives in services, and FIEs should revisit sectors — healthcare, education, cloud, finance — that were historically constrained.

Investment facilitation: from entry to operation

Three measures matter most for day-to-day FIE operations:

  • Foreign M&A: the rules on foreign investors acquiring domestic enterprises will be revised to streamline process and consideration payment, with strengthened inter-departmental coordination; qualifying foreign equity-investment institutions may participate as strategic investors in non-related listed-company securities issuance.
  • Cross-border data: FTZs and services-opening pilot cities are encouraged to formulate scenario-based, field-level negative lists for data export, and national standards for important-data identification are to be developed in sectors such as industry, telecoms, geoinformation, automotive, pharmaceuticals, seeds, aerospace and civil aviation.

Promotion and safeguards

On safeguards, it affirms national treatment, strengthens fair-competition review in government procurement and bidding, supports FIE participation in consumption-stimulation campaigns, and establishes a coordinated mechanism for handling online-infringement complaints — protecting FIEs’ legitimate online rights.

Optimising management

The Plan pledges a comprehensive upgrade of the foreign-investment information-reporting system, with direct reporting channels and information sharing that support foreign-exchange registration, administrative licensing and fixed-asset-investment management. For FIEs, this points to a lighter, more digital compliance footprint over time.
