Vocational education and skills training: 2026 access and compliance for foreign investors | 2026

Overview

Vocational education and skills training is one of the few education sub-sectors where China is actively widening the door to foreign capital in 2026. The signal is unambiguous: the *Action Plan for Stabilising and Optimising Foreign Investment*, issued on 22 June 2026 by the Ministry of Commerce (MOFCOM), the National Development and Reform Commission (NDRC) and the Ministry of Finance, lists “steadily expanding the opening pilot for vocational-skills training institutions, vocational colleges, and high-level science/agriculture/medicine/engineering universities” among its market-access measures. On the ground, free-trade zones are already moving: Nanning’s Guangxi FTZ片区 published, on 3 July 2026, a draft implementing rule for wholly foreign-owned for-profit vocational-skills training institutions (non-schooling type).

This article explains the legal scaffold, the 2026 openings, the FTZ pilots, and the compliance checklist for a foreign investor.

The legal scaffold

Three statutes frame the sector. The *Private Education Promotion Law* and its implementation regulations govern all non-government education, distinguishing for-profit from non-profit and schooling from training. The *Sino–Foreign Cooperation in Running Schools Regulation* specifically governs cooperative schools and training institutions with a foreign party. The *Vocational Education Law* sets the policy direction toward industry–education integration and enterprise participation.

Crucially, the line that matters most for foreign capital is schooling vs. non-schooling (培训). A “vocational college” (职业院校) or “schooling-type” institution confers qualifications through a formal education pathway and is treated as education proper, subject to tighter foreign-investment constraints. A “vocational-skills training institution (non-schooling type)” delivers skills training without conferring a formal academic qualification and is the segment now being opened to wholly foreign-owned investment in pilot zones.

The foreign-investment negative list is the other reference point. The national list has been cut to 29 items with manufacturing fully opened; education is not among the broadly liberalised items, so the opening for vocational training proceeds through *pilot* mechanisms and FTZ implementing rules rather than a blanket list removal.

The 2026 opening signals

The June 2026 Action Plan is the clearest statement. Its education opening measures are:

  • steadily expand the opening pilot for vocational-skills training institutions;
  • steadily expand the opening pilot for vocational colleges;
  • steadily expand the opening pilot for high-level science/agriculture/medicine/engineering universities.

The Plan also broadens the wholly foreign-owned hospital pilot and supports foreign-invested R&D centres with training bases — relevant because enterprise training and R&D talent development are adjacent opportunities. The policy framing is “shaping the new advantages of attracting foreign capital during the 15th Five-Year Plan” through services liberalisation.

FTZ pilots on the ground: Nanning and beyond

The most concrete 2026 move is Nanning’s Guangxi FTZ片区 draft (public comment 3 July – 2 August 2026) for * Measures for Wholly Foreign-Owned For-Profit Vocational-Skills Training Institutions (Non-Schooling Type)*. The draft is grounded in the *Foreign Investment Law*, the *Private Education Promotion Law* and its implementation regulations, the *Sino–Foreign Cooperation in Running Schools Regulation*, and the Guangxi FTZ regulations. It applies to foreign-owned for-profit non-schooling vocational training institutions established within the片区, signalling that the wholly foreign-owned training model is moving from concept to rule text.

Other localities show the cooperative (rather than wholly owned) route is already live. Yunnan’s 2026 adjustment of its *Vocational School Operating Licence Implementation Specification* (announced 20 March 2026) explicitly lists the sub-item “licensing for Sino–foreign, Guangdong/Hong Kong/Macao, and cross-strait cooperative vocational-skills training institutions”, with provincial-level approval and a minimum scale of simultaneously training no fewer than 200 persons. This confirms that cooperative vocational training is an established, approvable pathway even outside FTZs.

Compliance checklist

A foreign investor entering vocational training should plan around six pillars:

  1. Form choice: decide schooling vs. non-schooling. Non-schooling for-profit training is the pilot-opening segment; schooling-type or degree-granting activity remains constrained and generally requires cooperative (not wholly foreign-owned) structures.
  2. Licensing: obtain the private non-school education/training operating licence from the competent education or human-resources/social-security authority, then complete business registration. Operating without a licence is prohibited.
  3. Negative-list and FTZ alignment: anchor in a zone (e.g., Nanning Guangxi FTZ, or other FTZs issuing implementing rules) where the pilot explicitly permits the chosen model.
  4. Scale and faculty: meet setting standards — Yunnan’s cooperative standard requires capacity for at least 200 simultaneous trainees, qualified teachers and managers, and matching premises, equipment and curriculum.
  5. Fee supervision: vocational training fees fall under the national off-campus training supervision and service platform; pre-collected fees must enter a dedicated account, with caps (non-schooling off-campus training generally capped at RMB 5,000 per collection and no more than 3 months or 60 class-hours).
  6. Non-profit/for-profit split (if schooling): where the activity counts as schooling, the promoter cannot extract schooling gains if non-profit; for-profit requires the statutory classification and tax treatment.

Practical steps

  • Screen your offering: pure skills-upgrading for adults/employees fits the non-schooling training pilot; anything conferring a formal qualification trends toward schooling and cooperation.
  • Target an FTZ with a published or draft implementing rule (Nanning’s is open for comment in July–August 2026) and pre-engage the zone’s investment and education authorities.
  • Prepare the licence dossier early: articles, decision-body list, premises proof, teacher qualifications, and a feasible funding source.
  • Build the fee-management and platform-onboarding process before enrolment; retrospective compliance is costly.
  • If you intend cooperative delivery, identify a qualified domestic partner and budget for provincial approval timelines.

  • 稳步扩大职业技能培训机构对外开放试点;
  • 稳步扩大职业院校对外开放试点;

Zhuhai–Macao Ports Upgrade the “Joint Inspection, One-Stop Release” Model: What It Means for Greater Bay Area Travel (August 2026) |

Why this matters now

On 18 August 2026, with approval from the Exit-Entry Administration and after coordination between the Zhuhai General Station of Exit-Entry Frontier Inspection and the Macao Public Security Police Force, three cooperation-inspection ports — Hong Kong–Zhuhai–Macao Bridge, Hengqin and Qingmao — began implementing three facilitation measures under the “joint inspection, one-stop release” (合作查验、一次放行) model. The measures expand the categories of travellers who can use the cooperation fast lanes and the “joint one-stop” vehicle lane, and simplify the documents that Macao and Hong Kong residents must present. For multinational companies with Greater Bay Area (GBA) operations, the change reduces the administrative cost of cross-border commuting between Zhuhai, Macao, Hengqin and Hong Kong — an increasingly important factor for regional headquarters, R&D and supply-chain staff.

What the three measures change

The first measure makes document handling more flexible. Macao residents and Hong Kong permanent residents travelling through the cooperation fast lanes at the three ports, and through the Hengqin vehicle lane, may now present either their ID cards or their Home Return Permit (including the version for non-Chinese nationals) in both directions. Previously, travellers had to switch documents depending on travel direction. The change effectively delivers “one-card clearance” and removes a common source of confusion at the gates.

The second measure widens the eligible population for the cooperation fast lanes. Chinese citizens who hold a one-year multi-entry People’s Republic of China Exit-Entry Permit, and who have completed the e-channel filing with both the mainland and Macao border inspection authorities, may use the fast lanes at the Hong Kong–Zhuhai–Macao Bridge port inspection hall and the Hengqin port (restricted to the ports for which they have filed). This is the latest step in a process that has gradually converged eligibility across different fast-lane categories.

The third measure is the most significant for foreign nationals. After completing e-channel filing, eligible foreigners and Taiwan residents may now drive through the “joint one-stop” vehicle lane at Hengqin port. Eligible foreigners include: those holding a foreign passport plus a Foreigner’s Permanent Residence ID Card; and those holding a foreign e-passport plus either a residence permit valid for more than six months or a multi-entry Chinese visa valid for more than six months (and who also meet Macao’s conditions for repeated entry). The lane, which has cut per-vehicle clearance from eight minutes to under 90 seconds since launch, now serves a much broader cross-border driving population.

Practical implications for business

For regional employers and their expatriate and cross-border staff, the practical effects are measurable. First, Hong Kong–Macao commuting for GBA staff becomes faster and less document-sensitive, which helps with meetings, audits and shift-based operations across Zhuhai and Macao. Second, foreign nationals who qualify for the Hengqin vehicle lane gain a materially faster route between Macao and Hengqin — the base for the Guangdong-Macao In-Depth Cooperation Zone — which is relevant for the growing number of foreign-invested operations in the zone. Third, the volume growth at these ports (42 million person-trips in the first half of 2026, up 12.8% year on year) signals sustained demand that makes smooth, compliant clearance a business-relevant capability rather than an administrative detail.

Practical steps for companies and travellers

  1. Check eligibility for the vehicle lane. Foreign staff who hold a permanent residence card, or a qualifying residence permit or long-term multi-entry visa plus Macao re-entry rights, should complete the e-channel filing with both border authorities before relying on the lane.
  2. Standardise document packs for fast lanes. Ensure Macao/Hong Kong resident employees use the Home Return Permit consistently in both directions and understand the “one-card” option.
  3. Update internal travel guidance. Mobility teams in the GBA should refresh instructions for mainland staff who hold the one-year multi-entry permit and wish to use the cooperation fast lanes.
  4. Plan clearance time realistically. Even with sub-90-second lanes, peak-hour queues remain; schedule cross-border meetings with buffer time.
  5. Keep filings current. E-channel registrations are tied to specific ports and document validity; renew passports, permits and visas in time to avoid losing the convenience.
  6. Watch for further port-level expansion. The model has been replicated across ports since 2018 and may extend to more crossing points and traveller categories.

Compliance notes

These are operational facilitation measures, not changes to immigration status or border-control legal requirements. Travellers must still hold valid documents and comply with the purpose-of-stay rules of their entry categories. The “one-stop release” speeds inspection but does not relax entry conditions; business visitors who need to work in China for longer periods or take up employment must still use the work permit and residence permit routes. Vehicle drivers must also meet all mainland and Macao driving and insurance requirements. As with all exit-entry policy, the practical implementation can be adjusted, so companies should verify current port-level rules before major cross-border events.

Zhuhai–Macao Ports Upgrade the “Joint Inspection, One-Stop Release” Model: What It Means for Greater Bay Area Travel (August 2026)

Shenzhen’s 19 Port Measures and the Greater Bay Area Opportunity for Foreign Business |

In August 2026 Shenzhen rolled out the *Several Measures for Optimising the Port Business Environment in 2026* — 19 concrete measures spanning clearance efficiency, infrastructure, inbound services and new trade forms. Released against the backdrop of the APEC leaders’ meeting hosted in the city, the package is the latest signal that the Greater Bay Area (GBA) is competing on cross-border convenience as much as on policy.

Clearance efficiency upgrades

The measures upgrade the port environment for the APEC meeting and beyond:

  • APEC green lane. A dedicated fast channel for APEC participants, with multilingual signage and translation/guidance materials.
  • Manufacturing-tailored clearance. Processes for raw-material import and finished-goods export are optimised for advanced manufacturing.
  • Qianhai “front-line direct, smart-linked supervision.” Eligible goods may be moved to the comprehensive bonded zone for sorting and consolidation before full clearance, under fully digital, visualised and intelligent supervision.
  • Border-inspection “zero-wait” arrival and “zero-delay” departure, plus maritime conveniences such as pre-arrival inspection and “leave-without-inspection” for departures.

Infrastructure and new trade forms

  • New Huanggang port opens with “co-operative inspection, one release” — a single crossing for both jurisdictions.
  • Luohu upgrade and Sham Chun Kok reconstruction proceed; the Shanwei Bay cold-chain inspection desk is operational.
  • Contactless passage via face recognition at road ports, with a face + iris smart lane piloted at Shenzhen Bay.
  • Cross-border low-altitude logistics. Shenzhen explores drone cross-border logistics and cross-border flight management, advancing Shenzhen–Hong Kong drone trial flights and eVTOL supervision research.
  • E-commerce reform. “Inspect-before-load” embeds customs checks into sorting/pick-and-pack, cutting handling loss; “Sunshine 2.0” builds a six-in-one (commerce, customs, exchange, tax, loan, insurance) oversight system, with classified management for white-list firms and facilitated rebates.

Inbound services and the foreign-visitor experience

The package directly improves the experience of foreign business travellers and residents:

  • Two new duty-free shops at ports and an “e-commerce pre-order, port pickup” model.
  • Departure-tax refund smart service islands and self-service terminals.
  • All-area payment demonstration zone: new or upgraded overseas-visitor payment service centres at key ports with foreign-card ATMs and currency exchange.
  • Upgraded “Shenzhen AI City Travel Card” integrating payment, transport and tourism.
  • Cruise and yacht liberalisation: expanded yacht free-trade waters, a “two-plate” management model for Hong Kong–Macao yachts, and self-service medical exams for licence conversion.

Why this matters for foreign investors

The GBA is where many foreign manufacturers, trading houses and brand operators concentrate their China footprint. The 19 measures cut two kinds of cost: time-at-the-border (faster clearance, smart supervision) and talent-and-travel friction (APEC lane, payment, tax refund). For firms moving goods through Qianhai or Shenzhen ports, the “front-line direct” model can compress working-capital cycles; for firms rotating expatriate and regional staff, the travel-card and payment upgrades reduce everyday friction.

Practical steps

  1. Map flows to measures. List your import/export lanes and staff-travel patterns; tag each against the 19 measures.
  2. Pilot Qianhai. If you import/export via Shenzhen, trial the “front-line direct” bonded model for consolidation.
  3. Use the APEC lane. Equip eligible staff with APEC cards to use the green lane during the meeting period and beyond.
  4. Join e-commerce white lists. If you sell cross-border, pursue the “Sunshine 2.0” white-list status for rebate facilitation.
  5. Brief travellers. Issue the AI city travel card and pre-register payment centres for visiting executives.

Greater Bay Area: opportunities for SMEs |

Overview

The Guangdong–Hong Kong–Macao Greater Bay Area (GBA) is a city-cluster strategy that bundles Hong Kong, Macao and nine municipalities in Guangdong province — Guangzhou, Shenzhen, Zhuhai, Foshan, Huizhou, Dongguan, Zhongshan, Jiangmen and Zhaoqing — into a single integrated economic space. As set out in the *Outline Development Plan for the Guangdong–Hong Kong–Macao Greater Bay Area* (issued by the CPC Central Committee and the State Council in February 2019), the GBA covers about 56,000 square kilometres and, as of 2017, had a population of roughly 70 million and an economic aggregate of around RMB 10 trillion (about USD 1.6 trillion in 2018). For a foreign small or medium-sized enterprise (SME), the GBA is not one market but a layered platform: a global financial and services hub in Hong Kong, a tourism-and-diversification base in Macao, and a vast advanced-manufacturing and innovation hinterland across the nine mainland cities.

This article explains, in practical terms, what the integration means for a foreign SME, how goods and talent now move across the “three customs territories and three legal systems”, and which incentives and market-access channels are realistically available to foreign-invested smaller businesses.

The integration framework and why it matters to SMEs

The GBA’s defining feature is what Chinese policy documents call “one country, two systems, three customs territories, three legal systems”. Hong Kong and Macao are separate customs territories with their own currencies, tax systems and common-law/civil-law traditions; the nine Guangdong cities sit inside the Mainland customs and legal system. Integration therefore does not mean merging the three systems — it means building “soft connectivity” (规则衔接、机制对接) so that factors of production flow more efficiently while each side keeps its own regime.

For an SME this has two consequences. First, the GBA gives a foreign firm a low-friction way to use Hong Kong as a regional holding, financing and IP base while operating production and sales on the Mainland side. Second, the integration agenda actively lowers friction for smaller players: simplified customs models, mutual recognition of professional qualifications, and a growing set of fiscal subsidies aimed at attracting overseas (including foreign, HK/Macao and Taiwanese) high-end and urgently-needed talent. The strategic positioning named in the Plan is fivefold — a world-class city cluster, an international science-and-technology innovation centre, a support pillar for the Belt and Road, a demonstration zone for in-depth mainland–HK/Macao cooperation, and a liveable, workable and tourist-friendly quality-living circle.

Cross-border flow of goods and talent

Goods: The Mainland and Hong Kong have rolled out the “cross-boundary lock” (跨境一锁) model across the GBA, and the Mainland–Macao version has started. Port clearance has been streamlined, with models such as “cooperative inspection, one-time release” (合作查验、一次放行) at the HZMB Zhuhai–Macao port and “one-stop two-system inspection” (一地两检) at Hong Kong’s West Kowloon station. For SMEs this translates into shorter transit times and lower logistics cost on cross-border shipments.

Talent: Cross-boundary mobility is the most practical benefit for a knowledge-intensive SME. The Mainland side has recognised or made facilitation arrangements for professional qualifications from HK/Macao in eight key fields — construction, healthcare, education, law, accounting, tourism and others. Hong Kong and Macao residents working in the nine cities are, subject to local rules, now able to buy property, enroll their children in local schools, and participate in the local social-insurance system. For foreign (non-Chinese) staff, the GBA’s talent policies are layered on top of national visa and work-permit rules, and several cities operate “green channel” pathways for research and innovation leaders.

Capital: On the financial side, a unified RMB/foreign-currency cross-border cash-pool business has been launched, the cross-boundary Wealth Management Connect (跨境理财通) pilot is advancing, and cross-boundary motor-vehicle insurance (“one policy, three places”) is being trialled. These are most relevant to SMEs with cross-border treasury needs, though they remain subject to mainland capital-account and conduct rules.

Incentives and market access for foreign SMEs

The single most relevant fiscal tool for a foreign SME with people in the GBA is the individual income tax (IIT) subsidy for overseas high-end and urgently-needed talent. Under the *Notice on Preferential Individual Income Tax Policies for the Guangdong–Hong Kong–Macao Greater Bay Area* (Cai Shui [2019] No. 31) and its extension *Cai Shui [2023] No. 34, the nine Guangdong cities grant a fiscal subsidy equal to the difference between the IIT actually paid and the Hong Kong tax level, and that subsidy is exempt from IIT. In practice the effect is that the effective top burden is capped at roughly 15% for qualifying individuals. The policy currently runs through 31 December 2027. Eligibility is determined by Guangdong and the respective city governments, and the subsidy is capped per taxpayer per year (for example, Guangdong sets a maximum of RMB 5 million per taxpayer per year under local implementing rules).

For the enterprise itself, market access follows the national negative list for foreign investment (the 2024 version cut nationwide restrictions to 29 items, with manufacturing fully opened), and inside the GBA’s pilot cooperation zones — Qianhai (Shenzhen–HK modern services), Nansha (Guangzhou), Hengqin (Guangdong–Macao) and the HK–SZ Loop (Heung Yuen Wai / Futian) — additional openness and facilitation apply. Foreign SMEs in advanced manufacturing, cross-border services, technology and healthcare should check both the national list and the local pilot catalogue, because the zone’s more liberal rule applies within the zone.

Practical landing paths

Most foreign SMEs enter the GBA through one of two doors. Door one is Hong Kong: incorporate a Hong Kong company to hold IP and regional contracts, then set up a Wholly Foreign-Owned Enterprise (WFOE) or representative structure in a GBA mainland city for production and sales. Door two is a direct mainland WFOE in one of the cooperation zones, which can offer sector-specific opening and administrative convenience. The Qianhai, Nansha and Hengqin plans each “misalign” their positioning — Qianhai leans modern services, Nansha leans comprehensive cooperation and shipping, Hengqin leans Macao diversification — so the choice of zone should follow the business model rather than a generic “GBA” label. Guangdong has also built a network of youth innovation-and-entrepreneurship bases (around a dozen), through which HK/Macao and overseas young founders can access incubation, subsidies and local procurement links.

What to do next

  • Confirm whether your target sector is off the national foreign-investment negative list, then re-check the specific Qianhai / Nansha / Hengqin pilot catalogue for any extra opening.
  • If you will employ foreign or HK/Macao senior staff in the nine cities, model the IIT subsidy (Cai Shui [2019] No. 31 / [2023] No. 34) early — it can materially lower your fully-loaded employment cost through 2027.
  • Choose a landing zone by fit: Qianhai for services, Nansha for trade/shipping, Hengqin for Macao-linked activity, the Loop for R&D.
  • Use Hong Kong as your regional treasury, IP and contract hub where group structure allows, while operating a Mainland WFOE for substance.
  • Plan customs and logistics around the cross-boundary lock and streamlined port models if you move goods between HK/Macao and the mainland.
  • Engage a local adviser on professional-qualification recognition before relocating key technical or professional staff.

Greater Bay Area 2026: foreign-investment opportunities in healthcare and cross-border medical services | 2026

Overview

Healthcare is one of the most attractive — and most regulated — sectors for foreign investors in the Greater Bay Area (GBA). Two forces converge in 2026. First, the “Hong Kong/Macao medicine pass” (港澳药械通) has matured from a regional pilot into a strategic channel that multinational innovators treat as part of their China strategy. Second, the policy environment for foreign-invested medical services — wholly foreign-owned hospitals, Hong Kong/Macao-invested institutions, cross-boundary care — is being actively widened. For a foreign healthcare group, the GBA is no longer just a sales market but a place to run clinical evidence, pilot cross-boundary care and anchor regional operations.

This article maps the 2026 opportunity across three layers: innovative drugs and devices via the medicine pass, foreign-invested and Hong Kong/Macao medical institutions, and cross-boundary medical services and data.

The medicine pass: from pilot to strategic channel

The 2026 multinational-pharma GBA roundtable, held in Guangzhou on 28 January 2026 and hosted by the Guangdong Development Reform Commission (Provincial GBA Office), brought together leaders from 15 multinationals — Johnson & Johnson, Pfizer, AstraZeneca, Bayer, Novartis, AbbVie, Sanofi and others — with Guangdong and nine-city governments. The message from firms was consistent: the GBA’s market potential and innovation ecosystem make it a strategic location, and the medicine pass is the fastest route for innovative products.

The pass has expanded sharply. The number of Hong Kong/Macao drugs and devices approved for use in the GBA rose from 48 in 2023 to 146 (another source cites 149) by early 2026, and designated medical institutions grew from 19 to 71, covering all nine GBA cities. By late April 2026 the approved total reached 162 innovative products (71 drugs, 91 devices), serving over 17,000 patient-visits. Guangdong has enacted the *Regulations of Guangdong Province on the Import of Hong Kong and Macao Drugs and Medical Devices in the Nine GBA Mainland Cities*, standardising filing and approval and raising efficiency.

For foreign innovators the decisive advantage is speed and evidence. Industry experts note that, versus the traditional registration path, products can clear the medicine-pass access process in as little as six months. Just as important, the pass supports real-world study (RWS): Guangdong has issued supporting policies allowing public hospitals to collaborate with firms on RWS and detailing the filing process. Seven multinationals have already run nine RWS projects with four GBA medical institutions. A notable case is Pfizer’s migraine drug rimegepant, whose prospective single-arm multi-centre RWS was completed in three months using Guangzhou’s rich clinical resources.

Foreign-invested and Hong Kong/Macao medical institutions

On the services side, Qianhai has issued what it describes as the nation’s first policy supporting the clustered development of Hong Kong/Macao and foreign-invested medical institutions, and is advancing a wholly foreign-owned hospital pilot. The cluster already comprises 14 international medical institutions with 4,045 beds, and overseas-patient visits grow over 10% annually. Under “talent connect”, Shenzhen’s first Hong Kong nurse registered to practise in Qianhai, six Hong Kong-style family-doctor studios opened, and 44 overseas medical experts are resident. Under “medicine connect”, the pass covers five tertiary hospitals in the cooperation zone with 60 approved items serving over 2,300 patient-visits. Under “ambulance connect”, cross-boundary transfer achieves “no-exit clearance, point-to-point direct” with transfer time cut by 80%.

The June 2026 *Action Plan for Stabilising and Optimising Foreign Investment* (MOFCOM, NDRC, MOF) explicitly supports studying and expanding the geographic scope of the wholly foreign-owned hospital pilot. The existing pilot covers nine localities — Beijing, Shanghai, Tianjin, Nanjing, Suzhou, Fuzhou, Guangdong, Shenzhen and the whole of Hainan island — and the plan signals further expansion. It also supports bringing more innovative drugs and devices into commercial insurance coverage and facilitating foreign-invested drugs into retail channels.

Cross-boundary medical services and data

Cross-boundary care is becoming operational. The University of Hong Kong–Shenzhen Hospital — a GBA cross-boundary medical benchmark — is among the first medicine-pass pilot hospitals, has introduced 34 international drugs and 18 devices serving over 7,500 patient-visits, and hosts nearly 100 Hong Kong-registered doctors. It runs a Futian port direct shuttle (one-hour cross-boundary) and has built one-stop cross-boundary diagnosis with multi-language service and direct insurance settlement.

Data and payment rails are being built. Shenzhen–Hong Kong medical-data cross-boundary security channels transmitted over 6.79 million medical files in four months. Under “payment connect”, Shenzhen’s first “medical insurance + commercial insurance” one-stop service centre supports overseas cards and digital RMB; six institutions connect to international insurers for instant settlement. Guangzhou’s ten measures on the medicine pass (issued 30 March 2026) add a quarterly Guangzhou–Hong Kong–Macao consultation mechanism, an RWS collaboration network, and support for commercial-insurance inclusion and cross-boundary electronic payment.

Practical pathways for foreign investors

  • For innovative products: treat the medicine pass as a China strategy, not a regional sideline. Identify clinical-need products already approved in Hong Kong/Macao, file through designated hospitals, and pair access with an RWS plan to generate national-registration evidence.
  • For services: use the Qianhai / Nansha / Hengqin platforms and the expanded wholly foreign-owned hospital pilot to establish or partner with international medical institutions; anchor on the “ten connect” model (institution, talent, medicine, service, ambulance, payment, data, education, guarantee, elderly care).
  • For payers and insurers: build direct-billing and commercial-insurance links; the GBA is piloting “medical insurance + commercial insurance” one-stop settlement and cross-boundary e-payment.
  • For evidence: collaborate with GBA hospitals on RWS; several multinationals already run such projects and the policy framework is explicit.
  • Compliance: the pass is bounded to designated hospitals and approved indications; products still need national registration for nationwide scale, and data crossing must follow the negative-list and security-channel rules.

Greater Bay Area 2026: mutual recognition progress for Hong Kong and Macao professionals practising north | 2026

Overview

A recurring bottleneck for foreign-invested and Hong Kong/Macao-invested businesses in the Greater Bay Area (GBA) is talent: can the professionals they rely on — lawyers, doctors, tax agents — actually practise north of the border? The 2026 picture is one of steady, pragmatic liberalisation concentrated in three professions, each with its own mechanism. Lawyers move through a statutory pilot with an expiry date; lawyers’ recognition is the most advanced and most politicised. Doctors move through CEPA-based facilitation and the “Hong Kong/Macao medicine pass”. Tax agents move through a Qianhai–Shekou pilot that has already removed the examination barrier.

This article takes stock of where each profession stands in 2026, what the remaining conditions are, and what foreign-invested enterprises should watch.

Lawyers: a mature pilot facing a sunset clause

The GBA lawyer pilot originated from an August 2020 NPC Standing Committee authorisation allowing Hong Kong legal practitioners and Macao lawyers to obtain Mainland practicing qualifications and practise in the nine GBA mainland cities. A September 2023 decision extended the pilot by three years to 4 October 2026.

According to the State Council report deliberated at the 23rd session of the 14th NPC Standing Committee in June 2026, the Ministry of Justice has organised five GBA lawyer examinations; more than 2,000 Hong Kong and Macao lawyers registered, and 646 obtained the GBA lawyer certificate — 544 Hong Kong legal practitioners and 102 Macao lawyers. Geographically they cover all nine cities: Guangzhou 166, Shenzhen 351, Zhuhai 58, Foshan 13, Huizhou 11, Dongguan 19, Zhongshan 16, Jiangmen 6, Zhaoqing 6. Of the 646, 81 serve as arbitrators at Mainland arbitration institutions, 71 as commercial mediators, and 26 as specially-invited mediators at Guangdong courts. They practise in 190 law firms, including 106 in HK/Macao–Mainland joint-venture firms and 540 in Mainland firms.

The 2026 examination follows a clear calendar. The Ministry of Justice announcement (30 March 2026) sets online registration from 16 to 25 April, a compulsory legal-knowledge training before the exam, and the written test on 19 September in Shenzhen and Zhuhai. Two papers (objective and subjective) total 200 points; results and the pass line are published by January 2027.

A critical uncertainty is the 4 October 2026 sunset. The report notes broad support for elevating the pilot into an institutional arrangement, and stakeholders are watching whether it is extended again or codified.

Doctors: CEPA facilitation and the medicine pass

Medical recognition is broader but more layered. Under CEPA, Guangdong has rolled out a ten-point facilitation package for Hong Kong and Macao doctors — “short-term practice + multi-site practice + Hong Kong/Macao medicine pass + professional-title recognition”. By 2025, 95 Macao nursing graduates had passed the national nurse exam in Guangdong, 73 Hong Kong/Macao talents obtained professional-title assessments, 951 Hong Kong/Macao doctors had obtained Mainland physician qualifications and practise, and 277 practise short-term. Fifty Hong Kong/Macao-invested medical institutions operate in Guangdong.

For individual doctors, the Hong Kong/Macao physician qualification recognition (clinical, dental; TCM via the provincial TCM bureau) requires, among other things, lawful practice qualification in Hong Kong/Macao for at least five years before 31 December 2007, a specialist certificate, and current practice in a Hong Kong/Macao medical institution. The Guangdong government service portal shows an eight-working-day commitment for the recognition, fully online.

The “Hong Kong/Macao medicine pass” (港澳药械通) complements physician mobility: it lets specified Mainland GBA hospitals use drugs and devices already approved in Hong Kong/Macao, so a Hong Kong specialist can treat cross-boundary patients with familiar products. As of late April 2026, the pass covered 162 approved innovative drugs/devices (71 drugs, 91 devices) across 71 designated hospitals in all nine cities, serving over 17,000 patient-visits.

Tax agents: the Qianhai–Shekou breakthrough

The least visible but most procedurally radical change is for tax agents. The *Interim Measures for Hong Kong and Macao Tax Professionals Practising in the China (Guangdong) FTZ Shenzhen Qianhai–Shekou Area*, revised and issued by the Shenzhen Tax Bureau, removed the practice examination, widened eligibility from Hong Kong tax agents to Hong Kong and Macao tax professionals, dropped the 180-day practice requirement, and allowed them to establish tax-agent firms (treated as Mainland tax agents as shareholders). Registration, not examination, is the gateway.

The results are concrete: the first Hong Kong/Macao-invested tax-agent firm (Guozheng Zhengzheng) was established in Shenzhen in 2021, and the first tripartite Shenzhen–Hong Kong–Macao joint tax-agent firm (Hua Meng Ling Jun Liu Guo) was registered in Qianhai in November 2021. As of recent figures, 74 Hong Kong/Macao tax professionals have completed cross-boundary practice registration and 7 joint-venture tax-agent firms are administratively registered and operating. Supporting measures — the “18 measures for innovation in Qianshui tax-related services” and “15 measures to boost the Qianhai tax-service cluster” — have drawn the first batch of over 30 well-known tax institutions to the cluster.

Nansha’s recognition list and “practise first, file later”

Beyond the three professions, Nansha has built a broad recognition channel. Its 2.0 overseas professional-qualification list (issued January 2026) covers 248 foreign qualifications (112 from Hong Kong/Macao/Taiwan) and pairs with the *Nansha Measures for Hong Kong/Macao Professional Institutions and Professionals*. The standout innovation is “practise first, file later”: a Hong Kong/Macao-registered institution or individual with recognised qualifications may provide professional services in engineering, urban planning and medical fields in Nansha and complete confirmation within one month after practise. Nansha also recognises Hong Kong’s MPF and Macao’s social-security fund as equivalent, exempting dual social-insurance contributions for qualifying residents.

Practical implications for foreign-invested enterprises

  • Legal counsel: a foreign-invested enterprise with GBA disputes can now retain a GBA-licensed Hong Kong or Macao lawyer directly, and should brief counsel on the 4 October 2026 pilot horizon when planning multi-year engagements.
  • Medical cover: firms relocating staff to the GBA can leverage the medicine pass and cross-boundary medical facilities (e.g., the University of Hong Kong–Shenzhen Hospital) for international-standard care.
  • Tax and audit: Hong Kong/Macao-invested groups can use Qianhai-based joint tax-agent firms for integrated cross-boundary tax and audit, but must confirm the firm’s registration and the professional’s practise status.
  • Talent planning: track the lawyer-pilot sunset and the possible institutionalisation; otherwise build succession so key matters are not stranded if a licence lapses.
  • Entity and licence: recognition eases entry but does not eliminate the need for a compliant Mainland entity, local licence and social-insurance coordination.

Greater Bay Area 2026: landing wholly foreign-owned and Hong Kong/Macao-invested enterprises, and tax preferences | 2026

Overview

For a foreign or Hong Kong/Macao investor entering the Greater Bay Area (GBA), the single most consequential decision after choosing a sector is choosing a landing zone, because the GBA’s most generous tax preferences are geographically ring-fenced to three pilot platforms — Qianhai (Shenzhen–Hong Kong modern services), Nansha (Guangzhou trade and shipping) and Hengqin (Guangdong–Macao) — plus the HK–SZ Loop for R&D. Each runs its own “one zone, one policy” regime, and the preferences are real: a 15% corporate income tax (CIT) rate that brings the effective burden close to Hong Kong’s, twinned with individual income tax (IIT) subsidies for overseas high-end and urgently-needed talent.

This article explains, in practical terms, how a foreign-invested enterprise (FIE) or a Hong Kong/Macao-invested company actually lands in the GBA in 2026, what the tax preferences are, how “substantive operation” is now defined and evidenced, and what a prudent setup looks like.

Qianhai: 15% CIT extended to 2027, five eligible sectors

The Qianhai Shenzhen–Hong Kong Modern Service Industry Cooperation Zone pioneered the 15% CIT preference. In February 2026, the Ministry of Finance and the State Taxation Administration issued *Cai Shui [2026] No. 3*, extending the policy through 31 December 2027 and continuing to levy CIT at a reduced 15% rate on qualifying enterprises. The preference now covers the expanded 120.56 sq km Qianhai cooperation zone and applies to five sectors: modern logistics, information services, technology services, cultural creativity and business services.

On 9 February 2026, the Qianhai tax bureau and the Bao’an tax bureau, together with eight other departments, jointly issued an implementing announcement clarifying “substantive operation” (实质性运营). The stated intent is to stabilise market expectations while preventing empty-shell companies from improperly enjoying the preference.

What “substantive operation” now requires

Substantive operation is assessed across four dimensions — production/business, personnel, accounting and assets — all anchored in the zone:

  • Production/business in the zone: a fixed place and necessary equipment, with the main business location or the entity exercising substantive overall management and control located in Qianhai, and contracts concluded in the enterprise’s own name.
  • Personnel in the zone: employees actually working in Qianhai, paid through a bank account opened in Qianhai, with social-insurance contributions. A tiered headcount test applies: enterprises with fewer than 10 employees need at least 3 insured staff; those with 10–99 need at least 30%; those with 100+ need at least 30 insured staff for the year.
  • Accounting in the zone: accounting archives kept in Qianhai and the basic deposit account plus the main settlement account opened in Qianhai.
  • Assets in the zone: owned or used property actually employed in Qianhai and matched to the business.

The management model is “self-assess, commit, keep records”: the enterprise commits in its annual settlement, files a *Substantive Operation Self-Assessment Commitment Form*, and retains supporting documents (lease/title proof, board minutes, staff list and social-insurance evidence, accounting and bank materials, asset description). Tax authorities perform full coverage checks on new beneficiaries and proportionate spot checks on existing ones. Enterprises that merely book the zone for settlement, invoicing or tax filing without real functions are deemed non-compliant.

Nansha: the “dual 15%” package and a stabilisation award

Nansha’s preferences originate from the *Nansha Plan*. From 1 January 2022, enterprises in the Nansha launch zone in encouraged industries pay CIT at 15%; high-tech or technology SME key-industry enterprises may carry forward losses for up to 13 years; and Hong Kong/Macao residents working in Nansha receive a full refund of the IIT portion exceeding the Hong Kong/Macao tax burden.

The results are tangible. By end-November 2025, 60 enterprises had enjoyed the 15% CIT preference in Nansha, with cumulative tax relief exceeding RMB 2.1 billion; newly settled beneficiaries contributed over RMB 1.9 billion in tax and over RMB 50 billion in revenue. The Yuexiu iPark (Guangdong–Hong Kong Smart Valley) in the Qingsheng hub saw the number of Hong Kong/Macao enterprises grow fivefold in three years to over 210 registered or resident firms.

Nansha also layers a “foreign-investment stabilisation” award on top, reportedly up to RMB 50 million, requiring capital-verification and FDI-inward registration evidence. Both the 15% CIT and the awards generally run to 31 December 2026 for the current cycle, so timing matters.

Hengqin: Guangdong–Macao cooperation preferences

Hengqin applies CIT preferences to enterprises in the *Hengqin Guangdong–Macao Deep Cooperation Zone Preferential Industry Catalogue*, aligned to Macao diversification. In April 2026 the State Council approved Macao motor vehicles to enter other parts of Guangdong from Hengqin without a guarantee, and the customs authority is preparing supporting supervision measures — a concrete mobility benefit for Macao-invested operators.

Financial and talent facilitation supporting the landing

Beyond tax, the platforms ease the practical landing. In Nansha the FT account system has opened over 9,700 accounts with cross-border settlement near RMB 5 trillion, and the average time for Hong Kong-invested enterprises to complete RMB capital-account settlement was cut by over 50%. Guangzhou is accelerating the establishment of a GBA International Commercial Bank, deepening the “Nansha Finance 30 Measures”, expanding QDLP/QFLP pilots, and exploring cross-border “credit connect”. For talent, Nansha’s upgraded overseas professional-qualification recognition lists (2.0 version) cover 248 foreign professional qualifications (including 112 from Hong Kong/Macao/Taiwan) and offer rewards up to RMB 1 million for qualified holders, with a “practise first, file later” model in engineering, urban planning and medical fields.

Practical landing path

Most foreign and Hong Kong/Macao investors enter through one of two doors. Door one is Hong Kong: incorporate a Hong Kong company to hold IP, regional contracts and treasury, then set up a WFOE or branch in a GBA mainland platform. Door two is a direct Mainland WFOE inside Qianhai, Nansha or Hengqin, capturing the platform-specific tax and facilitation benefits. The choice should follow the business model: services and Hong Kong linkage favour Qianhai; trade, shipping and FT treasury favour Nansha; Macao-linked activity favours Hengqin.

What to do next

  • Confirm your sector is off the national negative list, then check the specific Qianhai / Nansha / Hengqin preferential catalogue for sector fit (main business revenue generally must exceed 60% of total revenue for the preference).
  • Model the 15% CIT saving early — for a profitable modern-services or technology enterprise the saving versus the standard 25% rate is material through 2027 (Qianhai) and ongoing (Nansha/Hengqin by their own terms).
  • Build substantive-operation substance before year-end: lease space, open the settlement account in the zone, relocate or hire the required insured headcount, and keep board and accounting records in the zone.
  • If employing Hong Kong/Macao or foreign senior staff, layer the IIT subsidy / refund on top of the CIT preference.
  • Track the 31 December 2026 deadlines for Nansha’s current award and preference cycle and plan capital injection and filing accordingly.

Greater Bay Area 2026: new facilitation for cross-border flow of people, goods and capital | 2026

Overview

The Guangdong–Hong Kong–Macao Greater Bay Area (GBA) is built on “one country, two systems, three customs territories, three legal systems”. Hong Kong and Macao are separate customs territories with their own currencies and legal traditions, while the nine Guangdong municipalities sit inside the Mainland customs and legal system. For a foreign investor, the GBA is therefore not a single frictionless market but a layered platform where the real value lies in “soft connectivity” (规则衔接、机制对接) — building bridges between the three systems so that production factors move more efficiently while each side keeps its own regime.

In 2026, against the backdrop of the “15th Five-Year Plan” opening year, the facilitation agenda has shifted from broad statements to concrete, operational measures. The most important development is the *Measures by the Customs Administration to Support the Development of the Guangdong–Hong Kong–Macao Greater Bay Area*, announced at a Guangzhou press conference on 21 May 2026, which sets out 20 specific measures across five dimensions. Complementing it are Guangdong provincial measures on infrastructure and rules, and Shenzhen’s 21-point business-environment action plan tied to the 2026 APEC ministers’ meeting. Together they materially lower the friction foreign-invested enterprises face when moving people, goods, capital and data across the GBA.

The May 2026 customs package: 20 measures in five dimensions

The 20 measures are organised around five themes: (1) integrated market development through rules alignment; (2) a science-and-innovation highland enabling efficient allocation of innovation factors; (3) new forms and models empowering foreign trade innovation; (4) a “dual circulation” logistics hub; and (5) pilot platforms such as Qianhai, Nansha, Hengqin and the HK–SZ Loop.

On trade performance, the context is strong: in 2025 the nine GBA mainland cities recorded total import–export value exceeding RMB 9 trillion; in the first four months of 2026 the figure reached RMB 3.4 trillion, up 18.4% year on year, contributing one quarter of the national increment in foreign trade. Port container throughput across the nine cities exceeds 60 million TEU annually, among the highest in the world.

Concrete customs innovations include:

  • “Single declaration, dual application” (一单两报): enterprises declare once and the data is applied on both sides, cutting declaration time by about half.
  • Expanded “cross-boundary lock” (跨境一锁): a single intelligent lock manages the whole journey, compressing cargo clearance time by roughly 30%.
  • “One-zone-one-policy” (一区一策): Qianhai, Nansha, Hengqin and the Loop each receive tailored customs support.
  • Unified GBA trade statistics: mainland customs will jointly compile and publish external goods-trade statistics for the GBA as a whole with Hong Kong and Macao customs, replacing the current patchwork of three separate datasets.

People flow: smoother movement and talent mobility

People movement is the most visible dividend. The GBA’s Hong Kong–Macao and Guangdong–Macao ports handle nearly 500 million passenger crossings per year, over 70% of the national total. The 2026 measures promote “one-stop” supervision for “Hong Kong/Macao vehicles going north” and “Guangdong vehicles going south”, and “AI +” driven “seamless customs clearance” to build a one-hour living circle.

On 29 May 2026, the Guangdong Development Reform Commission confirmed it will steadily advance “Guangdong vehicles going south” and “Greater Bay Area yacht free travel”, optimise personnel visa policies, expand the “Bay Area standard” and “Bay Area certification” regimes, and broaden mutual recognition of professional qualifications so that Hong Kong and Macao professionals can practise more easily in Guangdong. It also pledged to extend the “Hong Kong–Macao medicine and device pass” (港澳药械通), the “elderly health voucher” (长者医疗券) and the “Guangdong residential care service scheme” (广东院舍照顾服务计划).

For foreign (non-Chinese) staff, Shenzhen’s 2026 business-environment plan offers concrete entry facilitation: foreign senior managers establishing branches or subsidiaries in the Qianhai–Shekou free-trade片区 may obtain visas or residence permits valid up to two years, extended to accompanying spouses and family; AEO enterprises and trade headquarters enjoy relaxed APEC business travel card requirements; and urgent-entry port visas are available for critical foreign technical or management personnel.

Goods flow: ports, locks and bonded innovation

Goods benefit from three linked reforms. First, the “combined port / one-port-connect” (组合港 / 一港通) model and multi-modal (sea–rail, sea–sea) pilots let cargo move “one declaration, one document through”. Second, cross-border e-commerce “inspect first, ship later” (先查验、后装运) lowers logistics cost by about 30%. Third, for innovation factors, the package supports an expanded “positive list” for research materials, applies bonded supervision to imported inputs used in biomedical R&D, simplifies documentation, and explores lifecycle carbon-footprint management at customs clearance.

Agricultural and food supplies also see facilitation: a “product list + enterprise whitelist + risk monitoring” model for short-shelf-life foods destined for Hong Kong and Macao reduces on-site inspection frequency, while the “batch inspection” reform for export agri-food cuts on-site work by over 70%.

Capital flow: WMC, cash pools and FT accounts

The financial arteries are the most relevant for foreign treasury operations. Three instruments stand out:

  1. Cross-boundary Wealth Management Connect (跨境理财通): launched in 2021 and optimised in January 2024 (broader investor eligibility, securities firms included, wider product scope, higher quotas), it provides a closed-loop RMB channel for retail investors to hold cross-boundary investment accounts. Shenzhen’s 2026 plan goes further by allowing a three-party online communication channel (investor–HK/Macao seller–Mainland partner) inside pilot outlets, moving WMC from “limited contact” to “precision service”.
  2. Integrated local/foreign-currency cash pool (本外币一体化资金池): Shenzhen is deepening the pilot, bringing more qualified multinational groups into the scheme to centrally manage cross-border funds on a real-business basis.
  3. FT accounts: in Nansha, the free-trade account system had opened over 9,700 accounts with cross-border settlement approaching RMB 5 trillion, and the average time for Hong Kong-invested enterprises to complete RMB capital-account settlement was cut by more than 50%.

QFLP and QDLP pilots continue to widen: Guangdong’s QDLP quota approvals reached RMB 12.6 billion across nine institutions in the 14th Five-Year period, and over 500 foreign-invested QFLP projects were approved with quotas exceeding RMB 50 billion.南沙’s FT全功能资金池 exceeds 260 entities with FT loans above RMB 240 billion.

Data flow: negative lists and medical-data pilots

Data is the newest frontier. Shenzhen’s plan commits to issuing the China (Guangdong) Free Trade Zone negative list for cross-border data export, giving enterprises a clear, operable compliance reference. It also deepens the Shenzhen–Hong Kong cross-border data verification platform (targeting no fewer than 10 application scenarios) and pilots Shenzhen–Hong Kong medical-data sharing by connecting hospitals to Hong Kong’s “eHealth” system for mutual recognition of laboratory and imaging results.

Practical steps for foreign investors

  • Map your flows: decide whether your bottleneck is people, goods, capital or data, then identify the single measure that removes it.
  • Choose a platform by fit: Qianhai for modern services, Nansha for trade/shipping and FT treasury, Hengqin for Macao-linked activity, the Loop for R&D.
  • Use Hong Kong as a holding, financing and IP base while operating a Mainland WFOE for substance; plan treasury around WMC, the cash pool and FT accounts.
  • For R&D importers, apply the bonded-supervision and positive-list facilities for biomedical and high-tech inputs.
  • Engage a local adviser early on data-export compliance before moving operational systems across the border.

Healthcare & pharma market access (NMPA) |

Overview

Pharmaceuticals and medical devices are among the most heavily regulated products in China, supervised primarily by the National Medical Products Administration (NMPA). Market access hinges on registration, not merely on foreign approval: a drug or device lawfully sold in the EU or US generally cannot be marketed in China until it has gone through China’s own registration pathway and met Chinese standards.

This article explains the drug and device registration routes, clinical-trial requirements, and the practical steps a foreign pharma or medtech company should plan for. It is informational and must not be treated as regulatory or legal advice; confirm current requirements with the NMPA and qualified PRC counsel.

The NMPA and the marketing-authorisation-holder system

The NMPA (www.nmpa.gov.cn; English: english.nmpa.gov.cn) oversees drugs, medical devices, and cosmetics nationwide, supported by its centres for drug evaluation (CDE), medical-device evaluation (CMDE), and inspection. China operates a Marketing Authorisation Holder (MAH) system: the holder — which may be a domestic entity or, for imported products, the overseas manufacturer represented by a China responsible agent — bears the lifecycle responsibilities for a product. Foreign companies therefore need a registered China agent to act as the domestic responsible party for imported drugs and devices.

The MAH’s responsibilities are not limited to winning approval; they extend across the product’s life — pharmacovigilance and adverse-drug-reaction monitoring, post-market studies and risk-management plans, lot-release and traceability, and recall execution. For imported products, the China responsible agent stands in for the overseas MAH on these duties and can be held directly accountable by the NMPA for quality and safety failures in the China market. This makes agent selection a governance decision, not a paperwork one: the agent must have the regulatory capacity, quality-system interface, and personnel to discharge obligations such as timely adverse-event reporting and recall coordination. A weak agent is a recurring root cause of post-market enforcement actions.

Drug registration pathways

Chemical drugs are classified into five categories (Class 1 innovative, through Classes 2–5 for modified, generic, and imported/domestic equivalents), and biological products follow a parallel framework. A new innovative drug (Class 1) requires full non-clinical and clinical data generated to Chinese Good Clinical Practice (GCP) and Good Laboratory Practice standards. Generic drugs rely on bioequivalence and quality-consistency studies. Imported drugs are registered through the NMPA’s drug-evaluation centre, with dossiers submitted in the required CTD-style format and, for most new drugs, via the marketing-authorisation application after a completed clinical trial approved by the NMPA.

Clinical-trial requirements

Before a human trial in China, the sponsor must obtain NMPA approval (or, for certain listed trials, file a notification) and register the trial in the national drug-trial registration system. Trials must follow Chinese GCP; ethical review by a qualified institutional review board is mandatory, and the use of Chinese patient populations and sites is generally expected so that the data are relevant to the China population. The NMPA has, in recent years, aligned many technical guidelines with ICH standards to ease multinational, multi-regional trials, but local relevance and NMPA acceptance of overseas data still require careful planning.

A related point is the use of the communication channels (Pre-IND and formal communication meetings) with the CDE. The NMPA encourages sponsors to consult the centre at key milestones — before an IND for innovative drugs, on pivotal technical questions, and before the marketing-authorisation application. Meaningful communication materially reduces the risk of later demands for supplementary studies. For overseas-approved drugs that are clinically urgent and not yet marketed in China, conditional approval and priority-review pathways can shorten time-to-market, but they are conditioned on a commitment to complete confirmatory trials. Where overseas data are used for China registration, a racial-sensitivity (ethnic sensitivity) assessment and, where needed, bridging data should be anticipated.

Medical-device registration

Devices are tiered by risk into Class I (low), Class II (medium), and Class III (high). Class I devices are filed with the provincial NMPA office; Class II and III require NMPA or provincial registration (Class III and most Class II are registered with the NMPA/CMDE). Registration demands product technical requirements, type testing at an accredited lab, and a clinical evaluation or trial unless the device is exempt. Quality-system compliance (Good Manufacturing Practice for medical devices) is inspected, and overseas manufacturers of Class II/III devices must register their production site with the NMPA.

Another frequent blind spot in device registration is the choice of clinical-evaluation route. Not every Class II/III device requires a clinical trial: where a product is comparable to an already-marketed device of the same品种, a literature- and data-based “same-species” comparison can support exemption from trials; but novel or high-risk devices with no comparable predicate still need a trial. Companies should settle the clinical-evaluation strategy early — same-species comparison, trial exemption, or full trial — because it dictates the evidence-generation timeline and cost. In addition, the overseas manufacturing site of imported Class II/III devices must be registered with the NMPA, and the clean-room environment and quality system are subject to on-site inspection.

Post-market, labelling, and import considerations

Approved drugs and devices carry Chinese package inserts and labels; foreign-language-only labelling is not sufficient for the China market. Importers and responsible agents must maintain traceability and adverse-event reporting. Imported products enter through customs with the NMPA registration certificate as a key clearance document, and certain products face additional inspection by customs and SAMR. Reimbursement via the National Reimbursement Drug List and Volume-Based Procurement (VBP) are commercial-access factors a market-entry plan should weigh, though they sit outside the registration step itself.

A market-entry plan that stops at registration understates the real access barrier. The National Reimbursement Drug List (NRDL) negotiation and the Volume-Based Procurement (VBP, “集中带量采购”) program are the dominant commercial gateways: inclusion in the NRDL makes a drug reimbursable under basic medical insurance and unlocks hospital demand, while VBP tenders — which now cover many chemical generics, some biosimilars, and high-value devices — award volume in exchange for steep price cuts (often 50%–90%). Winning a VBP tender guarantees large, near-certain volume but at compressed margins, and losing can mean effective exclusion from public hospitals. Foreign companies should model the reimbursement and VBP scenario explicitly rather than treating them as downstream marketing concerns. Separately, data and market-exclusivity protections (e.g. for innovative drugs and paediatric/rare-disease indications) can shape the timing and defensibility of a launch.

Common pitfalls

  • Assuming foreign approval is enough. An FDA or EMA licence does not register a product in China. A separate NMPA pathway, meeting Chinese standards and often Chinese clinical data, is mandatory before any lawful marketing.
  • Relying on overseas trial data alone. Even where NMPA accepts foreign data under ICH-aligned guidance, trials are expected to follow Chinese GCP with local sites and Chinese patient populations; data without local relevance risks rejection or a requirement for bridging studies.
  • Treating the China responsible agent as a formality. The agent is the domestic MAH stand-in with real lifecycle duties — pharmacovigilance, recalls, traceability. A weak agent is a frequent root cause of enforcement.
  • Forgetting the registration certificate at customs. Import clearance hinges on the NMPA registration certificate as a key document; without it the product cannot enter, regardless of foreign readiness.
  • Planning only for registration, not reimbursement. For most drugs and many devices, NRDL inclusion and VBP outcome — not the registration grant — determine commercial viability in the China market.
  • Neglecting the device clinical-evaluation route analysis. Not all devices need trials, but the route choice (same-species comparison, exemption, or trial) sets the evidence cost and launch pace and should be settled at project kick-off.

What to do next

  • Identify the correct classification early (drug class, device Class I/II/III) because it dictates the entire evidence and review path.
  • Appoint a qualified China responsible agent to serve as the domestic party for imported-product registration and post-market duties.
  • Plan clinical trials to Chinese GCP with NMPA approval and local sites; do not assume overseas trial data alone will suffice.
  • Budget for type testing, stability studies, and GMP/site inspection lead times — these, not the fee, are usually the critical path.
  • Prepare Chinese labelling, inserts, and a pharmacovigilance/traceability system before launch.
  • Check reimbursement and VBP exposure as part of the commercial case, separate from registration.
